3375 Construction of Main Sewer Districts N & OAN ORDINANCE creating and defining certain Main Sewer Districts in the City of Salina, designated as Main Sewer Districts 'IN" and Uoffand providing for the construction of Main Sewers in the Districts so created; providing for the cost thereof and for the levy of special assessments against the property in such districts for the payment of such costs, and for the issuing of bonds therefor. BE IT ORDAINED by the Board of Commissioners of the City of Salina Kansas: SECTION 1. MAIN SEWER DISTRICT N. That there be and there is hereby created a Main Sewer District in the City of Salina which shall be desig- nated as Main Sewer District "N", which shall include all of the following described property in said city, to -wit: Lot 17 in Replat of Block 5, Lots 3 and 4 in Block 4, Lots 1 and 2 in Block 2 $ i Lot I in Block 1, all of Blocks 61 7, 81 12, 13 and 14 and the west half of Blocks 9 and 15, all in South Park Addition, and Lots 1 and 2 in Block A, Lots 3 to 9 inclusive in Block B, and Lots 10 to 14 inclusive in Block C, all in South Park subdivision No. 1. SECTION 2. MAIN SEINER DISThICT 0. That there be and there is hereby created a Main Sewer District in the City of Salina which shall be desig- nated as Main Sewer District "0", which shall include all of the following described property in said city, to -wit: Lots 3 to 11, inclusive in Block 1, all of Block 2, Lots 8 to 15 inclusive- in Block 3, Lots 8 to 15 inclusive, in Block 5, all of Blocks 4 and 6, all in Phillips East Salina Addition; Lots 2 to 5 inclusive, and Lots 8 to 12 inclusive, all in >urveyor's Flat No. 12; and all of Blocks 1, 2, 3, and 4 in Stack Place. SECTION 3. That it is necessary and it is hereby ordered that a Main Sewer together with all necessary inlets, inlet connections, manholes, head walls and other appurtenances, be constructed and built in Main Sewer District "N", along the following described course within said district, as follows: iAm eight inch vitrified pipe sewer beginning at a manhole to be constructed in the intersection of Montrose and Prescott Streets; thence east in Prescott Street, approximately 478 feet to a manhole to be con- structed in said street; thence east in said street as a ten inch vitrified pipe sewer approximately 278 feet to a manhole to be constructed in said street; thence east in said street approximately 343 feet to connect with an existing ten inch vitrified pipe sewer in Prescott Street at a point Approximately 100 feet west of the west line of Eleventh Street. -I E SECTION 4. That it is'necessary and it is hereby ordered that a Main Sewer, together with all necessary inlets, inlet connections, manholes, head walls and other appurtenances, be constructed and built along the following course within 1again Sewer District "011 as follows: An eight inch vitrified pipe sewer beginning at a flush tank to be constructed in an alley south of Gypsum Avenue approximately 45 feet west of the west line of Missouri Avenue; thence west in said alley 114 feet to a manhole to be constructed in said alley; thence west in said alley 354 feet to a manhole to be constructed in said alley,; thence west in said alley as a ten inch vitrified pipe sewer 354 feet to a manhole to be constructed in said alley; thence west in said alley 181 feet to a manhole to be constructed in Ohio Avenue; thence north in Ohio Avenue 408 feet to a manhole to be constructed in said Ohio Avenue; thence north 286 feet to a manhole to be constructed in said Ohio Avenue; thence north 245 feet in Ohio Avenue to an existing manhole on the main sewer in iron L -venue. SECTION 5. That the City Engineer shall on or before the 25th day of may, 1927, prepare and file in the office of the City ulerk, plans and speci-fications for the construction of the Main Sewers provided for in the precedinL, sections of this ordinance which shall be of the proper character andalong the proper courses and at the proper grades to serve the property lying within the dis- tricts within which such sewers are to be constructed, and shall on or before said date prepare and submit to the Board of uom missioners detailed estimates, under oath, of the cost thereof. That thereafter the City Clerk shall advertise for three consecu- tive days in the official city paper for sealed proposals for the building and construction of such sewers according to such plans and specifications, which proposals shall be filed with the City Clerk on or before the tine fixed for such notice or notices., at which time the Board of Uommissioners may let a contract for the building and construction of such sewers to the lowest responsible bidder or bidders therefor; provided that such bids shall not ex- ceed the estimated cost there of and provided further that