An Ordinance specifying and selecting the materia]. to be used
and letting a contract for the re -curbing and guttering
of Fifth Street in the City of Salina, Kansas from the
south line of Ash street to the north line of Walnut
Street therein, (except the intersection of Fifth Street
with Iron Avenue) and for the re -paving of said Fifth
Street frorn the south line of Ash Street to the north
line of Walnut street therein.
BE IT ORDAINED by the Board of Commissioners of the Oity of
Salina, Kansas:
Section 1. That it is hereby determined that Fifth Street
in the City of Salina, Kansas from the south line of Ash
Street to the north line of Walnut otreet.in said pity, OExcept-
ink; the intersection of Fifth Street with Iron Avenue) be
re -curbed with separate concrete curb, said concrete curb to be
22 inches deep, 6 inches at top and 7 inches at bottom.
Section 2. That it is hereby determined that Fifth
Street in the City of Salina, Kansas from the south line of
Ash Street to the north line of Walnut Street in said City
(excepting the intersection of Fifth Dtreet with Iron Avenue)
be glittered with concrete gutter, said t;u.tter to be 4 feet
wide, 6 inches deep and to be placed outside of the present
pavingline on each side of said street.
Section 3. That it is hereby determined that Fifth
Street in the City of Salina, xansas from the south line of
Ash Street to the north line of Walnut Street in said Uity
be re -paved by :the construction of a new five inch concrete
base where necessary to replace the present concrete base in
said street, the reshaping of the present sand cushion so as
to form a new sand cushion ]. inch thick, new sand to be used
as necesse.ry to complete said 1 inch sand cushion and by the
removing and turning and replacing of the present 4 inch
brick blocks constituting the present wearing surface of the
pavement on said street and the replacing of defective or
broken brick block with now brick block of the same size and
quality and by the placing of asphalt filler between and over
the surface of said brick blocks placed as above specified.
Section 4. that the present curb and all the present
sidewalk in saidd street lying within four feet on each side
of the present paving line of said street and all the earth
within said space necessary to be removed for the construction
of said curb and gutter above provided for be excavated and
removed and that all filling and rolling necessary for the pro-
per construction of all of the improvements herein above provided
for shall be done and all of such improvements shall be made and
doneinstrict conformity and in compliance with the plans and
specifications heretofore made by the City Engineer of Salina,
L'ansas and now on file with the City Clerk of said City, which
said plans and specifications are hereby incorporated in and made
a part hereof in all respects as fully and completely as though
written out at length herein; which said plans and specification
are hereby adopted as and for the plans and specifications of
such work and improvements.
Section 5. That a contract is hereby awarded to J. L. Rayl
for the re -curbing, guttering, re -paving and excavating and re-
moval of all material necessary for such work hereinabove mention-
ed within the limits aforesaid with the materials hereinbefore
provided and for the re -curbing and re -paving actually laid and
put in place and for the labor actually performed and the mater-
ial actually furnished, the follovring prices shall be paid:- For
excavating old curb and sidewalk, per cubic yard, $;2.10, For
excavating earth, Per cubic yard,, 80�; For Portland Cement Con
trete curb (using 1:2:4 cement -sand -crushed stone concrete base)
Per lineal foot, 54�; For Portland Cement Concrete gutter (Us-
ing 1:2;4 cement -sand -crushed stone concrete base) Per square
,yard, X2.20; For taking up present brick block wearing surface,
re -shaping present sand cushion and relaying brick block_ with
asphalt filler; complete according to the specifications of the
City Engineer lincluding the placing and layingof such new sand
cushion as may be necessary and such new brick block as may be
necessary but not including the cost of such new sand or neva
brick block) Per square yard, 65¢; r'or additional brick blocks
necessary to replace broken or condemned brick (using 32x4x82 inch
repressed block brick) Per M. 'x'46.25; For extra sand to be used
in sand cushion necessary to replace any condemned sand, Per _
cubic yard, ..2.25; r'or extra concrete to, be used in replacing
any defective or condemned concrete paving base to be placed
according to the directions of the City Engineer (using 1:32:52'
mixture, cement -sand -crushed stone, Price per cubic yard $14.00;
For new cement sidevialk, 4 inches thick, laid according to the
specifications for concrete sidewalks now on file in the
office of the City Engineer, Price per, square foot, 15�;
r'or tat{ing up and relaying, brick sidewalk where necessary
under the directions of the City Engineer, Price per square
foot, 9�.. All of said work shall be paid for according to
the measurement made by the City Engineer of the City of
balina. It is 'here by determined and found that the prices
to be paid for the improvements as aforesaid is less than
the estimated prices for said improvements, according to
the estimate made and prepared by the City -Engineer and now
on file in the office of the City Clerk of the City of
Salina, Kansas.
