SECTION 2. That it is nece sary and it is hereby ordered that
Gypsum Avenue, in the Oity of Salina, rom the west line of Ohio Street
to the west line of Indiana Avenue be p ved, and that said street with-
in the limits above mentioned be excavat and graded to the extent
necessary for the completion of such work nd that at the intersection
of streets and alleys said paving be carrie back to the lot line of the
street so improved, said street to be paved r a width of 26 feet ex -
eluding curb and gutter.
SECTION 3. For the work and improveme is herein provided for
the City Engineer shall make and file with the C y Clerk on or before
June 23rd, 1927, complete plans and specifications for the curbing and
guttering and for the paving of said street (includ g excavation)
with the following materials:
PAVING:
1. 22 inch brick on 5 inch and 6 inch co-neret base with
asphalt filler.
21 3 inch brick on 5 inch concrete base with asph t filler.
3. 6 inch plain Portland cement concrete.
4. 6 inch reinforced Portland cement concrete.
5. 6 inch Vibrolithic concrete.

BE IT ORDAIN by the Board of Commissioners of the City of
Salina, Kansas:

SECTION 4. That after such plans and specifications shall�-I'

advertise in the off tial City paper for three consecutive days for the
receipt of sealed pro sals for the improving of slid street with the
kind of materials name and specified in the preceding section hereof,
and for such excavating d grading all to be done in strict accord-
ance with such plans and ecifications, and after the receipt of
such proposals the said Boa d of Commissioners may and they are hereby
authorized to let contracts Apr the improving of said street with the

ORDINANCE N0. 3400
An Ordinance providing for the curbing and guttering, excavating,
grading and paving of Gypsum Avenue from the. west line of
Ohio Street to the vies i of Indiana avenue, and providing
for the cost thereof, how the same shall be assessed and the
manner of payment therefor.
WHEREAS, by resolution duly adopted on May 23rd ,
1927, the Board of Commissioners of the City of Salina, have de-
clared that they deem it necessary to curb and gutter,
grade and pave Gypsum Avenue within the limits hereinafter de-
fined, and
VuHEREAS, said resolution was published for six days in the
Salina Journal, a daily newspaper published in said city, the
official city paper, and the majority of the resident property
owners, owning a majority in square feet of the lots or real estate
liable to taxation for the cost of said improvments did not within
twenty days from the date of the last publication of such resolution
file with the City Clerk their protest in writing against such
improvments or the making thereof, N09J THEREFORE:
BE IT ORDAIiED:by the Board of Commissioners of the City of
Salina, Kansas:
SECTION 1. That it is necessary and it is hereby ordered
that Gypsum Avenue, in the City of Salina, Kansas from the west
line of Ohio Street to the west line of Indiana Avenue be curbed
and guttered, and that said street within such limits be excavated
and graded to such an extent as may be necessary for the completion
of said work, and that at the intersection of streets and allies said
curb and gutter shall be carried back to the lot.line of the street
so improved, the distance between the curbing on each side of said

the value ofany lots or pieces of land so appraised, of which
due notice shall be given in the official city paper, at which
special session said Board may alter any valuation of any lot or
piece of land if, in their opinion, the.same has been appraised
too high or too low,

improvements the Board of Uommissioners are hereby authorized and
directed to issue internal improvement bonds of the City of Salina
in an amount not to exceed the cost of such improvements and to run
for a period of ten years and be payable in ten approximately equal
inatallmentsp together with interest not to exceed 5% per annam, which
bonds shall be made payable at the fiscal agency of the State of
Kansas; and for the purpose of paying principal and interest on said
bonds as they severally become due and payable the Board of Com-
missioners shall apportion and assess against the lots and pieces of

land within the taxing district of such Improvements special assess-
ments covering such cost and the.apportionment therein contained shall
hold good for all the installments that are to be collected from the
specific property chargeable with said improvements. Such assessment
and apportionment ordinance shall contain the total amount of tax
apportioned to each tract,,, piece and parcel of land within the taxing
district and shall state the number of annual installments in which
such tax is to be collected; and thereafter the City Clerlc shall
annually, at the same time other taxes are certified, certify to the
County Clerk of Saline County, 8ansaso a full list of --all property
liable for such work and improvements, together with respectivo
amounts due on each of said tracts, pieces and parcels of -land., which
amounts shall include the annual installments and interest on all un-
paid balances for one year at the rate of not to exceed 5% per annum,
on such amounts so certified which shall be collected as otter taxes
are collected; PROVIDED, that for the purpose of defraying the*cost
of improving the.interseotions and areas formed by the crossing of
streets and alleys, as well as where the improvement is through or
adjacent to property of the City for which the City would be liable
the assessment will be made against all taxable property of the City
and paid by the City at large..
Section 8 This ordinance shall take effect and be in force
from and after its publication once in the official City paper