said Board shall reserve the right to reject any and all such proposals and that if no responsible bids shall be received within said estimated cost said board may proceed and build such sewer or sewers or any portion thereof within such estimated cost. 46, 'ECTION 6. That for the cost of building and constructing such sewers, special assessments shall be made for the full cost thereof, on all lots or pieces of land within the Main Sewer District within which any such main sewer or portion thereof shall be built, according to the appraised value thereof, without regard to the improvments or buildings thereon. SECTION 7. Z4-f-fter the passage and publication of this ordinance, the Board of commissioners shall appoint three disinterested appraisers who after having taken an oath to make a true and impartial appraisement of all lots or pieces of land liable to taxation for the cost of such im- provements, shall within five days after having been notified of their appointment proceed to appraise all of the lots or pieces of land within such districts, liable to assessment and taxation as aforesaid, without regard to the buildings or improvments thereon, and after makine, said appraisements shall return the same to the board of commissioners of said city and said Board shall designate a time foil holdin&, a special meeting of said board for the purpose of hearing any complaints that may be made as to the value of any lot or piece of land appraised as aforesaid, of which special session due notice shall be given in the official city paper, and at which special session said Bdard may alter any valuation bf any lot or piece of land,if,in their opinion, the same has been appraised too high or too low. SECTIO 8. The special assessments herein provided for may be paid by the person 'Liable therefor in ten approximately equal annual installments but the owner of any property liable to such assessment may within thirty days from the date of determining the amount assessed against his property pay the same in full and his property shall not be liable for any assess- ment for the cost of such improvements- and bonds as hereinafter provided for shall be issued for the amount of the cost of such improvements re- maining unpaid at the end of thirty days from the time such assessment is fixed. SECTION 9. For the purpose of paying for the work and improvements in this ordinance provided for, the Board of Commissioners are hereby authorized and directed to issue improvement bonds of the City of Salina in an"amount not to exceed the cost of such I and to run for a perios of ten years and be payable in ten approximately equal annual installments,together with interest not to exceed five percent per annum which bonds shall beissued and payable accordint to law; and for the purpose of paying the principal and interest on said bonds as they severally become due and payable, the board of Commissioners shall apportion and assess against the lots or pieces of land within the taxing districts of such improvements, special assessments covering the cost of such improments and the apportionment therein contained shall '�l I I hold good for all of the installments are to be collected from the specific property chargeable with said improvement. Such assess- ment and apportionment ordinance shall contain the total amount of tax apportioned to each tract., piece or parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually, at the same time other taxes are certified certify to the County Clerk of Saline County, Kansas, a full list of all property liable for such work and improvements, together with the respective amounts due on each of said tracts, piece or A of land, which amounts shall include the annual installments' and interest on all unpaid balances for one year at the rate of not to exceed 5 percent per annum, on such amounts so certified, which shall be collected as other taxes are collected. SECTION 5. That thereafter the City Clerk shall advertise for three consecutive days in the official city paper for sealed proposals for the building and con- struction of such sewers according to such plans and specifications,-&= which,proposalsshall be filed with , the City Clerk on or before the time fixed fox such notice or -notices, at which time the Board of Commissioners may let a contract for the build- ing and construction of such sewers to the lowest responsible bidder or bidders therefor;; provided that such bids shall not exceed the estimated cost thereof and provided further that said Board shall reserve the right to reject any and all such proposals and that if no responsible bids shall be received within said estimated cost said Board may proceed and build such sewer or sewers or any portion thereof within such estimated cost. SECTION 6.
