3392 Street Improvements of Crestview DriveNE ORDINANCE NO. 3392 AN ORDINANCii.' providing for the excavation, grading and paving of Crestview Drive from the west line of Ylarymount Road to the west line of Hilldale Road, and providing for the cost thereof, how the same shall be assessed and the manner of payment therefor. WHEREAS, by resolution duly adopted on May 16th, 1927 the Board of Commissioners of the City of Salina declared that they deem it necessary to grade and pave Crestview Drive, within the limits here- inafter defined, and VIMEREAS, said resolution was published for six days in the Salina J6urnal, a daily newspaper published in said City: the official city paper, and the majority of the resident property owners, owning a majority in square feet of the lots of real estate liable to tax- ation for the cost of said improvements did not within twenty days from the date of the last publication of such resolution file with the City Clerk their protest in writing against such improvements or i the making thereof, NOW THEREFORE: BE IT ORDAINED by the Board of Oommissions of the ('ity of Salinas Kansas: SECTION 1. That it is necessary and it is hereby ordered 1 that Crestview Drive in the vity of Salim,, from the west line of Marymount Road to the west line of Hilldale Road bepavedp and that said street within the limits above mentioned be excavated and graded to the extent necessary for -the completion of such work.. said street to be paved for a width of 22 feet excluding curb and gutter. SECTION 2. For the work and improvements herein provided for the City Engineer shall make and file with the City Clerk on or before June 23rd, 1927, complete plans and specifications for the paving of said street, (including excavation) with the following materials: 1. 22 inch brick on 5 inch and 6 inch concrete base with hi asphalt filler. 2. 3 inch brick on 5 inch concrete base with asphalt filler. 3. 6 inch Portland plain cement concrete. 4. 6 inch reinforced Portland cement concrete. 5. 6 inch 4ibrolithic concrete. and that on or before said date the pity Engineer shall submit to the Board of Commissioners under oath, detailed estimates of the cost of such paving including the excavation and grading necessary therefor the different kinds of material above mentioned. SECTION 3. That after such plans and specifications shall have been filed with the City Clerk as aforesaid the City Clerk shall ad-' vertise in the official City paper for three consecutive days for the receipt of sealed proposals for the improving of said street with the kind of materials named and specified in the preceding section hereof, and for such excavating and grading all to be done in strict accord- ance with such plans and specifications, and after the receipt of such proposals the said Board Of Commissioners may and they are hereby authorized to let contracts for the improving of said street with the Q8 material selected by them, and for such excavating and gradings to the lowest responsible bidder therefor, as determined by said Board of Com- missionerso the right to reject any and all bids, being specifically reserved. SECTION 4. That for such improvements special assessments shall be made as provided by law for the full cost thereof on all lots and pieces of land to the center of the block on either side of the street to be improved according to the appraised value thereof, without regard to the buildings or improvements thereon, SECTION 5. After the passage and publication of this ordinance the Board of Commissioners shall appoint three disinterested appraisers, householders, who after having taken an oath to make a true and impartial appraisement of all lots and pieces of land liable to assessment and taxation for the cost of the improvements herein provided for, shall within five days after having been notified of their appointment proceed to appraise the lots and pieces of land liable to assessment and tax- ation as aforesaid, wit -Lout regard to the buildings or improvements thereon, and after making said appraisement shall return the same to said Board, and said Board shall designate a time for holding a special session for the purpose of hearing any complaints that may be made as to the value of any lots or pieces of land so appraised, of which due not- ice shall be given in the official city paper, at which special session said Board may alter any valuation of any lot or piece of land if, in their opinion, the same has been appraised too high or too low. SECTION 6. For the purpose of paying for said work and improve- ments the Board of Commissioners are hereby authorized and directed to issue internal improvement bonds of the City of Salina in an amount not to exceed the cost of such improvements and to run for a period of ten years and be payable in ten approximately equal installments, to- gether with interest not to exceed 5�6 per annum, which bonds shall be made payable at the fiscal agency of the State of Kansas; and for the purpose. of paying principal and interest on said bonds as they severally become due and payable the Board of Commissioners shall apportion and assess against lots and pieces of land within the taxing district of such im- provements special assessments covering such cost and the apportionment therein contained shall hold good for all the installments that are to be collected from the specific property chargeable with said improve ments. Such assessment and apportionment ordinance shall contain the total amount of tax apportioned to each tract, piece and parcel of land I F 7 !,,within the taxing district and shall state the number of annual install- ments in which such tax is to be collected; and thereafter the City ,'Clerk shall annually, at the same time other taxes are certified, cert- ify to the County Clerk of Salie County, Kansas, a full list of all [property liable for such work and imprmvements, together with respective ,amounts due on each of said tracts,pieces and parcels of lands which ;amounts shall include the annual installments and interest on all un- paid balances for one year at the rate of not to exceed per annum, ,[on such amounts so certified which shall be collected as other taxes are collected; PROVIDED, that for the Duruose of dnfrnuir� tina ^^o+ of improveing the intersections and areas fvrmed by the crossing of streets and alleys, as well as where the improvement is through or adjacent to property of the City for which the City would be liable ,the assessment will be made against all taxable property of the City I 4nd paid by the City at large. Such assessment and apportionment ordinance shall contain the total amount of tax apportioned to each tract,,, piece and parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collooted; and thereafter the City Clerk shall annually, at the same time other taxes are certified, certify to the County Clerk of Saline County, Kansas; a full list of all property liable for such work and improvements, together with respective amounts due on each of said tracts, pieces and parcels of land, which amounts shall include the annual installments and interest on all un- paid balances for one year at the rate of not to exceed 5% per annum, on such amounts so certified which shall be collected as otter taxes are'oolleeted; PROVIDED, that for the purpose of defraying the cost of improving the.interseotions and areas formed by the crossing of streets and alloys, as well as where the improvement is through or adjacent to property of the City for which the City would be liable the assessment will be made against all taxable property of the City and paid by the City at large..
