AN ORDIl .NCE creating and defining certain Lateral Sewer Districts in the
City of Salina, designated as Lateral Sewer Districts Numbered 129 to
140, inclusive; providing for the construction of Lateral Sewers in
certain of the districts so created; providing for the cost thereof
and for the levying of special assessments against the property in
such districts for thepayment of such cost, and for the issuing of
bonds therefor.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
SECTION 1. LATERAL SEINER DISTRICT 129. That there be and there is hereby
created a Lateral Sewer District in the City of Salina, which shall be
designated as Lateral Sewer District No. 129, which shall include all of
the following described property in the City of Salina to -wit Lots
11 3, 5.9 7 and 9 in '-look 7, Lots 1, 31 5P 7 and 9 in Block 13, Lots 1,
21 3s 4 and 5 in Block 6. and Lots 1, 2, 3, 4 and 5 in dock 12, all in
South Park Addition.
SECTION 2. L.LTERkL SEWER DISTRICT 130. That there be and there is hereby
created a Lateral Sewer District in the City of Salina which shall be
designated as Lateral Sewer District No. 130, which shall include all
of the following described property in said city, to -wit: Lots 1, 31 51
7 and 9 in Block 8,11.ots 1, 3., 5, 7 and 9 in Block 14; Lots 2, 4, 6, 8 and
10 in Block 7 and Lots 2., 4, 6, 8 ane10in Block 15 all in South park
Addition.

created a Lateral Sewer District in the uit; of Salina which shall be
designated as Lateral Sewer District No. 131, which shall include all of
the following described property in said city, to -wit: Lots 1, 30 51 7
and 9 in 'lock 9; Lots 1, 30 5, 7 and 9 in Block 15; Lots 2, 4, 6, 8 and
10 in Block 6 and Lots 2, 4, 6, 8 ana 10 in Block 14 all in youth Park
Addition.
SECTION 4. LATERAL SEWER DISTRICT 162. That there be and there is here-
by ere --.ted a Lateral Sewer -Listriet in the City'of Salina -which.:shall be
designated as Lateral Sewer District No. 132, which shall include all of
the following described property in said city, to -wit: Lots 1 to 11 in -
elusive on Ninth Street, Lots 12 to 22 inclusive, on Tenth Street, and Lots
37 to 42 on Antrim. Street, all in Heimold's Addition, and Lots 1 to 20
inclusive, in -,-lock 27 in Military Addition.
SECTION 5. LATERAL SEVIER DISTRICT 133. That there be and there is hereby
created a -Lateral Sewer District in the uity of Salina which shall
be designated as Lateral Sewer -1--istrict No. 133, which shall include all of
the following described property in said city, to -wit: Lots 1, 3, 5, 7,
9, 112 13., 15, 17 and 19 on kinneapolis Avenue and Lots 2, 4, 6, 81 10,
12, 14, 16, 18 and 20 on Ellsworth avenue, all in the addition to the
Kansas Wesleyan University grounds.

