2988 Levy AssessmentsORDINANCE NUMBER 2988 An Ordinance relating to and apportioning and levying special assessme2ts on certain lots and pieces of ground in the City of alina, Kansas to pay the cost of curbing, gutter- ing, excavating, grading and paving Eleventh Street in said City from the north line of Park treet to the south line of Elm Street therein, and relating to and providing for the collection and payment of such assessments. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. For the purpose of paying for the cost of curb- ing, guttering, excavating, grading and paving Eleventh Street in the City of Salina, Kansas from the north line of nark Street to the south line of Elm street in said City, there are hereby levied and assessed on the property liable therefor, being all of the'lots and pieces of ground lying on either side of said Eleventh °treet for the distance improved as aforesaid to the center of the block on either side thereof, according to the appraised value of such lots and pieces of ground without re- gard to the buildings or improvements thereon, special assessment; covering the cost of such work and improvements, said special assessments being based on the special valuation and appraisement of said lots and pieces of ground heretofore made by three dis- interested appraisers appointed by the Board of Commissioners of the City of Salina, Kansas, which sa id appraisement is hereby referred to and made a part of this ordinance and the several amounts levied, apportioned and assessed against such lots and pieces of ground for the purpose aforesaid are hereby found and determined to be as follows: ELEVENTH STREET FROM PARK TO ELM STREETS Weaver's Addition South 40 feet Lot 1, Park Street ------------- 138.75 North 42 feet Lot 1, `r " Bishop's Third Add. Said amounts levied, apportioned and assessed aforesaid shall be due and collectible in ten equal installments, the first becoming due with the taxes for the year 1924 and one of said installments, falling due each and every year there- after until all are paid, and all to be collected with inter- est as in this ordinance provided; PROVIDED HO17EVER, that the owner of any piece of property liable for any such assessment may redeem his property fvom such liability by paying into the City Treasury the entire amount chargeable against the same, as in this ordinance designated, at any time within thirty days after the publication of this ordinance and before the issuance of the bonds of said City in payment of the balance of said im- provements, and his property so paid on shall not thereafter be liable for any further assessments for the cost of said improve- ments nor for any part of said bonds. Section 3. There is hereby levied and assessed against each lot and piece of ground described in this ordinance 4-3/4% interest per annum on all of said installments therein mentioned from the date of the bonds, which may be issued at the end of thirty days, as specified in the preceding section hereof, as by law provided,.to the time of collection of the last install- ment, as provided by law, which said interest shall be collect- ed annually at"the same time and in the same manner as said installments are collected; and after the taking effect of this ordinance it shall be the duty of the City Clerk of said City to annually at•the same time other taxes are certified, and until all of said assessments so apportioned and levied herein have been certified, to certify to the County Clerk of ''aline County Kansas a full list of all property liable to assessment and taxation for such work and improvement, except such property on which the special assessments aforesaid have been paid in full as hereinbefore provided, together with the respecrive amounts due on each of such lots and pieces of ground, which amounts shall include the annual installments of such special assessments to- gether with the interest for one year at the rate of 4-3/4% per annum, on all unpaid balances of such assessments at the beginning of each such year as aforesaid, and such amounts so certified as herein provided shall be placed upon the tax roll by the County Clerk of Jaline County, Kansas and collected as all other taxes are collected. Section 4. This ordinance shall take effect and be in full force from and after its publication once in the official City paper, (SEAL) Attest: Introduced for first reading, May 26th, 1924.
