AN ORDINANCE authorizing and providing for the issuance of Improvement
Bonds of the City of Salina, Kansas in the sum of $158,881.96
to pay the cost of improving certain streets and constructing
certain main and lateral sanitary sewers and constructing cer-
tain storm sewers in said city.
WHEREAS, pursuant to proceedings duly had according to law,
contracts have been let and performed for the construction of the
following street improvements in said city, to -wit:
Curbing, guttering, excavating, grading and paving Eleventh
Street from the north line of Elm Street to the south line of Bishop
Street;
Curbing and guttering the south side of Country Club Road
from the east line of Marymount Road to the west line of Hilldale Road;
Curbing, guttering, excavation, grading and paving South
Street from the west line of College Avenue to the east line of Montrose
Street;
Curbing, guttering, excavating, grading and paving of Montrose
Street from the north line of South Street to the north line of Morrison
Avenue;
Curbing and guttering Republic Avenue from the east line of
Fifth Street to the west line of Osborne Street (south of Republic)
and to the west line of Second Street (north of Republic);
Excavating, grading and paving Beloit Avenue from the west line
of Ninth Street to the east line of Highland Circle;
Curbing and guttering Chicago Street from the north line of
Ash Street to the south line of Park Street;
Curbing, guttering, excavating, grading and paving Minneapolis
Avenu-e from the east line of Santa Fe Avenue to the west line of Osborne
Street;
Excavating, grading and paving Crestview Drive from the west
line of Marymount Road to the west line of Hilldale Road;
Excavating, grading and paving East Park Lane from the north
line of Crestview Drive to the south line of Country Club Road;
Curbing, gutteringp excavating, grading and paving of Twelfth
Street from the south line of Iron Avenue to the north line of Walnut
Street;
Curbing, guttering, excavating, grading and paving Inez Avenue
from the west line of Ninth Street thence west approximately 660 feet
to west city limits;
Curbing,guttering, excavating, grading and paving Ninth Street,
from the north,line of Otis Avenue to the north line of Inez Avenue;
and
WHEREAS, the total cost of said improvements has been ascertained,
and the total portion thereof to be paid by a general tax to be levied
upon all the taxable property within said city for the improvement of
squares and areas formed by the crossing of streets and alleys, and for
the improvement of any of said streets where the same is through or ad-
jacent to property of the city for which the city is liable, and for which
bonds will be issued as hereinafter provided, has been ascertained and is
hereby determined and found to be the sum of $18,206.59; and
WHEREAS, the portion of said street improvements to be paid by
special assessment levied upon the lots and pieces of ground liable for
the payment of said street improvements has been ascertained and is hereby
found and determined to be the sum of $72,909.23, which said last amount
has been heretofore duly assessed and apportioned to the several lots and
pieces of ground on such streets liable therefore, payable in ten equal
installments, according to law, and as provided in the ordinances of the
City of Salina relating thereto duly passed and approved, of which amount
the sum of $30426.72 has been paid by the property owners liable therefore,
leaving a balance for which bonds are to be ':.issued in the sum of $69,482.51
and

