3401 Construction of Storm Sewer # 5,6,7r"IMW ORDINANCE '140. 3401 Journal_-- -L'- AN ORD IN±-'t'NCE providing for the construction of certain Storm Sewers in the City of Salina, to be designated as Storm Sewers Nos. 5, 6 and 7, and providing for the issuing of improvement bonds to pay the cost thereof. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: SECTION 1. STOF6,11 SEENER NO. 5. That it is necessary and it is hereby ordered that a storm sewer, together with all necessary inlets, connections and other appurtenancess be constructed in the City of Salina along the following course, to -wit: beginning at a manhole to be con- structed at the intersection of Park and Chicago °streets; thence west as an 18 inch sewer to a manhole to be constructed at the intersection of Park and olive Streets; also beginning at a manhole to be constructed at the intersection of olive Street with the alley between park and Ash Streets; thence north as a 12 inch sewer to the above mentioned manhole to be constructed at Park and olive Streets; thence west along Park Street as a 21 inch sewer to Dry Greek, said sewer to be designated as Storm Sewer No. 5. That it is necessary and it is hereby ordered that a storm sewer, together with all necessary inlets, connections and other appurtenances, be constructed in the City of Salina along the following course, to -wit: beginning at a manhole to be constructed at the intersection of Ninth Street and Teague Avenue; thence north as an 18 inch sewer to the intersection of Ninth Street and Euclid Avenue; thence north as a 24 inch sewer to Dry Greek, said sewer to be designated as Storm Sewer No. 7. SECTION 4. That on or before June 23rd, 1927, the 'ity Engineer shall prepare and file in the office of the City clerk detailed plans and specifications for the construction of the storm sewers provided for in Sections 1, 2 and 3 of this ordinance, with vitrified and con- crete sewer pipe, and on or before the same date shall prepare and file in the office of the City Clerk, under oath, a detailed estimate of the costs thereof. after such -lans and specifications and k, estLated costs shall have been filed, as aforesaid, the City Clerk shall advertise, by advertisements published in the official City paper for at least three consecutive days, for sealed proposals for the building and construction of such storm sewers, and at the time and place mentioned, the Board of Commissioners may contract with the lowest and best resperr- sible bidder therefor, for the building and construction of such storm sewers, but the right to reject any and all proposals shall be and the same is hereby reserved, and any contract awarded for such work shall provide for the furnishing by such contractor of performance and maintenance bonds, and for a statutory bond, in amounts equal to 4 the full cost of such work, which shall be approved b -..,,i the Board of Coim-nissioners before any such work shall be commenced. SECTION 5. That for the purpose of paying the cost of such improvements, the Board of Commissioners shall issue improvement bonds of the City of Salina, Kansas, in an amount not to exceed the total cost of such work and improvements and to bear interest at not to exceed 5% per annum from the date of such bonds, and for the pur- pose of paying such bonds and interest as they severally mature, the Board of Commissioners shall annually levy a tax upon all real and per- sonal property in the City of Salina in an amount sufficient to pay the annual installments of such principal and interest, and that pending the issue of such bonds, temporary notes shall be issued according to law, to pay the cost of such work. SECTION 6. This ordinance shall take effect and be in full force from that first publication in the official City paper. Introduced June 20th, 1927. Passed June 21st, 1927. L. T.
