3344 Street Improvements Crawford AveORDINANCE NO. 3344 (Published—in the Salina Journal faaren iyaf.), AN ORDINANCE providing for the curbing, guttering, grading and paving of Crawford Avenue from the east line of Tenth Street to the east line—of the Missouri Pacific Railroad right-of-way, and providing for the cost thereof, how the same shall be paid and assessed, and the manner of payment therefor. WHEREAS,'by resolution duly introduced on December 20th, 1926, and duly adopted by the Board of Commissioners of said City on February 7th, 1927, said Board of Commissioners have declared that it has become expedient and a public necessity to curb, gutter, grade and pave Crawford Avenue from the east line of Tenth Street in the City of Salina to the city limits of said city at the east line of the Missouri Pacific Railroad right-of-way, so 'as to con- nect the existing pavement on Crawford Avenue at Tenth Street with the county road lying between Sections 14 and 23, Township 14, south, Range 3 west, in Saline County, and extending west from said city limits at said Missouri Pacific Railroad right-of-way, the above portion of said street being less than one-half mile in length; and WHEREAS, before the final adoption of said resolution by said Board of Commissioners, twenty days notice thereof was duly given by publication in the Salina Journal, the 'official city paper as required by Section 13-1033 Revised Statutes 1923; and WHEREAS, after the adoption of said resolution by said Board of Commissioners, the same was duly submitted to the Board of County Commissioners of Saline County, Kansas, and was duly adopted by said Board of County (ommissioners at a regular meeting of said Board on February 9, 1927, and was duly published thereafter in three consecutive issues of the Salina Journal, the official city paper and in three consecutive issues of the Salina Journal, the official county paper, such publication commencing on February 179 19270 NOW THEREFORE,,. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That it is necessary and it is hereby ordered that Crawford Avenue in the City of Salina, Kansas from the east line of Tenth Street to the east line of the Missouri Pacific Railroad right-of-way therein, be curbed, guttered, graded and paved so as to connect the existing pavement on Crawford Avenue at Tenth Street with the county road in Saline County, Kansas, lying west of the east line of the Missouri Pacific Railroad right-of-way and extending west from the city limits at said point between and adjacent to Section 14 and Section 23, Township 14, Range'3 1n said county; that said curbing and guttering shall be combined concrete curb and gutter 2 feet in width exclusive of width of curb, and that said paving shall be of concrete 30 feet wide exclusive of curb and gutter, all to be built and constructed in accordance with the plans and specifications of the City Engineer of the city of Salina, Kansas as hereinafter pro- vided for. Section 2. That for the work and improvement herein pro- vided for the City Engineer shall make and file with the City Clerk on or before the 7th day of.April 1927 complete plans and specifications for the grading of said street and for the curbing, guttering and paving thereof with the following materials: CURB AND GUTTER: PAVING: \ t' Combined curb and gutter (Portland Cement Concrete) width from face of curb to paving line 24 inches; curb to be 6 inches wide at the top and 6 inches deep from top of curb to top of gutter; gutter to be 7 inches deep. 1. 6 inch Portland Cement Concrete (reinforced) 2. 6 inch Portland Cement Concrete (Plain) 3. 7 inch Portland Cement Concrete (reinforced) 4. 7 inch Portland Cement Concrete (Plain) 5. 6 inch Vibrolithic Concrete 6. 7 inch Vibrolithic Concrete and that on or before said -date last named the City Engineer of said city shall submit to the Board of Commissioners, under oath, detailed estimates of the cost of such curbing, guttering and paving including the excavation and grading necessary therefor with the different kinds of materials mentioned herein. Section 3. That after the plans 'and specifications shall have been made and prepared by the City Engineer and filed with the City.Clerk as aforesaid the Board of Commissioners shall ad- vertise by advertisement published in the official city paper of the City of Salina, Kansas for three consecutive days for the receipt of sealed proposals for the curbing and guttering of said street with the kind of material named and specified in the pre- ceding section hereof, and for the excavation and grading necessary for the completion of such curbing and guttering and paving, and for the paving of said street with the kind of material.named.and specified hereinbefore, and after the receipt of such proposals 'the said Board of Commissioners may and are hereby authorized to let contracts for the improving of said