3021 SignageOHDI .NAN.CE_Nu_302 An Ordinance relating to the construction, erection and main— tenance of signs in the city of -)alina, Kansas, the issu- ing of permits therefor, defining certain nuisances, pro- viding penalties for the violation of this ordinance and repealing all ordinances or parts of ordinances in conflict herewith. Section 1. No person or persons, corporation or company shall erect or cause to be erected or re -erected within the lim- its of the City of Salina, Kansas, any sign upon or attached to any building, across or over any street or public highway there- in, without first, before proceeding ,with the erection or hang- ing of. any such sign in :.aid City, obtaining a permit for such erection or hanging from the Building Inspector, and it shall be unlawful to proceed with the erection or hanging of any sign unless such permit shall first have been obtained. All such signs hereafter constructed or erected shall comply with and be erected in accordance with the provisions of this ordinance. Section 2. Before a permit is issued by the wilding In - specter the applicant therefor shall sign an application in writ- ing, which shall show the proposed location, size, nature and method of construction of such sign, and any other information which the Building Inspector may require in connection there- with. . If the sign to be erected, as shown by such application, conforms with the provisions of this ordinance, the Building Inspector shall, upon payment of a fee of 50�/ therefor, issue such permit. All such fees collected by the lu ilding Inspector shall be by him paid into the City Treasury between the lst and 10th of the month following their collection, with a report in duplicate to the City Clerk showing from whom and for what purpose such sums werecollected. Section 5. All signs erected flat against any building or struct- ure shall be securely anchored to such building or structure in a manner sufficient to withstand the weight of the sign and the probable wind pressure, the method of anchoring such signs in each case to be approved by the Building Inspector. Section 6. No sign hereafter erected or re -erected over or across any street or public thoroughfare or over or ,across any sidewalk or parkway therein, except signs having an area of 4 square feet or less, and not extending more than 3 feet from the building to which attached, shall be allowad to hang on a pole or rod in such a manner that the same will swing with the vfind, but shall be anchored so that the same will be rigid and self supporting, and no such signs shall have less than two side guy wiresand one guy wire supporting same from the top, except by special permission from the Building Inspector.when he may deem such guy wires unnecessary. No siEp which is now or hereafter er- ected shall be supported by a post or support placed in or upon any stree or public thoroughfare within the City of Salina, or in or upon any sidewalk or parkway therein, nor shall any such sign be supported by or attached to any tree in or upon any such street or other thoroughfare or any parkway or sidewalk therein. Section 7. All signs hereafter erected or re -erected, attached to buildings or structures and extending over a sidewelk, street or public thoroughfare, except signs having an area of 4 square feet or less and extending not more than 3 feet from the building, shall be erected with hinged brackets, the center of action of which shall be not more than 6 inches from the building or other structure to which the same is attached, so that the sign will swing to the building without falling,, should the side guy wires or braces become loosened from any cause,. The supports for any such sign shall be fastened to the building or structure in a safe and secure manner, sufficient to support the sign and to withstand the probable wind pressure, and shall be subject to the approval of the Building Inspector. Section 8. All signs hereafter erected under the provisions of this ordinance shall have the final inspection and approval of the i'uilding Ir Spector upon notice to him of the completion of such sign, such approval to be evidenced by a certificate to that effect signed by the Building Inspector. Any person or corporation failing to notify the Building In- spector promptly upon the completion of any sign shall be deemed guilty of a -violation of this ordinance. Section 9. All signs now or hereafter erected shall be, at all times, subject to the inspection of the Building Inspector whenever any complaint has been made to him, or whenever he deems such inspection necesaa.ry. If the Inspector sh7 1, at any time, find any sign insecurely anchored or in any manner unsafe or in such condition that it or any support or part thereof, is liable to fall or break, lie shall have authority to either order the same entirely removed or, to order the same to be repaired or secured in such a manner as he may deem necessary, if in his opinion, it can be safely repaired or secured. Any person, whether the owner of the sigr or building to which it is attached or in charge of such buil.dingor the occupant thereof, or the agent, representative, offier or member of any firm or corporation owning such sign or owning or occupyin such building, or in charg( thereof, who refuses to comply with any such order shall be deeme< guilty of a violation of this ordinance. Section 10. Any sign hereafter erected or maintained con- trary to the provisions and requirements of this.ordinance, or .ny sign which may at any time be deemed by the Building Inspectol to be in an unsafe condition, shall be deemed and is hereby de- clared to be a nuisance and may be abated and ramoved at the cost of the owner thereof in the same manner as now provided for the abatement and removal of nuisances. Section 11. Flat signs having an area of 4. square feet or less on one side thereof, which do riot extend more than 3 feet from the building to which they are attached, may be supported by a pole or rod securely fastened to the building in a manner satisfactory to the Building Inspector and shall be otherwise supported in such a manner as the BudIding Inspector may direct. section 12. Any person who violates, neglects or refuses to comply with or who resists or opposes the enforcement of any of the provisions of this ordinance shall be deemed guilty of a mis- demeanor and upon conviction thereof shall be fined not less than $10.00 nor more than x;200.00 for each offense. Whenever in this ordinance the word °person" is ised, the same shall be deemed to apply to any agent, representative, member or officer of any firm or corporation owning or in charge of any signs in this ordinance mentioned, or owning occupying or in charge of any building to which such sign may be attached, or responsible for the erection or maintenance of any such sign. Each days contin- uance of any offense herein defined shall be deemed to be a separate offense and violation for each day in which such violation, neglect or refusal shall continue. Section 13. This ordinance shall take effect and be in full force from and after its publication once in the official City paper. Introduced for first reading, August 18th, 1924. BE IT ORDAINED by the Board of Commissioners of the,City