ORDINANCE NO. 3319

AN ORDINANCE relating to and apportioning and levying special assessments
on certain lots and pieces of ground in the City of Salina, Kansas
to pay the cost of building and constructing a laterial storm sewer in
laterdl storm sewer district Number 4 in said City, and relating
to and providing for the collection and payment of such assess-
ments.
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. For the purpose of paying the cost of building
land constructing lateral storm sewer in lateral storm sewer district
INumber 4 in the City of Salina, Kansas, beginning at a point on the
west line of Section 17, Township 14, Range Two, 215 feet south of the
Northwest corner of said Section; thence south along said section line
Ito its intersection with the southerly line, produced, of Lot 5, Block
2, Country Club Heights; thence easterly along the southerly line of
said lot, and said line produced, to the center line .of Overhill Road;
thence southerly along the center of said Road to its intersection with
the southerly line, produced, of Lot 4, Block 3, Country Club Heights;
thence easterly along the southerly line of said lot to the souther -
easterly corner of said lot; thence northerly along the easterly line
of Lots 5, 4, 3 and 2 in said Block 3, to the northeasterly corner of
said Lot 2; thence northeasterly along the southeasterly line of Lot 1,
in said Block 3, and said line produced, to the center line of Green-
way Road; thence northwesterly along the center of said Road to its
intersection with the southeasterly line, produced, of Lot 1, Block 4,
Country Club Heights; thence northeasterly along the southeasterly line
of said Lot 1 to the southwesterly corner of Lot 16 inlaid Block 4; thence
southeasterly along the southerly lines of Lots 16 and 15, and the
southwesterly lines of Lots 14 and 13 in said Block 4 tothe southeasterly
line of said lot 13; thence northeasterly along the southeasterly line
said lot 13, and said line produced, to its intersection with the
center line of Fairdale Road; thence southeasterly along the center of
said Road to its intersection with the southeasterly line, produced, of
Lot 1, Block 5, Country Club Heights; thence easterly along the southerly
lines of Lots 1, 19, 18 and 17 in said Block 5 to the southeasterly corner
of said Lot 17; thence northerly along the easterly line of said Lot
17, and said line produced, to the center line of Crestview Drive; thence
westerly along the center of Crestview Drive to its intersection with
the center line of West Park Lane; thence northwesterly along the center
of West Park Lane to its intersection with the northwesterly line, pro
uced, of Lot 4, Block 1,.',�ountry Club Heights; thence southwesterly
long said line of Lot 4 to the southeasterly corner of Lot 5 in said
Block 1; thence westerly along the southerly line of Lots 5 and 6 in said
Block 1, and said line produced, to place of 'beginning; the same con-

taining Lots 12 2, 3 and 4 in Block 1; Lots 1, 2, 3 and 4 in Blockl;
Lots 1, 21 3, 4 and 5 in Block 2; Lots 1, 21 3 and 4 in Block 3; Lots
1, 13, 14, 15 and 16 in Block 4; and Lots 1, 17, 18 and 19 in Block 5;
all in said Country Club Heights, an addition in said City, there are
hereby levied and assessed on the property liable therefor, being all
of the lots and pieces of ground situated in and comprising said
lateral storm sewer district No. 4 heretofore provided for and established
by Ordinance No. 3303, which are specially benefitted by said sewer
according to the appraised value of such lots and pieces of ground with-
out regard to the buildings or improvements thereon, special assessments
covering the cost of such work and improvements; said.special assess-
ments being based on the special valuation or appraisement of said
lots and pieces of ground heretofore made by three disinterested
appraisers appointed by the_ Board of Commissioners of the City of
Salina, Kansas, which said appraisement is hereby referred to and
made a part of this ordinance, and the several amounts levied,
apportioned and assessed against each of said lots and pieces of _
ground for the purpose aforesaid are hereby found and determined to
be as follows:

Section 2. Said amounts levied, apportioned and assessed
aforesaid, shall be due and collectible in ten equal installments, the
first becoming due with the tazes levied for the year 1927 and one of
said installments falling due each and every year thereafter until all
are paid, and all to be collected with interest as in this ordinance pro-
vided; PROVIDED, that the owner of any piece of property liable for any
such assessment may redeem his property from such liabilitg by paying in-
to the City Treasury the entire amount chargeable against the same, as in
this ordinance designated, at any time within thirty days after the pub-
lication of this ordinance and before the issuance of the bonds of
said City in payment of the balance of said improvements, and his
property so paid on shall not thereafter be liable for any further
assessments.for the cost of said improvements, nor for any part of
said bonds.
Section 3. There is hereby further levied and assessed
against each lot and pace of ground described in this ordinance
five. per cent interest per annum on all of said installments there-
in mentioned from the date of the bonds, which may be issued at the
end of thirty days, as specified in the preceding section hereof,
as by law provided to the time of collection of the last installment,
as provided by law, which said interest shall be collected annually
at the same time and in the same manner as said installments are
collected; and after the taking effect.of this ordinance it shall
be the duty of the City Clerk of said City to annually at the same
time other taxes are certified, and until all of said assessments
so apportioned and levied herein have been certified, to certify to
the County Clerk of Saline County, Kansas, a full list of all pro-
perty liable to assessment and taxation for such work and improve-
ments, except such property on which the spcial assessments aforesaid
have been paid in full as hereinbefore provided, together with the
respective amounts due on each of such lots and pieces of ground,
which amounts shall include the annual installments of such special
assessments together with the interest for one year at the rate of
five per cent per annum, on all unpaid balances of such assessments
at the beginning of each such year as aforesaid, and such amounts
so certified as herein provided shall be placed upon the tax roll by
the County Clerk of Saline County, Kansas, and collected as all other
taxes are collected.
Section 4. This ordinance shall take effect and be in
full force from and after its publication once in the official city
paper.

An Ordinance relating to and apportioning and levying special
assessments on certain lots and pieces of ground in the
City of Salina, Kansas, to pay the cost of building and
constructing a lateral storm sewer in lateral storm
sewer district Number 4 in said City, and relating to and
providing for the collection and payment of such assess-
ments.
BE IT ORDAINED by the Board of Commissioners of the.City of
Salina, Kansas:
Section 1. For the purpose of paying the cost of build-
ing and constructing lateral storm sewer in lateral storm sewer
district Number 4 in the City of Salina, Kansas, beginning at

thence easterly along the southerly line of said lot, and said

18 and 19 in Block 5; all in said Country Club Heights, an additim
in said.City, there are hereby levied and assessed on the property

Section 2. Said amounts levied, apportioned and
assessed aforesaid, shall be due and collectible in ten equal
installments, the first becoming due with the taxes levied
for the year 1927 and one of said installments falling due each
