3398 Street Improvements for Inez AvenueAN ORDINANCE providing for the curbing and guttering, excavating,
grading and paving on Inez Avenue from the west line of Ninth Street,
then,ce west approximately 660 feet to the west city limits, and
providing for the cost thereof, how the same shall be assessed and
the manner of payment therefor.
WHEREAS) by resolution duly adopted on May 24th, 1927, the
Board of Commissioners of the City of Salina, have declared that they
deem it necessary to curb and gutter, grade and pave Inez Avenue within
the limits hereinafter defined, and
WHEhEA81 said resolution was published for six days in the
Salina Journal, a daily newspaper published in said city, the official
city paper, and the majority of the resident property owners, owning
a majority in square feet of the lots or real estate liable to tax-
ation for the cost of said improvements did not within'twenty days
from the date of the last publication of such resolution file with
the City Clerk their protest in writing against such improvements or
the making thereof, NO14 THEREFORE:
BE IT ORDAL-IED by the Board of Commissioners of the City of
Salina, Kansas:
SECTION 1. That it is necessary and it is hereby ordered that
Inez Avenue, in the City of Salina, Kansas from the west line of
Ninth Street, thence west approximately 660 feet to the west city
limits be curbed and guttered, and that said street within such limits
be excavated and graded to such an extent as may be necessary for the
completion of said work, and that at the intersection of streets and
alleys said curb and gutter shall be carried back to the lot line of
the street so improved, the distance between the curbing on each side
of said street to be 25 feet from face to face of curb.
SECTION 2. That it is necessary and it is hereby ordered that
Inez Avenue, in the City of Salina, from the west line of Ninth Street,
thence west approximately 660 feet to the west city limits be paved,
and that said street within the limits above mentioned be excavated
and graded to the extent necessary for the completion of such work and
that at the intersection of streets and alleys said paving be carried
back to the lot line of the street so improved, said street to be paved
for a width of 21 feet excluding curb and gutter. 0
SECTION 3. For the work and improvements herein provided for
the City Engineer shall make and file with the City Clerk on or before
June 23rd, 1927, complete plans and specifications for the curbing and
guttering and for the pavinf of said street (including excavation) with
the following materials:
CURB and GUTTER:
Portland cement concrete combined curb and gutter, 30 inches
wide from back of curb to paving line, curb to be 6 inches at top,
7 inches at bottom, and 6 inches deepo gutter to be 6 inches deep at
curb.. 10 inches deep at inside line of gutter.

PAVING:
1. 22 inch brick on 5 inch and 6 inch concrete base with
asphalt filler.
2. 3 inch brick on 5 inch concrete base with asphalt filler.
3. 6 inch plain Portland cement concrete.
4. 6 inch reinforced Portland cement concrete.
5. 6 inch Vibrolithic concrete.
and that on or before said date the City Engineer shall submit to
the Board of Commissioners under oath, detailed estimates of the cost
of such curbing., guttering and paving, including the excavation and
grading necessary therefore with the different kinds of material
above mentioned.
SECTION 4. That after such plans and specifications shall
have been filed with the City Clerk as aforesaid the City Clerk shall
advertise in the official city paper for three consecutive days for
the receipt of sealed proposals for the improving of said street
with the kind of materials named and specified in the preceding see -
tion hereof, and for such excavating and grading all to be done in
strict accordance with such plans and specifications, and after the
receipt of such proposals the said Board of Commissioners may and they
are hereby authorized to let contracts for the improving of said street
with the material selected by them and for such excavating and gradi%
to the lowest responsible bidder therefor, as determined by said

Board of Commissioners the right to reject any and all bids, being
specifically reserved.
SECTION 5. That for such improvements special assessments
shall be made as provided by law for the full cost thereof on all lots
and pieces of land to the center of the block on either side of the
street to be improved according'to the appraised value thereof, with-
out regard to the bu-'!ldings or improvements thereon.
SECTION 6. After the passage and publication of this ordin-
ance the Board of Commissioners shall appoint three disinterested
appraisers, householders, who after having taken an oath to make a
true and impartial appraisement of all lots and pieces of land liable
to assessment and taxation for the cost of the improvements herein
provided for, shall within five days after having been notified of
their appointment proceed to appraise the lots and pieces of land
liable to assessment and taxation as aforesaid, without regard to the
buildings or improvements thereon, and after making said appraisement
shall return the same to said Board, and said Board shall designate
a time for holding a special session for the purpose of hearing any
complaints that may be made as to the value of any lots or pieces of
land so appraised, of which due notice shall be given in the official

city paper, at which special session said Board may alter any valua-
tion of any lot or piece of land if, in their opinion, the same has been
appraised too high or too low.
SECTION 7. For the purpose of paying for said work and improve-
ments the Board of Commissioners are hereby authorized and directed to
issue internal improvement bonds of the City of Salina in an amount
not to exceed the cost of such improvements and to run for a period of
ten years and be payable in ten approximately equal installments, to -

gether with interest not to exceed 5% per annum, which bonds shall be
made payable at the fiscal agency of the State of Kansas; and for the
purpose of paying principal and interest on said bonds as they severally
become due and payable the Board of Commissioners shall apportion and
assess against the lots and pieces of land within the taxing district
of such improvements special assessments covering such cost and the
apportionment therein contained shall hold good for all the install-
ments that are to be collected from the specific property chargeable
with said improvements. Such assessment and apportionment ordinance
shall contain the total amount of tax apportioned to each tract, piece
and parcel of land within the taxing district and shall state the num-
ber df annual installments in which such tax is to be collected; and
thereafter the City Clerk shall annually, at the same time other taxes
are certified., dertify to the County Clerk of saline County, Kansas,
a full list of all property liable for such work and improvements, to-
gether with respective amounts due on each of said tracts, pieces and
parcels of land, which amounts shall include the annual installments
and interest on all unpaid balances for one year at the rate of not to
exceed 5% per annum, on such amounts so certified which shall be col-
lected as other taxes are collected; PROVIDED, that for the purpose
of defraying the cost of improving the intersections and areas formed
by the crossing of streets and alleys, as well as where the improvement
is through or adjacent to property of the City for which the City would
be liable the assessment will be made against all taxable property of the
C.ty and paid by the City at large.
SECTION S. This ordinance shall take effect and be in force from
and after its publication once in the official City paper.

An Ordinance providing for the curbing and guttering, excavating,
grading and paving of Inez Avenue from'the west line of Ninth
Street, thence west approximately 560 feet to the west city
limits, and providing for the cost th.:reof, how the same shall be
assessed and the manner of payment therefor.

SECTION 3. For the work and improvments herein provided for

the assessment will be made against all taxable property of the City
-and paid by the City at large.
Section 8 This ordinance shall take effect and be 2n force
from and after its publication once in the official Citi paper,
