3320 Waste Water TreatmentINANCE-110..-33 AN ORDINANCE confirming and ratifying a contract for the building and construction of a system of disposal works for the purification of the sewage of Salina.. Kansas, and providing for the issuance and sale of temporary notes to pay the cost thereof as the work progresses, pending the issuance and sale of bonds as.required by law. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas; Section 1. That the acceptance by the City of Salina of the proposal of Harry J. Taylor, doing business as H. j. Taylor Construction Company, hereinafter referred to as the "Contractor" which is hereby found and determined to be the lowest and best bid for such work, and the awarding of the contract by the Board of Commissioners of said City to said Contractor, on December 15th, 1926, for the building and construction of a system of disposal works for the purification of the sewage.of the City of Salina, Kansas, in accordance with the provisions of Ordinance No. 3312 of said City adopted on November 23rd, 1926, at and for the contract price of °139,662.55, be and the same are hereby ratified and confirmed, said proposal being within the estimated cost of said improvements as shown by the sworn estimate of the consulting engineers, Haskins and Crawford, filed in the office of the City Clerk of December 6tho 1926 and which estimate is hereby referred to and made a part of this ordinance. Soetion 2. That said system of disposal works shall be built and constructed in accordance with the plans and specifications there- for prepared by said consulting engineers, on file in the office of, the City Clerk, and in accordance with the proposal of said contractor and under the terms of said contract entered into between this city and said contractor on December 15th, 1926, which said plans, speci- fications, proposal and contract are hereby referred to and made parts of this ordinance, said work to be done and the material, equipment, appliances and appurtenances necessary and required in connection there- with to be performed and furnished in accordance with said plans and specifications. . Section 3. That the performance bond in the sum of $86,820.55 and the statutory bond in the sum of $139.662.55 with said contractor as principal and Fidelity and Deposit Company of Maryland as surety, each executed and dated December 15th, 1926, furnished in accordance with the provisions of said contract, be and the -same are hereby approved. Section 4. 'That temporary notes, signed by the Mayor and attested by the City Clerk, be issued from time to time as the work progresses, in the manner and form as required by law, the total amount thereof not to exceed the contract price for such work, such notes to bear interest at not.to exceed 6 per cent per annum and to mature not later than October 1st, 1927 and to be issued in such amounts and at such times as money for the payment of the cost of such plant may be required, such notes to be sold in the manner provided by law for the sale of bonds or at private sale at not less than par and accrued interest, the proceeds to be placed in the City Treasury and applied only in payment of the.cost of such sewage disposal plant; said notes to be redeemed and cancelled before or at the time permanent bonds are issued in lieu thereof. Section 5. This ordinance shall take effect and be in force from and after its publication in the official city paper.