SECTION 6. LATERAL SINEW;RDISIEICT 134. That there be and there is
hereby created a Lateral Sewer District in the Uity of Salina which
shall be designated as Lateral Sewer District No. 134, which shall
include all of the following described property in said city, to -wit:
Lots 25$ 27, 29$ 31, 632 35 and 37 in Phillips t-ourth Addition;
Lots 1 to 13 inclusive, in Block A., Lots 14 to 23 inclusive, Block
"B". Lots 24 to 36 inclusive in Block "u", and the !.Test one,:�half of
Lots 37 to 46 inclusive in Block "D" in Morrison's Addition and
Lots 2 and 4 in Block 1 in Morrison's Second Addition.
SECTION 7. LATERAL SEWER DISTRICT 135. That there be and there is
hereby created a Lateral Sewer District in the City of Salina which
shall be designated as Lateral Sewer District No. 135, which shall
include all the following described property in said city, to -wit:
Lots 1, 2s 3 and 4 on University Place in University Addition; the
west half of Lots 6, 8, 10, 12, 14, 161 18 and 20 in Phillips Sec -
and Addition.
SECTION 8. LATERAL SEINER DISTRICT 136. That there be and there is
hereby created a Lateral Sewer District in the (jity of Salina which
shall be designated as Lateral Sewer District No. 136, which shall
include all of the following described property in said city, to -wit:
Lots 8 to 15 inclusive in Block 3., Lots 8 to 15 inclusive in Block
5 and all of Blocks 4 and 6 in Phillips East Salina Addition.
SECTION 9. LATERAL SENVER DlSTFI,JT 137. That there be and there is
hereby created a Lateral Sewer District in the City of Salina which
shall be designated as Lateral Sewer District No. 137Y which shall
include all of the following described property in said city., to -wit:
Lots 7 to 30 inclusive in Block 1 in Stack Place.
SECTION 10. LATERAL SEINER DISTiiI(;T 168. That there be and there is
hereby created a Lateral Sewer District in the City of Salina which
shall be designated as Lateral Sewer District No. 138, which shall
include all of the following described property in said city, to -wit:
Lots 7 to 28 inclusive in Block 2 in Stack Place.
SECTION 11. LATERAL SEINER D16TRICT 139. That there be and there is
hereby created a Lateral Sewer District in the Uity of Salina which
shall be designated as Lateral Sewer District No. 139, which shall
include all of the following described property in said city to -wit:

SE?1uTION 13. That it is necessary and it is hereby ordered that a
lateral sewer with all necessary inlets, inlet connections, manholes,
headwalls and other appurtenances be constructed and built in certain
of the lateral sewer districts created by the preceding sections of
this ordinance, along the following described courses within such
districts, as described in the following sections of this ordinance.
SECTiuN 14. That such a lateral sewer be constructed in lateral sewer
district No. 129 as follows:
An eight inch vitrified pipe sewer beginning at a fluch tank to be
constructed in Viontrose Street approximately 55 feet north of the north
line of Crawford Street; thence north in kontrose Street approximately
330 feet to a manhole to be constructed therein; thence north approxi-
mately 350 feet in said street to a manhole to be constructed therein;
thence north approximately 350 feet in said street to a manhole on the
main sewer in Prescott Street.
SECTION 15. That such a lateral sewer be constructed in lateral
sewer district No. 130 as follows:
An eight inch vitrified pipe sewer beginning at a flush tank to be
constructed in Phillips Street at a point approximately 45 feet north.

Street approximately . 330 feet to a manhole to be constructed therein;

thence north approximately 350 feet in said street to a manhole
to be constructed therein; thence nort'l approximately 350 feet to
a manhole on the main sewer in Prescott