street with the material so selected to the lowest responsible bidder or bidders therefor, as determined by said Board of Commissioners, which kind and character of curbing and guttering shall be determined by said Board of Commissioners, and for such excavating and grading. Said Board of Commissioners reserve the right to reject any and all bids. Section 4.. That the cost of the improvements herein above provided for shall be paid as follows: 30 per cent by the City of Salina; Kansas, 30 per cent by Saline County, Kansas and for the remaining 40 per cent special assessment shall be made for the full amount thereof on all lots and pieces of land to the center of the block on either side of said street according to the value of such lots and tracts of land without regard to the buildings or improve- ments thereon, for the distance to be improved, the same being here- by fixed as the benefit distriot fdr said improvement as provided by law, such value and apportionment of such cost to be made by the appraisers appointed as hereinafter provided'for. Section 5. After the passage and publication of this ordinance, the Mayor of the City of Salina shall appoint three disinterested pro- perty owners, who shall be approved by the Board of Commissioners of the City of Salina and by the Board of County Commissioners of Saline County, Kansas, who after having taken an oath to make a true and impartial appraisement of all lots and pieces of land liable to assess- ment and taxation for the cost of the improvements herein provided for, shall within five days after having been notified of their appointment proceed to appraise said lots and pieces of land liable to assessment and taxation as aforesaid as herein designated without regard to the buildings or improvements thereon, and after making said appraisement shall return the same to the Board of Commissioners of said City and said Board of Commissioners shall designate a time for holding a special session of such Board for the purpose of hearing any complaints that may be m ado as to the value of any lots or pieces of land appraised as aforesaid, of which special session due notice shall be given.in the official city paper, at which special session the Board of Commissioners may alter any valuation of any lot or piece of land if, in their opinion, the same has been appraised too high or too low. Section 6. That for the purpose of paying for the 30 per cent of the cost of -said work and improvement to be paid for by the City of'Salina, and the 40 per cent of said cost to be paid for by special assessment against the property in the benefit district herein provided for, the'Board of Commissioners of the City of Salina are hereby authorized and directed to issue Internal Improvement Bonds of the City of Salina in an amount not to exceed 70 per cent of the contract price of such improvements, and to run for a period of ten years and be payable in ten equal installments together with interest not to exceed 5 per cent per annum, which bonds shall be made payable at the fiscal agency of the State of Kansas; and for the purpose of paying principal and interest on said bonds as they severally become due and payable the Board of Commission shall apportion and assess against the lots and pieces of land within the taxing district of such improvements special assessments covering the cost of such improvements and the apportionment therein contained shall hold good for all the installments that are to be collected from the specific property chargeable with -said improvements. Such assessment and apportionment ordinance shall contain the total amount of tax apportioned to each tract, piece and parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually at the same time other taxes are certified, certify to the County Clerk of Saline County, Kansas, a full list of all property liable for such work and improvement, together with the respective amounts due on each of said tracts, pieces and parcels , of_,land, which amounts shall include the annual installments and interest on all unpaid balances for one year at the rate of not to'exceed 5% per annum, on such amounts so certified, which shall be collected as other taxes are collected; PROVIDED, however that the owner of any lot or pieces of land liable to any such special assessment may redeem his property from such liability by paying the entire amount chargeable against his property at any time within 30 days after such assessment which has been made, or at any time before the issuance of said bonds, and any property upon which any such assessment shall have been paid shall not thereafter ,be liable to further special assessment for the cost of such improve- ment, -and provided further that for the 30 per cent of such cost to be paid by the City of Salina, the assessment will be made against all taxable property of the city and paid by the city at large.
