AN ORDINANCE relating to and apportioning and levying special assess-
ments on certain lots and pieces of ground in the City of
Salina, Kansas, to pay the cost of curbing and guttering,
excavating, grading and paving Crawford Avenue from the east
line of Tenth Street to the east ne OF e Missouri Pacific
Railroad right-of-way in the City of Salina, Kansas, and re-
lating to and providing for the collection and payment of such
assessments.
WHEREAS, pursuant to Resolution Number 405 duly adopted by the Boardof
Commissioners of the City of Salina on February 7, 1927 and which reso-
lution was duly adopted and ratified by the Board of County Commissioners
Of Saline County, Kansas as required by law and in accordance with
ordinance Number 3344 of said city duly passed on March 14, 1927 and
ordinance Number 3366 of said city, duly passed on May 2, 1927, a con-
tract has been let for the curbing, guttering, grading and paving of Craw-
ford Avenue in said city connecting the existing pavement on Crawford
Avenue at Tenth Street in said city with a certain county road in Saline
County extending west from the city limits of said city at the Missouri
Pacific Railroad right-of-way, which said improvement is to be paid for
in accordance with provisions of Section 13-1032 to 13-1035, inclusive,
of the Revised Statutes of Kansas 1923 as follows; 30 per by the
City of Salina, Kansas; 30 percent by Saline County, Kansas; and 40 per
cent by the property liable to special assessment as provided by law;
and
WHEREAS, the cost of said improvement as determined by the final estimate
of the City Engineer of the City of Salina, filed in the office of the
City Clerk as provided by law on the 5th day of July, 1927 has been determined
and found to be the sum of $26,618.75, which amount 30 percent thereof
or '7,985.63 is to be paid by the City of Salina, and 30 percent thereof
or 7.985.62 is to be paid by Saline bounty, Kansas, and the remaining
40 percent thereof or $10,647.50 is to be paid by the property liable to
special assessment therefor as provided by law; NOW THEREFORE
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. That for the purpose of paying for that part of the
cost of curbing and guttering, excavating, grading and paving of Crawford
Avenue from the east line of Tenth Street to the east line of the Missouri
Pacific Railroad Right-of-way in the City of Salina, Kansas, which it to
be paid for by the property owners within the benefit district provided
by law, there are hereby levied and assessed on the property liable
therefor, being all the lots and pieces of ground lying on either side of
said street above mentioned for the distance improved, as aforesaid, to
the center of the block according to the appraised value of such lots
and pieces of ground without regard to the buildings or improvements
thereon, special assessments covering that portion of the cost of such
work and improvements assessable against such property, said special
assessments being based on the special valuation and appraisement of said
lots and pieces of ground heretofore made by three disinterested
appraisers, appointed by the Board of Commissioners of the City of Salina,
Kansas and duly approved by the Board of County Commissioners of Saline County,
Kansas, which said appraisement is hereby referred to and made a part
of this ordinance, and the several amounts levied, apportioned and
assessed against such lots and pieces of ground for the purpose aforesaid
are hereby found and determined to be as follows:

Section 2. Said amounts levied, apportioned and assessed as
aforesaid, shall be due and collectible in ten equal installments, the
first becoming due with the taxes levied for the year 1927 and one of
said installments falling due each and every year thereafter until all
are paid, and all to be collected with interest as in this ordinance
provided; PROVIDED, that the owner of any piece of property liable
for any such assessment may redeem his property.from such liability
by paying into the City Treasury the entire amount chargeable against
the same as in this ordinance d6signated, at any time within thirty
days after the publication of this ordinance and before the issuance
of the bonds of said City in payment of the balance of said improvements,
and his property so paid on shall not thereafter be liable for any
further assessment for the cost of said improvements, nor for any part
of said bonds.

Section 3, there is hereby further levied and assessed
against each lot and piece of ground described in this ordinance
42 percent interest per annum on all of said installments therein
mentioned from the date of the bonds, which may be issued at the end
of thirty days, as specified in the preceding section hereof, as by
law provided, to the time of collection of the last installment
as provided by law, which said interest shall be collected annually
at the same time and in the same manner as said installments are
collected; and after the taking effect of this ordinance it shall
be the duty of the City Clerk of said city to annually at the same
time other taxes are certified, and until all of said assessments
so apportioned and levied herein have been certified, to certify
to the County Clerk of Saline County, Kansas, a full list of all
property liable to assessment and taxation for such work and im-
provement except such property on which the special assessments
aforesaid have been paid in full as hereinbbfore provided, together
with the respective amounts due on each of such lots and pieces of
ground, which amounts shall include the annual installments of such
special assessments together with the interest for one year at the
rate of 42 per cent per annum on all unpaid balances of such assess-
ments at the beginning of each such year as aforesaid, and such
amounts so certified as herein provided shall be placed upon the
tax roll by the County Clerk of Swine County, Kansas, and collected
as all other taxes are collected.

AN ORDIivANCE relating to and apportioning and levying special
assessments on certain lots and pieces of ground in the
City of Salina, Kansas, to pay the cost of.grading and
paving Countr Club Road from the east line of Marymount
Road to t e west no or Hilldale Road in the City of
Salina, Kansas, and relating to and providing for the
collection and payment of such assessments.

Board of Commissioners of the City of Salina on December 200
1926 and which resolution was duly adopted and ratified by the
Board of County Commissioners of Saline County, Kansas as re-
quired by law and in accordance with Ordinance Number 3345 of
said city duly passed on march 14, 1927 and Ordinance Number
3367 of said city, duly passed on May 2, 1927, a contract has

Country Club Road and Hilldale Road, which said improvement
is to be paid for in accordance with provisions of Section 13-

30 percent by Saline County.. Kansas; and 40 percent by the pro-
perty liable to special assessment as provided by law; and