WHEREAS, pursuant to proceedings duly had according to law
relating to the construction of certain improvements on certain
streets in the City of Salina, Kansas which connect existing pave-
ments in said city with certain county roads in Saline County,
Kansas, contracts have been let and performed for the construction
of the following improvements, to -wit:
Curbing, guttering, grading and paving Pacific Street from
the east line of Santa Fe Avenue to the center line of Front Street;
Curbing, guttering, grading and paving Crawford Avenue from
the east line of Tenth Street to the east line of Missouri Pacific
Railroad right-�di'"way; to-
the
and paving Country Club Road from the east line of
Marymount Road thence east 1880 feet to the corporate limits to
Hilldale Road, the south side of said Country Club Road lying
within said city and north side thereof lying in Saline County,
Kansas; and
WHEREAS, the total cost of said improvements have been aseertainel
and the portion thereof to be paid by the City at large by general
tax upon all taxable property within the city, including the 30 per-
cent of the total cost of said work and the amount for which the
city is liable on account of the improvement of streets adjacent
to property of the city, for which bonds are to be issued, has been
ascertained and is hereby determined and found to be the sum of
$199532.72; and
WHEREAS, the portion of the cost of said improvements to be
paid by special assessments against the private property within the
benefit districts liable for such cost, within the City of Salina,
has been ascertained and is hereby found and determined to be the
sum of $230225.87, which said last amount has been duly assessed
and apportioned to the several lots and pieces of ground in the
benefit districts, liable therefor, payable in ten equal annual
installments, according to law and as provided in the ordinances
of the City of Salina relating thereto duly passed and approved,
of which amount $879.00 has been paid in cash by the property owners
liable therefor, and leaving unpaid a balance of said amount in
the sum of $22,346.87 for which bonds are to be issued as herein-
after provided for; and
WHEREAS, ;pursuant to proceedings duly has according to law,
contracts have been let and performed for the following work:
The construction of main Sanitary Sewers in Main Sewer Districts
"N" and holt;
The construction of lateral sanitary sewers in Lateral Sewer
Districts No. 129, 130, 132, 133, 134, 135 and 140;
The construction of certain storm sewers designated as Storm
Sewers No. 5 and No. 7; and
WHEREAS, the cost of the main sanitary sewers constructed in
Main Sewer Districts 'IN" and 11011 and the lateral sanitary sewers
constructed in Lateral Sewer Districts 129, 1300 132,133, 134, 135
and 140, to be paid by special assessments levied upon all the lots
and pieces of ground liable for the payment of said main and lateral
sanitary sewers in said main and lateral sewer districts last
mentioned, respectively, has been ascertained and is hereby found
and determined to be the sum of $250874.67 which amount has been
heretofore duly assessed and apportioned to the several lots and
pieces of ground liable therefor payable in ten equal installments,
according to law, and as provided in the cr dinances of the City of
Salina relating thereto duly passed and approved, of which amount
the sum of $12164.07 has been paid by the property owners liable
therefor, leaving a balance for which bonds will be issued in the
sum of $24,710„60; and
tHER.EAS, the amount to be paid by general taxation to be
levied upon all the taxable property within said city for the
construction of said storm sewer Nos. 5 and 7, for which bonds
will be issued as hereinafter provided, has been ascertained and
is hereby found and determined to be the sum of $4,602.67; and
WHEREAS, the total amount of said special assessment for which
bands will be issued as herein provided, in anticipation of said
special assessments which remain unpaid, has been ascertained and
is hereby found and determined to be the sum of $116.539.98, the
difference between the last named amount and the total amounts assessed
against private property for the improvements hereinabove mentioned
having been paid by the property owners liable for
such improvementss
whose property has been thereby discharged from any further assessment
for the cost of said improvements in the amount so paid; and the total
amount for which bonds will bel issued to be paid by general taxation
upon all the taxable property in the City of Salina has been determined
and found to be the sum of $42,341.98, making a total amount for which
bonds are to be issued in the sum of $158,881.96; NOW THEREFORE
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. `That for the purpose of providing funds to pay
the cost of the improvements herein before described, there shall
be issued and hereby are issued Internal Improvement Bonds of the
City of Salina, Kansas, in the total principal sum of $158.881.96,
said issue shall consist of 159 bonds, numbered from 1 to 159, in-
clusive, bond numbered l being in the sum of $881.96, and bonds
numbered 2 to 159, inclusive, being in the sum of $1,000 each. All
of said bonds shall be dated August 1, 1927, and shall become due
serially as follows: $14,881.96 on August 1. 1928 and $16,000.00
on August 1 in each of the years 1929 to 1937, inclusive. All of
said bonds shall bear interest at the rate of 4l�% per annum, payable
semi-annually on February land August 1 in each year. Both bonds
and interest coupons shall become payable at the office of the State
Treasurer of the State of Kansas, in the City of 'Topeka, Kansas.
Section 2. Said bonds shall be executed by the Mayor and
shall be attested by the City Clerk, and the corporate seal of
the City shall be affixed thereto. Said bonds shall have attached
jthereto interest coupons representing the interest thereon and said�
interest coupons shall bear the fac-simile signatures of the Mayor
and City Clerk of said City.
Section 3. Said bonds shall be in the form and shall contain
recitals substantially as follows:

KNOWN ALL MEN BY THESE PRESENTS, That the City of Salina,
in the County of Saline, State of Kansas, acknowledges itself to
be indebted and for value received hereby promises to pay to the
bearer the sum of
ONE THOUSAND DOLLARS
in lawful money of the United States of America, on the first day
of August, 19 , with interest thereon from the date hereof at the
rate of four nd one-half per cent (4—.1%) per annum, payable semi-
annually on the first days of February and August in each year on
presentation and surrender of the interest coupons hereto annexed
as said coupons severally become due, both principal and interest
of this bond being payable at the office of the State Treasurer of
the State of Kansas, in the City of Topeka, Kansas. And said City
Of Salina, Kansas, is held and firmly bound by these presents and
the full faith;, credit and resources of said city are hereby
irrevocably pledged for the payment of said principal and interest
at maturity.
h This bond is one of a series of 1.59 bonds of like date and
tenor, excepting denomination and maturity, aggregating the principal
sum of 0158,881.96, issued by the City of Salina, Kansas for the pur-
pose of paying the cost of improving certain streets in said City,
including public highways, connecting existing pavements in said
City with certain county roads at the corporate limits of said City,
and to pay the cost of constructing certain main and lateral sanitary
sewers and certain storm sewers in said City, by the authority of
and in full compliance with the provisions, restrictions and limi-
tations of the Constitution and laws of the State of Kansas, includ-
ing Sections 10-101 to 18-115, 12-601 t&10, 12-617 to 12=675"and 13-
1032 to 13-1035 of the Revised Statutes of Kansas, 19230 and all
kamendments thereof, and all other provisions of the laws of said
' State applicable thereto, and this bond and all of the other bonds
of this series, and all interest thereon are to be paid by said City
of Salina, Kamsas.
And it is hereby declared and certified that all acts,
conditions and things required to be done and to exist precedent:
to and in the issuance of this bond have been properly done and
performed and do exist in due and regular form and manner as re-
quired by the Constitution and laws of the State of Kansas, and
j that the total indebtedness of said City, including this series
of bonds, does not exceed any constitutional or statutory limitation_.
IN WITNESS WHEREOF, the said City of Salina, Kansas, has
executed this bond by causing it to be signed by its Mayor and its
corporate seal to be hereto affixed, attested by its City Clerk,
and the coupons hereto attached Lobe signed with the fac-simile

