3352 Street Improvements Country Club Rdd�1 ORDINANCE NO, 3352 AN ORDINANCE providing for the curbing and guttering of County Club Road in the City of Salina, Kansas, from the ea s ne o arymount Road to the west line of Hilldale Road. WHEREAS, a petition signed by all of the resident owners of all of the real property liable for taxation for the cost of the improve- ment herein provided for has been filed with the City Clerk praying for the curbing and guttering of the south side of Country Club "oad, lying along the north side of Country Club Heights Addition in the City of Salina, from the east line of Marymount Road (which lies along the west side of said Country Club Heights Addition, terminating at the section corner common to Sections 7, 8 , 17 and 18, Township 14 south, Range 2 west,) to the west line of Hilldale Road, which lies along the east side of said addition, the east line of which said Hilldale Road is 1880 feet east of said common section corner, and WHEREAS, it has been determined by the Board of Commissioners of said city that all of the signers of said petition are residents of the City of Salina, and .that all of the signatrues on said petition are the genuine signatures of the persons whose names appear thereon, and that they are the owners of all of the property liable for taxation for the cost of such improvements, NOW THEREFORE, BE IT -ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That it is necessary and it is hereby ordered that the south side of Country Club Woad in the City of Salina, Kansas, (lying along the north side of Country Club Heights Addition of said City) from the east.line of Marymount Road, which lies along the west side of said addition, terminating at the section corner common to Sections 7, 8, 17 and 18, Township 14 south, Range 2 west,) to the west line of Hilldale Road, which lies along the east side of said Addition, the east line of which said Hilldale oad is 1880 feet east of said common section corner) be curbed and guttered with monolithic curb and gutter, 7 feet wide, according to the specifications of the City Engineer of the City of Salina as hereinafter provided for, and that said street within the limits above defined be excavated and graded to such extent as may be necessary for the completion of said work, and that at the intersections of streets such curbing and guttering shall be car-r•ied back to the lot line of the street so improved, including the curbing and guttering lying around the public park lying between the intersections of West Park Lane and East Park Lane with said Country Club Road. Section 2. That for the work and improvements herein provided for the City Engineer shall make and file with the City Clerk on or before the 7th day of April 1927, complete plans and specifications for the curbing and guttering of said streets, with monolithic concrete curb and gutter, 7 feet wide, except that the curb and gutter be carried back to the property line at street intersections, and around said park, shall be 2 feet wide, and for the excavation and grading necessary therefor, and that on or before said last name and date said City Engineer shall submit to the Hoard of Commissioners, under oath, a detailed estimate of the cost of such curbing and guttering including the excavation and grading necessary therefor. Section 3. That after the plans and specifications shall have been made and prepared by the City rngineer and filed with the City Clerk as aforesaid the Board of Commissioners may advertise, by advertisement published in the official city paper for three consecutive days, for the receipt of sealed proposals for the performance of the wlrk specified in the preceding section hereof, and after the receipt of such proposals said Board of Commissioners may and they are hereby authorized to let a contract dor the improving of said street as herein provided for, to the lowest responsible bidder therefor, as determined by the Board of Commissioners, said Board reserving the right to reject any or all bids. Section 4. That for the improving of said street, special assessment shall be made for the full cost thereof on all lots and pieces of land to the center of the block on the south side of said street so improved, according to the appraisers value thereof, with- out regard to the building or improvements thereon, for the distance to.be improved, in the manner provided by law, the lots and pieces of land to be so taxed being hereby designated to include lots 4, 5 and 6 in block 1 and lots 13 to 23 inclusive and the north one- half lot 12 in block 6, in Country Club Heights Addition. Section 5. After the passage and publication of this ordinance the Board of Commissioners shall appoint three disinterested appraisers, householders, who after having taken an oath to make a true and impartial appraisement of all lots and pieces of land liable to assessment and taxation for the cost of the improvements herein provided for, shall within five days after having been notified of their appointment proceed to appraise said lots and pieces of land liable to assessment and taxation as aforesaid without regard to the buildings or improvements thereon, and after making said appraisement shall return the same to the Board of Commissioners of said City and said Board of Commissioners