WHEREAS, by resolution duly introduced on November 23rd, 1926, and duly adopted by the Board of Commissioners of said City on December 20th, 1926, said Board of Commissioners have declared that it has become expedient and a public necessity to grade and pave that certain public street in the City of Salina which lies along the section lines common to Sections 17 -and 18, in Township 14 south, Range 2 west, commencing at the section corner common to Sections 70 8, 17 and -18 and running thence east "1880 feet to the corporate limits of the City of Salina, the center line of which is the common section line above referred to, (the north half of which lies outside of City of Salina) said street being known as Country Club Road, so as to connect the existing pavement in said city which terminates at said section cormer common to Sections 7, 8, 17 and 18 with the county road lying between Sections 17 and 180 Township 14 south, Range 2 west, in Saline County and extending east from said city limits at a point 1880 feet east of said common section corner, the above portion of said street being less than one-half mile in length; and WHEREAS, before the final adoption of said resolution by said Board of Commissioners, twenty days notice thereof was duly given by publication in the Salina Journal, the official city paper as required by Section 13-1033 Revised Statutes 1923; and WHEREAS, after the adoption. of said resolution by said Board of Commissioners, the same was duly submitted to the Board of County Commissioners of Saline County, Kansas, and was duly adopted by said Board of County Commissioners at a regular meeting of said Board on February 9, 1927, and was duly published thereafter in three conse- cutive issues of the Salina J urnal,:the official,county paper, such publication commencing FebruaPy .l'%, 1927, NOW THEREFORE, BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. shat it is necessary and it is hereby ordered that certain public street in the City of Salina.. Kansas, as hereinabove described, known as Country Club Road, from the section corner common to Sections 7, 8, 17 and 18, Township 14; south, Range 2 west, to a point 1880 feet east of said common corner, said street lying along the section lines common to said Sections 17 and 18, be graded and paved so as to connect the existing pavement which terminates at said common section corner with the county road in Saline County, Kansas, lying east of a point 1880 feet east of said common section corner, and extending east from the city limits at said point between and adjacent to Sections 17 and 18, that said paving shall be of concrete 20 feet wide and shall be built and constructed in accordance with the plans and specifications of the City Engineer of the City of Salina, Kansas as hereinafter provided for. Section 2. That for such work and improvement herein provided for the City Engineer shall make and file with the City Clerk on or before the 7th day of April 19270 complete plans and specifications for the grading of said street and for the paving thereof with the following materials: PAVING 1. 6 inch Portland Cement Concrete (reinforced) 2. 6 inch Portland Cement Concrete (Plain) 3. 6 inch Vibrolithic Concrete and that on or before said date last named the City Engineer of said City shall submit to the Board of Commissioners, under oath, detailed estimates -of the cost of such paving, including the exca- cation and grading necessary therefor with the different kinds of materials mentioned herein. Section 3. That after the plans and specifications shall have been made and prepared by the City Engineer and filed with the City Clerk.as aforesaid the Board of Commissioners shall advertise, by advertisment published in the official city paper of the City of Salina, Kansas for three consecutive days for the receipt of sealed proposals for the grading necessary for the completion of said paving, and for the paving of said street with the kind of material named and specified hereinbefore, and after the receipt of such proposals the said Board of Commissioners may and are hereby authorized to let contracts for the improving of said street with the material so selected to the lowest responsible bidder or bidders therefor, as determined by said Board of Commissioners, which kind and character of paving shall be determined by said Board of Commissioners, and for such excavating and grading. Said Board of Commissioners re- serve the right to reject any and all bids. Section 4. That the cost of the improvements hereinabove provided for shall be paid as follows: 30 per cent by the.City of Salina, Kansas, 30 per cent by Saline County, Kansas, and for the remaining 40 per cent special assessment shall be made for -the full amount thereof on all lots and pieces.of land as provided by law, to -wit: to the center of the block on the south side of said street which property is within the .City of Sglina, and upon the land on .the north side of said street, which land is unplatted and lies outside of said City,.on all land lying within a distance.of 1320 -feet from the property line of said street,.according to the value of such lots and tracts of land without regard to the build- ings or improvements thereon,, for the distance to .be improved, the same being hereby fixed as the benefit district for said improve- ment as provided by law, such value and apportionment of such cost to be made by the appraisers.appointed as hereinafter provided for. Section 5. After the passage and publication of this ordinance the Mayor of the City of'Salina shall appoint three disinterested pro - party owners, who shall be approved by the Board of Commissioners of the City of Salina and by the Board of County Commissioners of Saline County, Kansas, who after having taken an oath to make a true and impartial appraisement of all lots and pieces of land liable to assessment and taxation for the cost of the improvements herein provided for, shall within five days after having been notified of their appointment pro- ceed to appraise said lots and pieces of land liable to assessment and taxation as aforesaid, as herein designated, without regard to the buildings or improvements thereon, and after making said appraisement shall return the same to the Board of Commissioners of said City and said Board of Commissioners shall designate a time for holding a special session of such Board for the purpose of hearing any complaints that may be made as to the value of any lots or pieces of land appraised as aforesaid, of which special session due notice shall be given in the official city paper, at which special session the Board of Commissioners may alter any valuation of any lot or piece of land if, in their opinion, the same has been appraised too high or too low. Section 6. That for the purpose of paying for the 30 per cent of the cost of said work and improvement to be paid for by the City of Salina, and such portion of the 40 per cent of said cost to be paid for by special assessment against the property in the benefit district herein provided for as may be assessed against the lots and pieces of land lying along the south side of said street, the Board of Commissioners of the City of Salina are hereby authorized and directed to issue Internal Improvement Bonds of the City of Salina in an amount not to exceed said 30 per cent of the contract price of such improvements to be paid for by the City and such portion of the 40 per cent to be assessed against the property owners as may be assessed against property lying within the City, and to run for a period of ten years and be payable in ten equal installments, together with interest not to exceed 5 per cent per annum,'which bonds shall be made payable at the fiscal agency of the State of Kansas; and for the purpose of paying principal and interest on said bonds as they severally become due and payable the Board of Commissioners shall apportion, and assess against the lots and pieces of land within the taxing district of such improvements special assessments covering the cost of such improvements and :the apportionment therein contained shall hold good for all the installments that are to be collected from the specific property chargeable with said improvements. Such assessment and'apportionment ordinance shall contain the total amount of tax apportioned to each tract, piece and parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually, at the same time other taxes are certified, certify to the County Clerk of Saline County, Kansas, a full list of all property liable for such work and improvement, together with the respective amounts due on each of said tracts, pieces and parcels of Innd, which amounts shall include the annual installments and interest on all unpaid balances for one year.at the rate of not to exceed 5% per annum, on such amounts so certified, which shall be collected as other taxes are collected; PROVIDED, however that the owner of any lot or pieces of land liable to any such special assessment may redeem his property from such liability by paying the entire amount chargeable against his property at any time within 30 days after such assessment which has been made, or at any time before the issuance of said bonds, and any property upon which any such assessment shall have been paid shall not thereafter be liable to further special assessment for the cost of such improve- ment, and provided further that for the 30 per cent of such cost to be paid by the City of Salina, the assessment will be made against all taxable property of the City and paid by the City at large.
