AN ORDINANCE confirming and ratifying a contract for the improvement
of certain streets in the City of Salina, Kansas, and
providing for the issuance of temporary notes to pay the
cost thereof as the work progresses, pending the issuance
and sale of bonds for the payment of the cost thereof, as
provided by law.
BE I,JL' ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. That the acceptance by the City of Salina of the
proposal of L. 'VV. Rexroad, hereinafter referred to as the "Contractor"
which is hereby found and determined to be the lowest and best bid for
such work, and the contract awarded by the Board of Commissioners to
said contractor, and signed on behalf of the City by the Mayor on June
28th I
., 1927 for the improvement of the following streets in the following
manner, to -*it:
The curbing and guttering, excavating, grading and paving of
South Street from the west line of College Avenue to the east line
of Montrose Street, as provided for by Ordi,=ante Number 3383., said
paving to be of 6 inch reinforced concrete.
The curbing and guttering, excavating, grading and paving of
Montrose Street from the north line of South Street to the north
line of Morrison Avenue, as provided for by ordinance Number 3384s
said paving to be of 6 inch reinforced concrete
The curbing and guttering, excavating, grading and paving of
Minneapolis Avenue from the east line of Santa Fe Avenue to the north
line of Osborne Street, as provided for by Ordinance Number 3390,
said paving to be of 6 inch reinforced concrete.
The curbing and guttering, excavating, grading and paving of
Inez Avenue from the west line of Ninth Street, thence west approximately
660 feet to the west City Limitso as provided for in ordinance Number
3390, said paving to be of 6 inch reinforced concrete.
The excavating, grading and paving of Bel&it Avenue from the west
line of Ninth Street to the east line of Highland Circle, as pro-
vided for by Ordinance Number 3386, said paving to be of 6 inch rein-
forced concrete.
The curbing and guttering of Republic Avenue from the east line
of Fifth Street to the west line of Osborne Street (on the south side
of Republic) and to the west line of Second Street (on the north side
of Republic), as provided for by Ordinance Number 3385.
. The curbing and guttering of Chicago Street from the north line
of Ash Street to the south line of Park Street, as provided for by
Ordinance Number 3388.
All of said work to be done at and for the unit price contained in
said proposal for the kind of work provided for as hereinabove set
forth and as set Borth in the ordinance hereinabove referred to.,
which contract is hereby referred to and made a part of this ordinance,
be and the same are hereby ratified and confirmed, said proposal,
being within the said cost of said improvements as shown by the
sworn estimate of the City Engineer filed in the office of the City
Clerk on June 23rd, 1927, which estimate is hereby referred to and
made a part of this ordinance.
Section 2. That said street improvements shall be built and
constructed in accordance with the plans and specifications therefor
prepared by the City Engineer on file in the office of the City
Clerk and in accordance with the proposal of said contractor and
under the terms of said contract entered into between the City
and said contractor on June 28th, 19270 which said plans, specifi-
cations, proposal and contract are hereby referred to and made parts
of this ordinance, said work to be done and the ma terials equipment,
appliances and appurtenances necessary and required in connection
therewith to be performed and furnished in accordance with said plans
and specifications, conditioned however upon the furnishing by the
contractor of the contract, maintenance and statutory bonds within
the time required of said contract.
Section 3. That temporary notes signed by the Mayor and
attested by the City Clerk be issued from time to time as the work
progresses in the manner and form required by law, the total amount
thereof not to exceed the contract price for such work, such notes
to bear interest 4-ff% per annum and to mature not later than November
ls 1927 and to be issued in such amounts and at such tirge as money
for the payment of the cost of such work may be required, such notes
to be issued to said contractor and to be redeemed and cancelled at
the time that permanent bonds are issued in lieu thereof.
Section 4. This ordinance shall take effect and be in force
from and after its publication in the official city paper.
