3328 Annex` ORDINANCE -N0..-3328 -I, __ - T_., v.v...I .T.,� I'a �i 4� aaO71 AN ORDINANCE providing that certain platted additions or subdivisions, and certain unplatted tracts of land, which join the present limits of the City of Salina, Kansas, be added to, taken into and made parts of the City of Salina, Kansas; extending the city limits of said city so as to include such added land; defining the corporate limits of said city as extended, and repealing all ordinances or parts of ordinances in conflict with the provisions of this ordinance. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That. Mt. Barbara Park; a platted addition or sub - in Saline County, Kansas, which is subdivided into lots and blocks, according .to the recorded plat thereof on file and of record in the office of the Register of Deeds of Saline County, Kansas as shown in Plat Certificate Book No. 1 at page 181, and in Book E of Plats at page 48, the north boundary of which addition adjoins the present limits of the City of Salina, be and the same is hereby added to, taken into, and made a part of the City of Salina, Kansas. Section 2. 'That that certain tract of unplatted land, which is described by metes and bounds as follows; Commencing at the inter- section of the center line, running north and south, of Section 18 Township 14 South, Range 2 west, with the south line of the public road known as Iron Avenue, such point being the Northwest corner of Lot 2 in Surveyor's Plat No. 34 of the north half of the northeast quarter of said Section 18; thence south along the center line of said Section 18 to its intersection with the centerline , extended, of Stapler Avenue; thence east along the center line, extended, of said Stapler Avenue to its intersection with the west line of lot 1 of Mt. Barbara Park Addition; thence north 235 feet,'more or less, west sixty feet, and north two hundred feet, more or less, along the west line of said Lot 1 Mt. Barbara Park Addition to the south line of said public road known as Iron Avenue thence westerly along the south line of said Iron Avenue, being the north line of said Lot 2 in Surveyor's Plat No. 34, to point of beginning; which tract does not exceed twenty acres in area and which is so situated that all of the north and westboundary lines thereof lie upon or touch the present boundary line of said City, and all of the east boundary- line oundaryline thereof lies upon or touches the boundary line of said city as established by Section 1 of this ordinance, said tract constituting e portion of said Lot 2.in Surveyor's Plat No. 34 -of the north half of the Northwest quarter of said Section 18, which portion of said lot is necessary to be added to said city for the purpose of making the boundary line thereof straight or harmonious, together with the west half of the public.road known as Iron Avenue, above described adjoining said tract, be and the same is hereby added to, taken into and', made part of the City of Salina, Kansas. Section 3. That that certain tract of land which is described by metes and bounds as follows: Commencing at the Northeast corner of Lot 6, in Mt. Barbara Park Addition; thence south along the east line of said addition to the Southwest corner of Lot 7 in said addition; thence east along a line parallel with and extended from the south line of said, addition 524.81 feet, more or less, to the east line of.Section 18, Town- ship 14 south, Range 2 west in Saline County, Kansas; thence north along the east line of said Section 18 to its intersection with the center of the public road known as Iron Avenue; thence west along the center line of said road to a point due north of the point of beginning; thence south to point of beginning; which tract does not exceed twenty acres in area and which is so situated that all of the north and east boundary lines . thereof lie upon or touch the present boundary -lines of the City of Salina, as heretofore established, and the east boundary line thereof lies upon or touches the boundary line of said city as established by Section 1 of this ordinance; and which said tract constitutes a part of the east quarter of the north half of the northeast quarter of said Section 18, and which is part of the private cemetery known as Mt. Calvary Cemetery, and which portion of said tract is necessary to be added to the City of Salina for the purpose of making the boundary line thereof straight or harmonious, together with the south half of the public road lying along the nortIg line of said tract, the west half of the public road along the east side of said tract, and the public road lying along the. west line of said tract, be and the same is hereby added to, taken into and made a part of the City of Salina, Kansas. Section 4. That that certain tract of unplatted land des- cribed by metes and bounds as follows: Commencing at a point 243 feet west and 20 feet north of the southeast corner of the southwest quarter Of Section 11 Township 14 south, Range 3 west in Saline County, Kansas; thence west 255 feet, more or less along the north line of the public road known as Pacific Avenue, to the southwest corner of a certain un - platted tract of land lying immediately east of Block 6 in. Episcopal Military Institute