SECTION 16. That such a lateral sewer be constructed in lateral
sewer district No. 131 as follows:
An eight inch vitrified pipe sewer beginning at a flush tank
to be constructed in Twelfth Street at a point approximately 45 feet
north of the north line of Crawford Street; thence north in Twelfth
Street approximately 330 feet to a manhole to be constructed therein;
thence nor1h.approxilriately 350 feet in said street to a manhole to
be constructed therein; thence north 350 feet to a manhole on the
main sewer in Prescott Street.
SECTION 17. That such a lateral sewer be constructed in lateral
sewer district No. 132 as follows:
An eight inch vitrified pipe sewer beginning at a flush tank
to be constructed in the alley between Ninth and Tenth Streets 35
feet south of the south line of Inez Street; thence south in said
alley approximately 550 feet to a manhole to be constructed in
Antrim Street; thence south approximately 478 feet to an existing
manhole in Hamilton Street.
SECTION,18. That such a lateral sewer be Constructed in lateral
sewer district No. 133 as follows:
An eight inch vitrified pipe sewer beginning at a flush tank
to be construcued in the alley between Minneapolis and Ellsworth
Streets 55 feet west of the west line of Osborne Street; thence
west in said alleyapproximately645 feet to an existing manhole
in said alley which is 40 feet west of the west line of Fourth
Street.
SECTION 19. That such a lateral sewer be constructed in lateral
sewer district iio. 134 as follows:
An eight inch vitrified pipe sewer beginning at a flush tank
to be constructed in f,ontrose Street approximately 5 feet south of
the north line of Morrison Avenue; thence north 363 feet in Mont-
rose Street to a manhole to be constructed therein;
thence north
350 feet in said street to a manhole to be constructed South
:street; thence east in South Street 260 feet to an existing
manhole on the sewer in South Street.
SECTION 20. That such a lateral sewer be constructed in lateral sewer
district No. 135 as follows:
An eight inch vitrified pipe sewer beginning at a flush tank to
be constructed in Twelfth Street approximately 70 feet north of the
north line of vialnut Street; thence north in Twelfth Street approxi-
mately 400 feet to a manhole to be constructed therein; thence north
approximately 392 feet in Twelfth Street to a manhole to be constructed
in the main sewer in iron Avenue.
SECTION 21. That such a lateral sewer be constructed in lateral sewer
district No. 140 as follows:
An eight inch vitrified pipe sewer beginning at a flush tank in
Eleventh Street approximately 45 feet north of the north line of
Republic Avenue; thence north in Eleventh Street 880 feet to. -,a manhole
to be constructed therein; thence north in said street 300 feet to a
manhole to be constructed in the intersection of Eleventh Street and
Wilson Street; thence north in Eleventh Street 330 feet to a manhole
to be constructed therein; thence north in said street 330 feet to a
manhole to be constructed in the intersection of Franklin Street and
Eleventh Street; thence north in Eleventh Street 323.5 feet to a man
hole to be constructed therein; thence north 323 feet in said street
to a manhole to be constructed in the intersection of Front and Eleventh
Streets; thence north in Eleventh Street 310 feet to a manhole to be
constructed in the intersection of Brown Street and Eleventh Street;
thence north in Eleventh Street 350 feet to a manhole to be constructed
in the intersection of; -'Crawford Avenue and Eleventh Street; thence
east in Crawford Avenue approximately 180 feet to a manhole on the
main sewer at the intersection of Crawford Avenue and Tenth Street.
SEcT101i 22. That the City Engineer shall on or before the 25th day of
May 1927, prepare and file in the office of the City Ulerk, plans and
specifications for the construction of the Lateral Sewers provided. -for
in the preceding sections of this ordinance which shall be of the

roper character and along the proper courses and at the proper grades
to serve the property lying within the districts within which such
sewers are to be constructed and shall on or before said date pre-
pare and submit to the Board of Commissioners detailed estimates,
under oath$ of the cost thereof. That thereafter the City Clerk shall
advertise for three consecutive days in the official city paper for
sealed proposals for the building and construction of such sewers
according to such plans and specifications, which proposals shall' be
filed with the City Clerk on or before the time fixed for such
notice or notices., at which time the Board of Commissioners may let
a contract for the building and construction of such sewers to the
lowest responsible bidder or bidders therefor, provided that such
bids shall not exceed the estimated cost thereof and provided

further that said Board shall reserve the right to reject any and
all such proposals and that if no responsible bids shall be received
within said estimated cost said Board may proceed and build such
sewer or sewers or any portion thereof within such estimated cost.
SECTION 23. That for the cost of building and constructing such
sewers, special assessments shall be for'the
made full cost thereof,
on all lots or pieces of land within the Riain Sewer District within
which any such lateral sewer or portion thereof shall be built,
according to the appraised value thereof, without regard to the
improvements or buildings thereon.
SECTION 24.: iifter the passage and publication of this ordinance,
the Board of liommissioners shall appoint three disinterested apprais-
ers who after having taken an oath to make a true and impartial
appraisement of all lots and pieces of land liable to taxation. for
the cost of such improvements shall within five days after having

