AN ORDINANCE providing for the curbing, guttering, grading and paving
of Pacific Street in the City of Salina, Kansas, am the
eastline o San a Fe Avenue to the center line o�jCFront
Street, and providing.for the cost thereof, how the same
shall be paid and assessed, and the manner of payment thereof.
WHEREAS, by resolution duly introduced on December 20th,
1926, and duly adopted by the Board of Commissioners of said City on
February 7th, 1927s said Board of Commissioners have declared that it
has become expedient and a public necessity to curb, gutter, grade and
pave Pacific Street.in the City of Salina, Kansas from the east line
Of Santa Fe Avenue to the city limits of said city at the center line
of Front Street, the same being the center lines of Section 1 and 12,
Township 14, Range 3, Saline County, Kansas, so as to connect the ex-
isting pavement on said Santa Fe Avenue in said city with the county
road in said city lying between and adjacent to the southeast quarter
Of Section 1 and the northeast quarter of. Section 12, and extending east
from said city limits at Front Street, said portion of said street being
less than one-half mile in length; and
WHEREAS, before the final adoption of said resolution by
said Board of Commissioners, twenty days notice thereof was duly
given by publication in the Salina Journal, the official city paper
as required by Section 13-1033 Revised Statutes 1923; and
WnExEAS, after the adoption of said resolution by said Board
of Commissioners, the same was duly submitted to the Board of County
Commissioners of Saline County, Kansas, and was duly adopted by said
Board of County Commissioners at a regular meeting of said Board on
February 9th, 1927, and was duly published thereafter in three consecu-
tive issues of the Salina Journal, the official city paper and in three
consecutive issues of the Salina Journal, the official county paper,
such publication commencing on February 17, 19270 NOW THEREFORE
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. That it is necessary and it is hereby ordered
that Pacific Street in the City of Salina, Kansas from the east line
of Santa Fe Avenue to the center line of Front Street therein, be
curbed, guttered, graded and paved so as to connect the existing
pavement on Santa Fe Avenue with the county road in Saline County,
Kansas, lying east of the center line of Front Street, and extending
east from the city limits at Front Street between and adjacent to
the southeast quarter of Section 1 and the northeast quarter of
Section 12, Township 14, Range 3 in said county; that said curbing
and guttering shall be combined concrete curb and gutter 2 feet in
width exclusive of width of curb, and that said paving shall be of
concrete 36 feet wide exclusive of curb and gutter, all to be built
and constructed in accordance with the plans and specifications of the
City Engineer of the City of Salina, Kansas, as hereinafter provided for.
Section 2. That for the work and improvement herein provided
for the City Engineer shall make and file with the City Clerk on or
before the 7th day of April 1927 complete plans and specifications for
the grading of said street and for the curbing, guttering and paving
thereof with the following materials:
CURB.AND GUTTER
Combined curb and gutter (Portland Cement Concrete):
Width from face of curb to paving line 24 inches;
Curb to be 6 inches wide at the top and 8 inches
deep from top of curb to top of gutter; gutter to
be 7 inches deep.
PAVING
1. 7 inch Portland Cement Concrete (reinforced)
2. 7 inch Portland Cement Concrete (Plain)
3. 7 inch Vibrolithic Concrete
and that on or before said date last named the City Engineer of
said city shall submit to the Board of Commissioners, under oath,
detailed estimates of the cost of such curbing, guttering and
paving including the excavation and grading necessary therefor
with the different kinds of materials mentioned herein.
Section 3. That after the plans and specifications shall have
been made and prepared by the City Engineer and filed with the City
Clerk as aforesaid the Board of Commissioners shall advertise, by
advertisement published in the official city paper of the city of
Salina, Kansas for three consecutive days for the receipt of sealed
proposals for the curbing and guttering of said street with the kind
of material named and specified in the preceding section hereof,
and for the excavation and grading necessary for the completion of
such curbing and guttering and paving, and for the paving of said
street with the kind of material named and specified hereinbefore,
and after the receipt of such proposals the said Board of Commissioners
may and are hereby authorized to let contracts for the improving of
said street with the material so selected to the lowest responsible
bidder or bidders therefor, as determined by said Board of Commissioners
which kind and character of curbing and guttering and paving shall
be determined by said Board of Commissioners, and for such excavating
and grading. Said Board of Commissioners reserve the right to re-
ject any and all bids.