of Galina, Kansas: Section 1. No person or persons, corporation or company shall erect or cause to be erected or re -erected within the limits of the City of Salina, Kansas, any sign upon or attached to any building, across or over any street or public highway therein, without first, before proceeding with the erection or hanging of any such sign in said City, obtaining a permit for such erection or hanging from the Building Inspector, and it shall be unlawful to proceed with the erection or hanging of any sign unless such permit shall first have been obtained. All such signs hereafter constructed or erected shall comply with and be erected in accordance with the provisions of this ordinance. Section 2. Before a permit is issued by the Building Inspector, the applicant therefor shall sign an application in writing, which shall show the proposed location, size, nature and method of con- struction of such sign, and any other information which the Building Inspector may require in connection therewith. If the sign to be erected, as shown by such application, conforms with the provisions of this ordinance, the Building Inspector shall, upon payment of a • 0 fee of 50� therefor, issue such permit. All such fees collected by the Building Inspector shall be by him paid into the City Treasury between the 1st and 10th of the month following their collection, with a report in duplicate to the City Clerk, showing from whom and for what purpose such sums were collected. All signs hanging over or across any street or public thorough e or sidewalk or parkway therein, within the cor- porate limits of said shall be at least 10 feet above such sidewalk, street or public th_o hfare, except that flat signs hav- ing an area on one side of square fe or less and which do not extend more than #.feet from the building which they are attached may be not less than 7-1/2 feet above such sidewalk street. } Section 5. All signs erected flat against any building or struct- ure shall be securely anchored to such building or structure in a manner sufficient to withstand the weight of the sign and the probable wind pressure, the method of anchoring such signs in each case to be approved by the Building Inspector. Section 6. No sign hereafter erected or re -erected over or across any street or public thoroughfare or over or across any sidewalk or parkway therein, except signs having an area of Z7square feet or less, and not extending more than feet from the building to which attached, shall be allowed to hang on a pole or rod in such a manner that the same will swing with the wind, but shall be anchored so that the same will be rigid and self supporting, and no such signs shall 0 0 46 have less than two side guy wires and one guy wire supporting same from the top, except by special permission from the Building Inspector when he may deem such guy wires unnecessary. No sign, which is now or hereafter erected, shall be supported by a post or support placed in or upon any street or public thoroughfare within the City of Salina, or in or upon any sidewalk or parkway therein, nor shall any such sign be supported by or.attached to any tree in or upon any such street or other thoroughfare or any parkway or sidewalk therein. Section 7. All signs hereafter erected or re -erected, attached to buildings or structures and extending over a sidewalk, street or public thoroughfare, except signs having an area of -& square feet or 3 less and extending not more than � feet from the building, shall be erected with hinged brackets, the center of action of which shall be not more than six inches from the building or other structure to which the same is attached, so that the sign will swing to the building without falling, should the side guy wires or braces become loosened from any cause. The supports for any such sign shall be fastened to the building or structure in a safe and secure manner, sufficient to support the sign and to withstand the probable wind pressure, and shall be subject to the approval of the Building Inspector. Section G. All signs hereafter erected under the provisions of this ordinance shall have the final inspection and approval of the Building Inspector upon notice to him of the completion of such sign, such approval to be evidenced by a certificate to that effect signed. by the Building Inspector. Any person or corporation failing to notify the building inspector promptly upon the completion of any sign shall be deemed guilty of a violation of this ordinance. Section 9. All signs now or hereafter erected shall be, at all times, subject to the inspection of the Building Inspector whenever any complaint hasbeen made of him, or whenever he deems such inspection necessary. If the Inspector,shall, at any time, find any sign in- securely anchored or in any manner unsafe or in such condition that it or any support or part thereof is liable to fall or break, he shall have authority to either order the same entirely removed or to order the same to be repaired or secured in such a manner as he may deen necessary, if, in his opinion, it can be safely rera ired or secured. Any person, whether the owner of the sign or building to which it is attached or in charge of such building or the occupant thereof, or oP the agent, representative, officer or member of any firm,/corporation owning such sign or owning or occupying such building, or in charge thereof, who refuses to comply with any such order thall be deemed:,,'. guilty of a violation of this ordinance. Section 10. Any sign hereafter erected or maintained contrary to the provisions and requirements of this ordinance, or any sign which may at any time be deemed by the Building Inspector to be in an unsafe condition, shall be deemed and is hereby declared to be a nuis- ance and may be abated and removed at the cost of the owner thereof in the same manner as now provided for the abatement and removal of other nuisances. Section 11. Flat signs having an area of Z - square feet or less 3 on one side thereof, which do not extend more than 2-49 feet from the building to which they are attached, may be supported by a pole or rod securely fastened to the building in a manner satisfactory to 0 to the Building Inspector and shall be otherwise supported in such a manner as the Building Inspector may direct. Section 12. Any person who violate6, neglects or refuses to comply with or who resists or opposes the enforcement of any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined not less.than $10.00 nor more than $200.00 for each offense. Whenever in this ordinance the word "person" is used, the same shall be deemed to apply to any agent: rep- resentative, member or officer of any firm or corporation owning or in charge of any signs in this ordinance mentioned, or owning occupying or in charge of any building to which such sign may be attached, or responsible for the erection or maintenance of any such sign. Each days continuance of any offense herein defined shall be deemed to be a separate offense and violation for each day in which such violation, neglect or refusal shall continue. Section 13. This ordinance shall take effect and be in full force from and after its publication once in the official City paper. Introduced for first reading, August 18th, 1924.
