3374 Construction of SidewalksOhDINAiiCE AU. 3374 AN ORDINkNCE relating to the construction and r6construction of certain sidewalks- and the condemnation of certain existing sidewalks - along certain streets in the City of Salina. 31 WHEREAS, petitions; each duly signed by ten or more citizens of the City of Salina, have been filed in the office of the City Clerk, asking for the construction of the sidewalks along the streets, and in front of and abutting upon the property mentioned in Section 1 of this ordinance, and WHEREAS, the sidewalks lying in front of and abutting upon the several pieces of property mentioned in Section 2 of this ordinance are in judgment of the Board of commissioners unsafe, worn out and unfit for repair; NOY,,i THEEREFURE, BE, IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That it is hereDy determined to be necessary,, and it Is hereby ordered, that concrete sidewalks five feet in width- be constructed and laid, in accordance with ordinance No. 2407 and with the. plans and specifications forconcretesidewalks on file in the office of the City Engineer and in the office of the City Clerk, which plans and specifications have been and are now hereby approved, upon grades to be furnished by the City Engineer, along the following streets and in front of and abutting upon the several lots and parcels of land hereinafter described, to -wit: Along the south side of Gypsum Avenue lying in front of and abutting upon the north side of Lots 2, 3, 41 5 and 6 in Block 2 and Lots 1, 2 and 3 in 'lock 4, in Stack Place; Lots 2, 31 4 and 5 in Surveyor's Flat 12; and Lots 11 2, 3,4 and 5 in Block 11 in Oakdale Addition. Along the west tide of Ninth Street, lying in front of and abutting upon the east side of Lot 15 in Block 9 in Bachtolds Plat, a part of West View Addition. Along the south side of Ellsworth avenue (east of i�ourth Street) lying in front of and abutting upon the north side of Lots 1, 3- 5 7 and 9 on Ellsworth J_ivenue in the Addition to the grounds of Kansas 741jesleyan University. Along the north side of University Place, lying in front of and abutting upon the south side of Lots 13 and 14 in Block 7 in Leaven- worth Addition. That it is hereby determined that the existing sidewalks lying in front of and abutting upon -._he lots and parcels of lamdhereinafter described are unsafe, warn out andunfit for re- pair, and that they be and the same are hereby condemned and ordered removed, and that such sidewalks be reconstructed of concrete, in accordance with ordinance No. 2407 and according to the plans and specifications for concrete sidewalks on file in the office.of the City Engineer and in the office of the City Clerk, which plans and specifications have been and are now hereby approved by the Board of Commissioners, on grades to be furnished by thy-° City Engineer., said sidewalks to be five feet in width unless herein otherwise specified, to -wit: Along the east side of Ninth Street, lying in front of and abutting upon the west side of Lots 58,68,70, 72 and 74 on Ninth Street., and Lot 75 on Ash Street$ Original Town; Along the west aide of Columbia Avenue lying in front of and abutting upon the east side of the North twenty-two feet of the east sixty-five feet of Lot 2,in Block 12 in Riverside Park Addi- tion; Along the east side of Tenth Street lying in front of and abutting upon the west side of the south fifty feet of Lot 10 on Park Street in Bishops Addition; Along the east side of Seventh Street lying in front of and abutting upon the west side of the south half of Lot 99, and the north half of Lot 101 on Seventh Street (said sidewalk to be 12 feet wide); Lot 123 on Seventh Street ( 12 feet wide); and Lot 125 on Seventh Street (5 feet wide); VM EM Along the west side of Seventh Street lying in front of and abutting upon the east side of Lot 118 and the south half of Lot 120 on Seventh Street ( sidewalk to be 12 feet wide); Along the south side of Ash Street lying in front of and abutting upon the north side of the east 46 feet Lot I and the west 50 feet 11 Lot 2 all in Block 13 Iliverside Park Addition; Along the west side of Santa -be avenue, in front of and abutting upon the east side of the south one-half of Lot 148 and the north nine feet of Lot 150 on Santa Fe I.venue ( said sidewalk to be 10 feet wide). Section 3. That the owners of each of the lots and parcels of land described in Sections 1 and 2 of this ordinance be and they are hereby ordered to construct in front of and abutting upon said lots or parcels of land., concrete sidewalks as above described,and that if any of them shall fail within fifteen (15) days from and after the publication of this ordinance to construct such sidewalks, the city engineer shall prepare and file with the City Clerk a detailed estimate under oath, of the cost of constructing such sidewalks, and the Board of Commissioners of said city shall proceed to construct or cause to be constructed such sidewalks as herein provided for and may let a contract therefor at a price not to exceed the estimate Of the City Engineer, and shall assess the cost thereof- which shall include 10 pre cent of the contract price on account of engineering, in- spection, legal and incidental expenses, against such lots or parcels of land upon which such sidewalks shall abutt according to the front foot thereof., and suchcost so assessed shall be certified by the City Clerk to the County Clerk of Saline Qounty to be collected as other taxes and assessments are collected. Along the west side of Santa Fe Avenue, in front of and abutting upon the east side of -the south - one-halffc^t of Lot 148 and the north nine feet of Lot 150 6n Santa Fe Avenue (Aid sidewalk to be '10 feet wide). Section 3. That the owners of each of the lots and parcels of land described in Sections 1 and 2 of this ordinance be and they are hereby ordered to construct in front of and abutting upon said lots or parcels of land, concrete sidewalks as above described, and that if any of them shall fail within fifteen (15) days from and after the publication of this ordinance to construct such side- walks, the city engineer shall prepare and file with the City Clerk a detailed estimate, under oath, of the cost of constructing such sidewalks, and the Board of Commissioners of said city shall proceed to construct or cause to be constructed such sidewalks as herein provided for and may let a contract therefor at a price not to exceed the estimate of the City Engineer, and shall assess the cost thereof, which shall include 10 percent of the contract price on account of engineering, inspection, legal and incidental ex- penses, against such Pots or,parcels of land upon which such side- walks shall abutt according to the front Not thereof, and such cost so assessed shall be oertified by the City Clerk to the County Clerk of Saline County to be collected as other taxes and assess- ments are collected.