notified of their appointment proceed to appraise all of the
lots or Pieces of land within such districts., liable to assessment
and taxation as aforesaid without regard to the buildings or im-
provements thereon, and after making said appraisemonts shall re-
turn the same to the Board of Uommissioners of said City and said
Board shall designate a time for holding a special meeting of said
Board for the purpose of hearing any coniplaints that may be made as
to the value of any lot or piece of land appraised as aforesaid, of
which special session due notice shall be given in the official
city paper, and at which special session said -board may alter any
valuation of any lot or piece of land, if, in their opinion the
same has been appraised too high or too low.
SECTION 8. The special assessments herein provided for may be
paid by the person liable therefor in ten approximately equal annual
installments but the owner of any property liable to such assessment
may within thirty days from the date of determining the amount
assessed against his property pay the same in full and his property
shall not be liable for any assessment for the cost of such improvements.,
and bonds as hereinafter provided for shall be issued for the amount
of the cost of such improvements remaining unpaid at the end of thirty
days from the time such assessment is fixed.
SECTION 26. For the purpose Of paying for the work and improvements
in this ordinance provided for the Board of Commissioners are hereby
authorized and directed to issue improvement bonds of the Uity of
Salina in --.an amount not to exceed the cost of such improvement and to
run for a period of ten years and be payable in ten approximately
equal annual installments, together with interest not to exceed five
per cent per annum, which bonds shall be issued and payable according
to law; and for the purpose of paying the principal and interest on
said bonds as they severally become due and payable, the Board of
Commissioners shall apportion and assess against the lots or pieces
of land within the taxing districts of such improvements, special
assessments covering the cost of such improvements and the apportion-
ment therein contained shall hold good for all of the installments
that are, to be colledted from the specific property chargeable with
said improvement. Such Assessment and apportionment ordinance shall
contain the total amount of tax apportioned to each tract, piece or
parcel of land within the taxing district and shall state the number
of -annual installments in which such tax is to be collected; and
thereafter the City Clerk shall annually, at the same time other taxes
are certified certify to the County Clerk of Saline County, Kansas, a
full list of all property liable for such work and improvements,,to-
gether with the respective amounts due on each of said tracts, pieces
or parcels of land, which amounts shall include the annual install-
ments and interest on all unpaid balances for one year at the rate of
not to exceed 5 per cent per annum on such amounts so certified, which
shall be collected as other taxes are collected.
SECTION 27. This ordinance shall take effect and be in full force
from and after its publication once in the official city paper.

UXJI N -JL That the City Engineer shall on or before the 25th day
of May 1927, prepare and file in the office of the City Clerk, plans
and specifications for the construction of the IeterSewers provided
for in the preceding sections of this ordinance shall shall be of
the proper character and along the proper courses and at the proper
which
grades to serve the property lying within the districts within/such
such sewers are to be constructed, and shall on or before said date
prepare and submit to the Board of Commissioners detailed estimates,
under oath, of the cost thereof. That thereafter the City Clerk
shall advertise for three consecutive days in the official City
paper for (/sealed proposals for the building and construction of such
sewers according to such plans and specifications, which proposals
shall be filed with the City Clerk on or before the time fixed for
such notice or notices, at which time the Board of Commissioners
may let a contract for the building and construction of such sewers .
to the lowest,responsible bidder or bidders therefor, provided that
such bids shall not exceed the estimated cost thereof and provided
further that said Board shall reserve the right to reject any and
all such proposals and that if no responsible bids shall be received
within said estimated cost said Board may proceed and build such
sewer or sewers or any portion thereof within such estimated cost.
SECTION That for the cost of building and constructing.such
sewers, special assessments shall be made for the full cost thereof,
on all lots or pieces of land within the Main Sewer District within
which any such lateral sewer or portion thereof shall be built,
according to the appraised value thereof, without regard to the
improvements or buildings thereon.
SECTION wi,TjW ter the passage and publication of this ordinance,
the Board of Commissioners shall appoint three disinterested apprais-
ers who after having taken an oath to make a true and impartial
appraisement of all lots and pieces of land liable to taxation for
the cost of such improvements, shall within five days after having
and the apportionment therein contained shall hold good for all of
the installments that are to be collected from the specific property
chargeable with said improvement. Such assessment and apportionment
ordinance shall contain the total amount of t ax apportioned to each
tract, piece or parcel of land within the taxing district and shall
state the number of annual installments in which such tax is to be
collected; and thereafter the City Clerk shall annually, at the
same time other taxes are certified certify to the County Clerk of
Saline County, Kansas, a full list of all property liable for such
work and improvements, together with the respective amounts due on
each of said tracts, pieces or parcels of land, which amounts shall
include the annual installments and interest on all unpaid balances
for one year at the rate of not to exceed 5 percent per annum on such
amounts so certified, which shall be collected as other taxes are
collected.

from and after its publication once in the official city paper.
