AN ORDINANCE prohibiting the conducting or operating of sidewalk stands
in the City of Salina, and prohibiting the sale or offering
for sale of goods, wares or ,mer andise therein, except as here-
in provided, prohibiting the i ui.ng of licenses for said stands
providing a penalty for the v lation of this ordinance, and re-
pealing Ordinance No. 3415 p see July 5th, 1927.

ares or merchandise whatsoever, except

a stand for vending peanuts or opo corn, when the same is located in
front of and adjacent to such bu ding, and when the same does not
extend more than twenty five inche\nfont of the property line
of such building, upon the payment City of Salina, ofalicense tax for such stand in the $30.00 for each year or
portion thereof and provided howevt nothing in this ordinance
shall be deemed to permit any owner, less a or tenant of any such
building to assign to any other person the ight to conduct any such
stand.in front of such building, and provided further, that the Board
of Commissioners reserve the right to revoke.a license issued here-
under at any time if the same is in their opinio so maintained as to
be a muisance to the public, and that any such lie se may be revoked
at any time by said Board for any reason upon refund ng to the licensee
the pro rata part of:)the license fee paid for the unex ed term of
the license.
Section 2. `Ih t all ordinances and parts of ordinances now
in effect and authorizin the issuance of any license by the City
Clerk to any person for opo ation of any stand of any kind upon any

other person engaged in the same of any sue merchandise who may not
be required to obtain a license, whenever sue vendor, peddler, or

be reasonabVy, requ ed,to stop for temporary purposes.
Section 3, Tha any person., acting for himself or for any othe
person, firms co-partner sip or corporation who shall violate any
of the provisions of this dinanee or who shall operate any stand
herein permitted without -fir securing a �ieense therefor, shall
be deemed guilty of a misdeamea or and upon convicting shall be

fined in any sum.not.less than $ 5 0 for each offenses and each days
violation of this ordinance shall be eemed a separate offense.
Section 4. This ordinance shall take effect and be in force
from and after its publication in the of tial city paper*

offering for sale of goods, wares or merchandise therein,
except -as herein provided, prohibiting the issuing of licenses

BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. That from and after the taking effect of this
ordinance, it shall be unlawful for any person, firm, co -partnership
or corporation, either for themselves or for another, to operate or
conduct upon any public street or sidewalk in the City of Salina any
street or sidewalk stand of any kind., from which is sold or offered
for sale any fruit, vegetables,.ice.cream, pop corn,,drinks, garden
truck or any other goods,:wares or merchandise whatsoever, except
that the owner, lessee, or tenant of any business building -may operate
in connection with th'e business conducted by him in such~building,
a stand for vending peanuts or pop corn, when the same is located in
front of and adjacent to such building, and when the same does not
extend more than twenty five inches in front of the property line
of such building, upon the payment to the City of7Salina , of a
license tax for such stand in the sum of $30.00 for each year or
portion thereof and provided however, that nothing in this ordinance .
shall be deemed to permit any owner, lessee or tenant of any such
building to assign to any other person the right to conduct any such
stand in front of such building, and provided further, that the Board
of Commissioners reserve the right 'to revoke any license issued here-
under at any time.1f the same is in their opinion so maintained as.'to
be a nuisance to the public, and that any such license may be revoked
at any time by said Board for any reason upon refunding to the licensee
the pro rata part of the license fee paid for the unexpired term of the
license.
Section: 2. That all ordinances and parts of ordinances.now
in effect and authorizing the issuance of any license by the City
Clerk to any person for',operation of any stand of any kind upon any
of the streets or, sidewalks of the City of Salina, excep.t'as herein-
above pr6vided.for and all ordinances or parts of ordinances in conflict
therewith` are;,herby_repealed,_ provi'd6d however, that .nothing -herein
contained shall'be held to prohibit the sale of,vegetables,.fruit
or:garden truck -by a duly licensed vendor or peddler, or any other
person engaged in the same of any such merchandise who may.not be
required to obtain a license, whenever such vendor, peddler, or other
person shall keep the cart, wagon or other vehicle from which such
merchandise is'sold, moving, except when engaged in making a sale of
such merchandise and except at suchtime as such peron may be reason-
ably required to stop for:temporary purposes.
Section 3. That any person, acting for himself or for any other
person,_:firm,-co-part nership:-or_-corporati:on:_who-.shalh_violatd -any. . -.
of the provisiona of•this ordinance or who shall operate any stand
herein permitted without first securing a' -license therefor, sha31
be deemed guilty of a misdeameanor and upon convicting shall be fined
in any -sum not less than $5.00 nor more than $25.00 for each offense,
and each days violation of this ordinance shall be deemed a separate
offense.
ni Section 4. This ordinance shall take effect and be in force from
and after its publication in the official city paper.