shall designate a time for holding a special session of such Board for the purpose of henring any com- plaints that may be made as to the value of any lots and pieces of land appraised as aforesaid, of which special session due notice shall be given in the official City paper, at which special session the Board of Commissioners may alter any valuation of any lot or piece of land if, in their opinion, the same has been appraised too high or too low. Section 6. For the purpose of paying for the work and improve- ments in this ordinance provided for the Board of Commissioners are hereby authorized and directed to issue internal improvement bonds of the City of Salina in an amount not to exceed the contract price for such improvements and to run for a period of ten years and be payable in ten equal installments, together with interest not to exceed 5,% per annum,, which bonds shall be made payable at the fiscal agency of the State of Kansas; and for the purpose of paying principal and interest on said bonds as they severally become due and payable the Board of Commissioners shall apportion and assess against the lots and pieces of land within the taxing district of such improvements and the apportionment therein contained shall hold good for all the installments that are to be collected from the specific property chargeable with said improvements. Such assessment and apportionment ordinance shall contain the total amount of tax apportioned to each tract, piece and parcel of land within the taxing district and shall state the.number of annual installments in which such tax is to be collected; and.thereafter the City Clerk shall annually, at the same time other taxes are certified, certify to the County Clerk of Saline County, Kansas, a full list of all property liable for such work and improvement, together with the respective amounts due on each of said tracts, pieces and parcels of land, which amounts shall include the annual installments and interest on all unpaid balances for one year at the rate of not to exceed 5% per annum, on such amounts so certified, which shall be collected as other taxes are collected; PROVIDED, that for the purpose of defraying the cost of improving the intersections and areas £ommed by the crossing of streets as well as khere the improvement is through or adjacent to,property of the City for which the City would be liable, the assessment will be made against all taxable property of the City and paid by the City at large. Section 9 This ordinance shall take effect and be in full force from and after its publication once in the official city paper. Section 2. That for the work and improvements herein provided for the City Engineer shall make and file with the City Clerk on or before the 7th day of April 1927, complete plans and specifications for the curbing and guttering of said streets, with monolithic concrete curb and gutter, 7 feet wide, except that the curb and gutter be carried back to the property line at street intersections, and around said park, shall be 2 feet wide,.and for the excavation and grading necessary therefor, and that on or before said last name and date -said City Engineer shall submit to the Board of Commissioners, under oath detailed estimate of the cost of such curbing and guttering including the excavation and grading necessary therefor. Section 3. That after the plans and specifications shall have been made and prepared by the City Engineer and filed with the City Clerk as aforesaid the Board of Commissioners may advertise, by advertisement published in the official city paper for three consecutive days, for the receipt of sealed proposals for the perfoilmance of the work specified in the preceding section hereof, and after the receipt of such proposals said Board of Commissioners may and they are hereby authorized to let a contract for the improving of said street as herein provided for, to the lowest responsible bidder therefor, as determined by the Board of Commissioners, said Board reserving the right to r eject any or all bids. to r Section 4. Such assessment and apportionment ordinance shall contain the total amount of tax apportioned to each tract, piece and parcel of land within the taxing district and shall state the number of annual installments in which such tax is to. be collected; and thereafter the City Clerk shall annually, at the same time other taxes are certified, certify to the County Clerk of.Salina County, Kansas, a ful list of all property liable for such work and improve- ment, together with the respective amounts due on each of said tracts, pieces and parcels of land, which amounts shall include the annual installments and interest on all unpaid balances for. one year at the rate of not to exceed 5% per annum, on such amounts so certified, which shall be collected as other taxes are collected; PROVIDED, that for the purpose of defraying the cost of improving the intersections and areas formed by the crossing of streets xnd as well as where the improvement is through or adjacent to property of the City for which the City would be liable, the assessment will be made against all taxable property of the City and paid by the City at large. 00 w Section 1"his ordinance shall take effect and be in full force from and after its publication once in the official city paper.
