BE Ix ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the acceptance by the City of Saliba of the proposal of iered F. Eberhardt and R. 0. Shriver, co-partners doing business as Eberhardt and Shriver hereinafter referred to as the "Contractor" which is hereby found and determined to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said City to said contractor, and signed on behalf of the City by the Mayor on June 282 1927 for the building and con- struction of Storm Sewer Number 5 and Storm Sewer Number 7 as pro- vided for in Ordinance Number 3401, at and for the unit prices con- tained in said proposal, which contract is hereby referred to and made a part of this ordinance, be and the same are hereby ratified and confirmed, said proposal being within the said cost of said improvements as shown by the sworn estimate of the City Engineer filed in the office of the City Clerk on June 23rd, 1927, which estimate is hereby referred to and made a part of this ordinance. Section 2. That said Storm Sewers shall be built and con- $trusted in accordance with the plans and specifications therefore prepared by the City Engineer on file in the office of the City Clerk and in accordance with the proposal of said contractor and under the terms of said contract entered into between the city and said contractor on June 28th, 1927, which said plans, specific- ations, proposal and contract are hereby referred to and made parts of this ordinance, said work to be done and the material, equipment, appliances and appurtenances necessary and required in connection therewith to be performed and furnished in accordance with said plans and specifications, conditioned however upon the furnishing by the contractor of the contract, maintenance and statutory bonds within the time required by said contract. Section 3. That temporary notes signed by the Mayor and attested by the City Clerk be issued from time to time as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the contract price for such work, such notes to bear interest 4j�6 per annum and to mature not later than November 1, 1927 and to be issued in such amounts and at such time as mcn ey for the payment of the cost of such work may be required, 1-44- --GuY T. AN ORDINANCE confirming and ratifying a contract for the building and construction of certain storm sewers in the City of Salina, desebibed as Storm Sewers Numbers 5 and 7 and providing for the issuance of temporary notes to pay the cost thereof as the work progresses, pending the issuance and sale of bonds for the payment of the cost thereof, as provided by law. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:_ SECTION 1. That the acceptance by the City of Salina of the proposal of Fred F. Eberhardt and R. 0.