tivecticn 6. Said contract is awarded upon the express
condition that such work and ir;provements shall be done in stric t
accordance with and in compliance with the plans and speci-
fications of the City hbgineer therefor, which plans and spec-
ifications are hereby made a part of -this ordinance and of
the contract awarded to said J. L. Rayl, and upon the further
condition among others that said J. L. Rayl shall furnish to
the City of Salina a surety company bond of the approximate
sum of the cost of such improvements guaranteeing the prompt,
proper and workmanlike construction of all of the same and
indemnifying the City of Salina against loss or damage which
the "ity Taay sustain or suffer on account of injury to per-
sons or property caused or penr.itted by said contractor or
his employees, together with a surety company bond guaranteeig
such part of the concrete base as shall be replaced against
all defects in material and workmanship for a period of five
years from the date of its completion and acceptance by the
City, and guaranteeing said curbing and guttering aLainst all
defects in material and workmanship for a period of two years
from the date of its completion and acceptance by the eity,
together with a good and sufficient surety company bond running
to the State of Kansas in an amount approximately equal to the
contract price of said improvements, conditioned that said J.
L. Rayl shall pay all indebtedness for labor and material fur-
nished in the making of the improvements provided for herein.
Section 7,. The Board of Commissicners of the City of
Salina are hereby authorized to make and enter into on behalf
of said City all written agreements necessary to secure the con-
struction of the improvements herein provided for.
Section 8. This ordinance shall take effect and be in full
force from and after its publication once in the official City
paper.

An ordinance specifying and selecting the material to be used and
letting a contract for the re -curbing and guttering of r'ifth
Street in the City of Salina, Kansas from the south line of
Ash Street to the north line of Walnut Street therein, (ex-
cept the intersection of Fifth Street with Iron Avenue) and
for the re -paving of said r'ifth street from the south line
of Ash Street to the north line of vualnut street therein.
BE IT ORDAINED by the Board of Commissioners of the Uity of Salina,
bans as
Section 1. That it is hereby determined that Fifth Street in
the city of Jalina, Kansas from the south line of Ash 6treet to
the north line of walnut otreet in said City, (excepting the
intersection of Fifth street with Iron Avenue) be re -curbed with
separate concrete curb, said concrete curb to be six (6) inches
at top, seven (7) inches at bottom and twenty-two (22) inches deep.
Section 2. That it is hereby determined that Fifth otreet
in the City of oalina, Kansas from the south line of Ash Street
to the north line of Walnut Street in said City (excepting the
intersection of Fifth Street with Iron Avenue) be guttered with
concrete gutter, said gutter to be four (4) feet wide, six (6)
inches deep and to be placed outside of the present paving line on
each side of said street.
Section 3. That it is hereby determined that Fifth Street
in the City of Salina, Kansas from the south line of Ash Street
to the north line of Walnut Street in said City be re -paved by
the construction of a new five (5) inch concrete base where necess-
ary to replace the present concrete base on said street, the
reshaping of the present sand cushion so as to form a new sand
cushion one (1) inch thick, new sand to be used as necessary to
complete said one (1) inch sand cushion and by the removing and
turning and replacing of the present four (4) inch brick blocks
constituting the present wearing surface of the pavement on said
street and the replacing of defective or broken brick block with
new brick block of the same size and quality and by the placing
of an asphalt filler between and over the surface of said brick
block placed as above specified.
Section 4:. That the present curb and all of the present side- ,
walk in said street lying within four (4) feet on each side of the
present paving line of said street and all the earth within said
space necessary to be removed for the construction of said curb
and gutter above provided for be excavated and removed and that
all filling and rolling necessary for the propert# construction of
all of the improvements herein above provided for shall be done
and all such improvements shall be made 8nd done in strict conform-
ity and in compliance with the plans and specifications heretofore
made by the Uity Engineer of Salina, nansas and now on file with
the City Clerk of said City, which said plans and specifications
are hereby incorporated in and made a part hereof in all respects
as fully and completely as though written out at length herein;
which said plans and specifications are hereby adopted as and for
the plans and specifications of such work and improvements.

bond of the approximate sum of the cost of such improvements,
guaranteeing the prompt, proper and workmanlike construction of
all of the same and indemnifying the City of Jalina against loss or
damage which the City may sustain or suffer on account of injury
to persons or property caused or permitted by said contractor or
his employees, together with a surety company.bond guaranteeing
such part of the brick wearing surface as may be laid with new bridle
and such part of the conerete base as shall be replaced against
all defects in material and workmanship for a period of five (5)
years -from the date of its completion and acceptance by the City
and guaranteeing said curbing and guttering against all defects in
material and workmanship for a period of two (2) years from the date
of its completion and- acceptance by the city, together with a good
and sufficient surety company bond running to the Mate of Kansas in
an amount approximately equal to the contract price of said improve-
ments conditioned that said J. L. Rayl shall pay all indebtedness
for labor and material furnished in the making of the improvements
provided for herein.
Section 7. The Board of Commissioners of the Vity of Salina
are hereby authorized to make and enter into on behalf of said City
all written agreements necessary to secure the construction of the
improvements herein provided for.
Section S. This ordinance shall take effect and be in full force
from and after its publication once in the official City paper.
