3418 Levy Assessments1 ORDINANCE NO. 3418 (Published in the Salina Journal Ai 1927) AN ORDINANCE relating to and apportioning and levying special assess- ments on certain lots and pieces of ground in the City of Salina, Kansas, to pay the cost of curbing and guttering, excavating, grading and paving Pacific Street from the east line of Santa Fe Avenue to the-cen er 11ne o Front Street in Salina, Kansas, and relating to and providing for the collection and payment of such assessments. WHEREAS, pursuant to Resolution Number 404 duly adopted by the Board of Commissioners of the City of Salina on February 7, 1927 and which resolution was duly adopted and ratified by the Board of County Commissioners of Saline County, Kansas as required by law and in accordance with Ordinance Number 3343 of said city duly passed on March 14, 1927, and Ordinance Number 3365 of said city, duly pa4ssed on May 2, 1927, a contract has been let for the curbing, guttering, grading and paving of Pacific Street in said city con- necting the existing pavement on Santa Fe in said city with a cer- tain county road in Saline County extending west from the city limits of said city at Front Street, which said improvement is to be paid for in accordance with provisions of Section 13-1032 to 13-1035, inclusive, of the Revised Statutes of Kansas 1923 as follows: 30 percent by the City of Salina, Kansas; 30 percent by Saline County, Kansas; and 40 percent by the property liable to special assessment as provided by law; and WHEREAS, the cost of said improvement as determined by the final estimate of the City Engineer of the City of Salina, filed in the office of the City Clerk as provided by law on the 5th day of July, 1927 has been determined and found to be the sum of $26,411.40, which amount 30 percent thereof or $7,923.42 is to be paid by the City of Salina, and 30 percent thereof or $7,923.42 is to be paid by Saline Country, Kansas, and the remaining 40 percent thereof or :10,564.56 is to be paid by the property liable to special assess- ment therefor as provided by law; NOW THEREFORE BE IT ORDAINED BY the Board of Commissioners of the City of Salina, Kansas: Section 1. That for the purpose of paying for that part of the cost of curbing and guttering, excavating, grading and paving of Pacific Street from the east line of Santa Fe Avenue to the center line of Front Street in the City of Salina, Kansas, which is to be paid for by the property onwers within the benefit dis- trict provided by law, there are hereby levied and assessed on the property liable therefor, being all the lots and pieces of ground lying on either side of said street above mentioned for the dis- tance improved, as aforesaid, to the center of the block according to the appraised value of such lots and pieces of ground without regard to the buildings or improvements thereon, special assessments covering that portion of the cost of such work and improvements assess- able against such property, said special assessments being based on the special valuation and appraisement of said lots and pieces of ground heretofore made by three disinterested appraisers, appointed by the Board of Commissioners of the City of Salina, Kansas and duly approved by the Board of County Commissioners of Saline County, Kansas, which said appraisement is hereby referred to and made a part of this ordinance, and the several amounts levied, apportioned and assessed against such lots and pieces of ground for the purpose aforesaid are hereby found and determined to be as follows: PACIFIC STREET FROM SANTA FE AVENUE TO CENTER LIME OF FRONT STREET Pacific Addition Lot 10 Block 8 ----------------------- W---$1076.41 3, S 1Lot 3 Block 8 ------------------------- 134.56 Lot 3, Block 8 ------------------== 104.66 S Lot 5, Block 8 ---------------------- - Said amounts levied, apportioned and assessed as aforesaid, shall be due and collectible in ten equal installments, the first becoming due with the taxes levied for the year 1927 and one of said installments falling due each and every year thereafter until all are paid, and all to be collected with interest as in this ordinance provided; PROVIDED, that the owner of any piece of pro- perty liable for any such assessment may redeen, his property from such liability by Paying into the City Treasury the entire amount charge- able against the same as in this ordinance designated, at any time within thirty clays after the publication of this ordinance and be- fore the issuance of the bonds of said City in payment of the balance of said improvements, and his property so paid on shall not there- after be liable for any further assessment for the cost of said im- provements, nor for any part of said bonds. Section 13). 'There is hereby further levied and assessed against each lot and piece of ground described in this ordinance 412 percent interest per annum on'all of said installments therein mentioned from the date of the bonds, which may be issued at the end of thirty days, as specified in the preceding section hereof, as by law pro- _F,2 vided, to the time of collection of the last installment as pro- vided by law, Which said interest shall be collected annually at the same time and in the same manner as said installments are collected; and after the taking effect of this ordinance it shall be the duty of the City Clerk of said City to annually at the same time other taxes are certified, and until all of said assessments so apportioned and levied herein have been certified, to certify to the County Clerk of Saline County, Kansas, a full list of all property liable to assessment and taxation for such work and im- provement except such property on which the special assessments aforesaid have been paid in full as hereinbefore provided, to- gether with the respective amounts due on each of such lots and pieces of ground, which amounts shall include the annual installments of such special assessments together with the interest for one year at the rate of 4.1 per cent per annum on all unpaid balances of such assessments at the beginning of each such year as aforesaid, and such amounts so certified as herein provided shall be placed upon the tax roll by the County Clerk of Saline County, Kansas, and collected as all other taxes are collected.