lots and pieces of ground liable for the payment of said main and

last mentioned, respectively, has been ascertained and is hereby
found and determined to be the sum of $ 25 874.67which amount has
been heretofore duly assessed and appor one to the several lots
and pieces of ground liable therefor payable in ten equal install-
ments, according to law, and as provided in the ordinances of the
City of Salina relating thereto duly passed and approved, of which
amount the sum of $1,164.07has been paid by the property owners
liable therefor, leav�a"balance for which bonds will be issued
in the sum of $24,710.60 ; and
WHEREAS, the amount to be paid by general taxation to be
levied upon all the taxable property within said city for the
construction of said storm sewer Nos. 5 and 7, for which bonds
will be issued as hereinafter provided, has been ascertained and
is hereby found and determined to be the sum of $ 4,602.67 ;
and
WHEREAS, the total amount of said special assessment for which
bonds will be issued as herein provided, in anticipation of•said
special assessments which remain unpaid, has been ascertained and
,is hereby found and determined to be the sum of $116 539.98 , the
difference between the last named amount and the otil amounts
assessed against private property for the improvements hereinabove
mentioned having been paid by the property owners liable for such
improvements, whose property has been thereby discharged from any
further assessment for the coe; of said improvements in the amount
so paid; and the total amount for which bonds will be issued to
be paid by general taxation upon all the taxable property in the
City of Salina has been determined and found,to be the sum of

BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. That for the purpose of providing funds to pay

inclusive, bond numbered 1 being in the sum of $881.96, and bonds
numbered 2 to 159, inclusive, being in the sum of $1,000 each.
All of said bonds shall be dated August 1, 1927, and shall become
due serially as follows: $14,881.96 on August 1, 1928 and f'r6 000.00
on August 1 in each of the years 1929 to 19370 inclusive, All of
said bonds shall bear interest at the rate of 4-16. per annum, pay-
able semi-annually on February 1 and August 1 in each year. Both
bonds and interest coupons shall become payable at the office of
the State Treasurer of the State of Kansas, i.in the City of Topeka,

Section 2. Said bonds shall be executed by the Mayor and

compliance with the provisions, restrictions and limitations of the
Constitution and laws of the State of Kansas, including Sections
10-101 to 10-115, 12-601 to 12-610, 12-617 to 12-675 and 13-1032 to
13-1035 of the Revised Statutes of Kansas, 1923, and all amendments
thereof, and all other provisions of the laws of said State applicable
thereto, and this bond and all of the other bonds of this series, and
all interest thereon are to be paid by said City of Salina, Kansas.
And it is;hereby declared and certified that all acts, conditions

I, the undersigned, City Clerk of the City of Salina, Kansas
hereby certify that the within Internal Improvement Bond of the
City of Salina, Kansas,.has been duly registered in my office
according to law.

I, Will J. French, Auditor of the State of Kansas, do hereby
certify that a transcript of the proceedings leading up to the
issuance of this bond has been filed in my office and that this
bond was registered in my office according to law this
WITNESS my hand and official seal.

Section 4. The Mayor and City Clerk are hereby authorized
and directed to prepare and execute the bonds hereinbefore described
and to advertise and sell the same in the manner provided by law,
and.. -.when duly executed.and registered, to deliver said bonds to
the purchaser or purchasers thereof on receipt of the purchase price.
Section 5. The full faith, credit and resources of the City
of Salina, Kansas, shall be, and the same are hereby irrevocably
pledged for the prompt payment of said bonds and all interest
thereon. The Board of Commissioners of the City of Salina,Kansas,
shall annually make provision for the payment of said bonds and the
principal thereof as the same become due by levying taxes and assess-
ments upon the property liable therefor as provided by law.
Section 6. This ordinance shall take effect and be in force
from and after its publication in the official city paper.