Section 4. That the cost of the improvements herein above
provided for shall be paid as follows: 30 per cent by the City of
Salina, Kansas, 30 per cent by Saline County, Kansas, and for the
remaining 40 per cent special assessment shall be made for the full
amount thereof on all lots and pieces of land to the center of the
block on either side of said street according to the ;value of such
lots and tracts of land without regard to the buildings or improve-
ments thereon, for the distance to be improved, the same being
hereby fixed as the benefit district for said improvement as pro-
vided by law, such value. and apportionment of such cost to be made
by the appraisers appointed as hereinafter provided for.
Section 5. After the passage and publication of -this ordinance,
the Mayor of the City of Salina shall appoint three disinterested
property owners, who shall be approved by the Board of Commissioners
of the City of Salina and by the Board of County Commissioners .of
Saline County, Kansas, who after having taken an oath to make a true
and impartial appraisement of all lots and pieces of land liable to
assessment and taxation for the cost of the improvements herein pro-
vided for, shall within five days after having been notified of their
appointment proceed to appraise said lots and pieces of land liable
to assessment and taxation as aforesaid as herein designated by the
Board of Commissioners of said City, without regard to the buildings
or improvements thereon, and after making said appraisement shall
return the same to the Board of Commissioners of said City and said
Board of Commissioners shall designate a time for holding a special
session of such Board for the purpose of hearing any complaints that
may be made as to the value of any lots or pieces of land appraised
as aforesaid, of which special session due notice shall be given in
the official city paper, at which special session the Board of
Commissioners may alter any valuation of any lot or piece of land
if, in their opinion, the same has been appraised too high or too
low.
Section 6. That for the purpose of paying for the 30 per
cent of the cost of said work and improvement to be paid for by the
City of Salina, and the 40 per cent of said cost to be paid for by
spebial assessment against the property in the benefit district
herein provided for, the Board of Commissioners of the City of Salina
are hereby authorized and directed to issue Internal Improvement
Bonds of the City of Salina in an amount not to exceed 70 per cent
of the contract price of such improvements, and to run for a period
of tenyears and be payable in ten equal installments, together with
interest not to exceed'5 per cent per annum, which bonds shall be
made payable at the fiscal agency of the State of Kansas; and for;
the purpose of paying principal and interest on said bonds as
they severally become due and payable the Board of Commissioners
shall apportion and assess against the lots and pieces of land with-
in the taxing district of such improvements special assessments

covering the cost of such improvements and the apportionment therein
contained`Shall hold good for all the installments that are to be
collected from the specific property chargeable with said improvements.
Such assessment and apportionment ordinance shall contain the
total amount of tax apportioned to each tract, piece and parcel
of land within the taxing district and shall state the number of
annual installments in which such tax is to be collected; and
thereafter the City Clerk shall annually, at the same time other
taxes are certified, certify to the County Clerk of Saline County,
Kansas, a full list of all property liable for such work and im-
provement, together with the respective amounts due on each of
said tracts, pieces and parcels of land, which amounts shall in-
clude the annual installments and interest on all unpaid balances
for one year at the rate of not to exceed 5% per cent per annum,
on such amounts so certified, which shall be collected as other
.taxes are collected; PROVIDED, however that the owner of any lot
or pieces of land liable to any such special assessment may redeem
his property from such liability by paying the entire amount
chargeable against his property at any time within 30 days after
such assessment which has been made or at any time before the
issuance of said bonds, and any property upon which any such
assessment shall have been paid shall not thereafter be liable
to further special assessment for the cost of such improvement,
and provided further.that for the 30 per cent of such cost to be
paid by the City of Salina, the assessment will be made against
all taxable property of the city and paid by the city at large.
Section 7. This ordinance shall take effect and be in full
,force:from.and after its publication once in the official city paper.

An Ordinance providing for the'curbing, guttering, grading and
