2997 Improving 9th StreetAn Ordinance specifying and selecting the material to be used
and letting a contract for the curbing and guttering of
the east side of Ninth Street in the City of balina,
Kansas from the south line of Jewell Avenue to the north
line of Cloud Street in said City.
BE IT ORDAINED By the Board of Commissioners of the City of
Salina, Kansas:
Section 1. That it is hereby determined that the east
side of Ninth'Street in the City of Galina, Kansas from the
south line of Jewell Avenue to the north line of Cloud Street
in said City shall be curbed and guttered with one piece combina-
tion cement curb and gutter, said combined curb and gutter shall
be comprised of a curb six (6) inches thick at the top and
six and one-half (62) inches wide at the throat. with gutter
twentypfour (24) inches wide, six (6) inches thick at the throat
and seven (7) inches thick next to the pavement.
Section 2. All excavating, filling and rolling necessary
for the proper construction of such improvements shall be done
and all of such improvements shall be made and done in strict
conformity to and in compliance with the plans and specifications
heretofore made by the City Engineer of Galina, hansas and now
on file with the City Clerk of said City, which plans and
specifications are hereby incorporated in and made a part hereof
in all respects as fully and completely as though written out
at length herein; which said plans and specifications are hereby
adopted as and for the plans and specifications of such work
and improvements.
Section 3. That a contract is hereby awarded to C. P.
Barrington for the curbing, guttering, excavating and filling
the above mentioned street in the limits aforesaid with the
materials hereinbefore specified, for the curbing and guttering
actually laid and J)ut in place, for the labor actually performed
and the materials actually furnished at the following prices:
For excavating and grading One and No/100 ($1,00) Dollars per
cubic yard; for Portland Uement Concrete combined curb and
1 gutter Ninety cents (90/) per lineal foot. All of said work
shall be paid for according to the measurement made -by the City
Engineer of the City of Galina. It is hereby determined and
found that the prices to be paid for the improvements as aforesa,
is less than the estimated prices of each and all of said improve
ments as now on file with the City Clerk of the City of Salina,
Kansas.
Section 4. Scuh contraact is awarded upon the express con-
dition that such work and improvements shall be done in strict
accordance and in compliance with the plans and specifications of
the City Engineer therefor, which plans and specifications are
hereby made a part of this ordinance and of the contract awarded,
and upon further conditions among others that the person to whom
said contract is awarded shall furnish to the City of Salina a
surety company bond in the approximate sum of the cost of such
improvements guaranteeing the prompt, proper and workmanlike
construction of all the same together with a surety company
bond guaranteeing such curb and gutter against all defects in
material and workmanship for a period of two (2) years from the
date of its completion and acceptance of such work by the City;
together with a good and sufficient surety company bond running
to the State of Kansas in an amount approximately ewual to the
contract price of said improvements and conditionsd that said
C. P. BArrington shall pay all indebtedness for labor and material
furnished in making the improvements provided for herein.
Section 5.' The Board of Commissioners of the City of
Salina are hereby authorized to make and enter into on behalf
of said City all written agreements necessry in order to secure
the construction of the improvements herein provided for.
Section 6. This ordinance shall take effect and be in
full force from and after its publication once in the official
City paper.

An Ordinance specifying and selecting the material to be used