Addition; thence north along the east line of said addition 480 feet, more or less, to the center line of Harsh Avenue, as shown by the Plat of said Episcopal Military Institute Addition; thence east 255 feet, more or less, along the center line of Harsh Avenue, extended, to a point due north of place of beginning; thence south along the west line of Block 1 in Golden Belt Subdivision to the point of be- ginning; which said tract of unplatted land does not exceed twenty acres N in area, and which is so situated that all of the west and south boundar+ lines of said tract lie upon or touch the present boundary lines of said city as heretofore established, together with the north half of the public road, lying along the south line of said tract, be and the same is hereby added to, taken into, and made a part of the City of Salina, Kansas; Section 5. That Bl6ok No. 1 df Golden Belt Subdivision, a platted addition or subdivision in Saline County, Kansas, which is sub- divided into lots and blocks and according to the recorded plat thereof in the office of the Register of Deeds of Saline County, Kansas as shown in Plat Certificate Book No.. 1 at Page 194, and in Book E of Plats at page 61, the south boundary line of which lies upon or touches _the present boundary line of said city as heretofore established, and the west boundary line of which lies upon or touches the boundary line of said city as established by Section 4 of this ordinance, be and the same.is hereby added to, taken into and made a part of the City of Salina, Kansas, Section 6. That the corporate limits of the City of Salina, be and the same are hereby extended to include the territory added to, taken into and made parts of said pity by the provisions of the•.= preceeding sections of this ordinance; and that all land lying with- in the following described boundaries be and the same is hereby de- clared to be within the corporate.limits of the City of Salina, Kansas, and a -part of such city, and that such corporate limits be and the same are hereby defined as follows, to -wit: Commencing at the point of intersection of the center of Ninth Street with the center of Cloud Avenue, being the corner of Sections 230 24, 25 and 26, Township 14 south, Range%3 fdst of the 6th P. M:-. in Saline County, Kansas; thence west along the south line of said section 23 to the southwest corner of Evergreen Park Addition; thence north -along the west line of Evergreen Park Addition to the northwest corner of said.Addition, such point being in the south line of Claflin Avenue as shown on the plat of Pleasant View Addition.; Section 7. That all references in this ordinance to any addition or subdivision be deemed to refer to and that the same does refer to such addition or subdivision as originally platted and as the certificate of the same is recorded in the office of the Register of Deeds of Saline County, Kansas. R Section 8. That all ordinances or parts of ordinances in conflict with this ordinance be and the same are, in so far as they conflict with the provisions of this ordinance, repealed. Section 9. That if any section of this ordinance or any claut or any part of any such section shall be held unconstitutional or void for any reason, all other sections, clauses or parts of this ordinances shall remain in full force and effect irrespective of any such holding .or decision, it being the intention to adopt each section clause or part of this ordinance independently of any other section, clause or 'part thereof. Section 10. That this ordinance shall take effect and be in full force form and after its phblication once in the official city paper. That the corporate limits of the City of Salina, be and the same are hereby extended to include the territory added to, taken into and made parts of said City by the provisions of the preceeding sections of this ordinance; and that all land lying within the following described boundaries be and the same is hereby declared to be within the corporate limits of the Eity of Salina, Kansas, and a part of such city, and that such corporate limits be and the same are hereby defined as follows, to -wit: Commencing at the point of intersection of the center of Ninth Street with the center of Cloud Avenue, being the corner Lo Sections 23, 242 25 and 26, Township 14 south, Range 3 west of the 6th P. That all references in this ordinance to any addition or subdivision be deemed to refer to and that the same does refer to such addition or subdivision as originally platted and as the certifi- cate of the same is recorded in the office of the Register of Deeds of Saline County, Kansas. 1.1 4V Section S. That all ordinances or parts of ordinances in conflict with this ordinance be and the same are, in so far as they conflict with the provisions of this ordinance, repealed. Section 9. That if any section of this ordinance or any clause or any part of any such section shall be held unconstitutional or void for any reason, all other sections, clauses or parts of this ordinance shall remain in full force and effect irrespective of any such holding or decision, it being the intention to adopt each section, clause or part of this ordinance independently of any other section, clause or part thereof.
