3387 Construction of Main & Lateral SewersORDINANCE VO. 3387. AN ORDINANCE confirming and ratifying a contract for the building and construction of certain main sewers and certain lateral sewers in the City of Salina and providing for the issuance of temporary notes to pay the cost thereof as the work progresses, pending the issuance and sale of bonds for the payment of the cost thereof as provided by law. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: SECTION 1. That the acceptance by the City of Salina of the i proposal of Fred F. Eberhardt and R. 0. Shriver, co-partners doing busi- ness as Eberhardt and Shriver hereinafter referred to as "Contractor" which is hereby found and determined to be the lowest and best bid for such work, and the contract awarded by the Board of commissioners of said City to said contractors and signed on behalf of the City by the Mayor on June 3rd, 1927 for the building and construction of certain main sewers in Main Sewer Districts t'Nff and "Off as provided for in Ordinance Number 3375, and for the building and construction of certain lateral sewers in Lateral Sewer Districts No. 129, 130, 131, 132, 133, 134, 135 and 140, as provided for in ordinance Number 3376, at and for the unit prices contained in said proposal, which contract is hereby referred to and made a part of this ordinance, be and the same are hereby ratified and confirmed, said proposal being within the said cost of said improvements as shown by the sworn estifiate of the City Engineer filed in the office of the City Clerk on May 25th, 1927,which estimate is hereby referred to and made a part of this ordinance. SECTION 2. That said main sewers and lateral sewers shall be built and constructed in accordance with the plans and specifications threrfore prepared by the City Engineer on file in the office of the City Clerk and in accordance with the proposal of said contractor and under the terms of said contract entered into between the city and said con- tractor on June 3rd, 1927, which said plans, specifications, proposal and contract are hereby referred to and made parts of this ordinance, said work to be done and the material, equipment, appliances and appurtenances necessary and required in connection therewith to be per- formed and furnished in accordance with said plans and specifications, conditioned however upon the furnishing by the contractor of the con- tract,maintenance and statutory bonds within the time required of said contract. SECTION 3. That temporary notes signed by the Mayor and attested by the City Clerk be issued from time to time as the work progresses in the manner and form as required by laws the total amount thereof not to exceed the contract price for such work, such notes to bear interest not to exceed 4ti% per annum and to mature not later than 1 C November 1, 1927 and to be issued in such amounts and at such time as money for the payment of the cost of such work may be required, such notes to be issued to saidcontractor and to be redeemed and cancelled at the time that permanent bonds are issued in lieu there- of. SECTION 4. This ordinance shall take effect and be in force from and after its publication in the official city paper. Introduced June 3rd, 1927. Passed June 6th, 1927. Attest: Chas. E.
