VI Z� AS, by resolution duly adopted on May 23rd, 1927, the Board of Comm ssioners of the City of Salina have dee3ared that they deem it neces ry to curb and gutter, grade and pave Gypsum Avenue with- in the limits ereinafter defined, and WHEREA said resolution was published for six days in the SalinaJournal,, daily newspaper published in said city, the official city paper, and t e majority of the resident property owners, owning a majority in squ e feet of the lots or real estate liable to tax- ation for -the cost f improvements did not within twenty days -said from the date Of t last publication of such resolution file with the. k City Clerk their pr est in writing against such improvements or the making thereof, NOW MEREFORE: BE IT ORDAIN by the Board of Commissioners of the City of Salina, Kansas: 2 SECTION 1. Tha it is necessary &nd it is hereby ordered that 13 Gypsum Avenue, in the Cit of Salina, Kansas from the west line of Ohio Street to the west line of ndiana Avenue be curbed and guttered, and that said street within such limits be excavated and graded to suchen extent as may be necessary fo the completion of said work, and that at the intersection of streets an -alleys said curb and gutter shall be carried back to the lot line of e street so improved, the distance between the curbing on each side said street to be 30 feet from face to face of curb. That after such plans and specifications shall�-I' have been filed wi the City Clerk as aforesaid the City Clerk shall advertise in the off tial City paper for three consecutive days for the receipt of sealed pro sals for the improving of slid street with the kind of materials name and specified in the preceding section hereof, and for such excavating d grading all to be done in strict accord- ance with such plans and ecifications, and after the receipt of such proposals the said Boa d of Commissioners may and they are hereby authorized to let contracts Apr the improving of said street with the material selected by them.. an for such excavating and grading, to the lowest responsible bidder t erefor., as determined by said Board of Commissioners, the right to rVect any and all bids, being specifically reserved. Such assessment and apportionment ordinance shall contain the total amount of tax apportioned to each tract,,, piece and parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerlc shall annually, at the same time other taxes are certified, certify to the County Clerk of Saline County, 8ansaso a full list of --all property liable for such work and improvements, together with respectivo amounts due on each of said tracts, pieces and parcels of -land., which amounts shall include the annual installments and interest on all un- paid balances for one year at the rate of not to exceed 5% per annum, on such amounts so certified which shall be collected as otter taxes are collected; PROVIDED, that for the purpose of defraying the*cost of improving the.interseotions and areas formed by the crossing of streets and alleys, as well as where the improvement is through or adjacent to property of the City for which the City would be liable the assessment will be made against all taxable property of the City and paid by the City at large..
