3312 Waste Water TreatmentAN ORDINANCE providing for the building and construction of a system
of disposal works for the purification of the sewage of Salina,
Kansas; providing for the awarding of a contract or contracts
for such construction; and for the issuance of bonds in pay -
ment of the cost and expense thereof.
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. That a system of disposal works for the purification
of the sewage of the City of Salina, be and the same is hereby found
and declared to be necessary, and that the same, including the necessary
pumping station, force main, outfall sewer, sewage treatment plant,
diversion manhole and inlet sewer, pumps, screens, piping and valves
in pumping station, storage tanks and digestion tanks, with mechanism
for same, sludge drying beds, sewers, and including all excavation and
embankment, and all other materials, equipment appliances and appurtenance:
necessary or required in connection therewith, be built and constructed
as hereafter provided for.
Section 2. That said system of disposal works shall be built
and constructed in accordance with the plans and specifications there-
for prepared by Haskins and Crawford, Consulting Civil Engineers of
Kansas City, Missouri, who are hereby selected as consulting engineers
for the City of Salina for such purpose, which saidl plans and specifi-
cations shall be filed in the office of the City Clerk on or before
the 6th day of December, 1926, for the approval of the Board of Com-
missioners, and on or before said date said engineers shall submit to
the Board of Commissioners a detailed estimate, under oath, of the cost

thereof. That after said plans and specifications and said detailed
estimate have been filed as aforesaid, sealed proposals for the buildings
and construction of said system of disposal works shall be invited by
advertisement, published by the City Clerk in the official city paper,
for at least three consecttive days, and at the time fixed in said
notice for the receipt of bids, the Board of Commissioners shall let
said work by contract either as a whole or separately for the several
portions of said work, to the lowest responsible bidder or bidders,
if there by any whose bid or bids do not exceed such estimate, pro-
vided however that the Board of Commissioners shall reserve the right
to reject any and all bids, and provided further that if not responsible
bid or bids shall be received within the estimate, the Board of
Commissioners shall have power to make such improvements or any part
thereof within the estimated cost thereof, and shall have the further
power to purchase the necessary tools, apparatus, materials, and employ
the .necessary labor, and construct the necessary plant or plants for
the purpose of carrying into effect the provisions of this ordinance
as provided by law.
Section 3. That the main disposal plant of the system here-
in provided for shall be constructed on a tract of land, approxi-
mately seven acres, more or less, in area, lying in the Southwest
Quarter of the North Half of the Northwest Quarter of Section S,
Township 14, South, Range 2 West, in Saline County, Kansas; the
main pumping plant shall be constructed approximately at or near
the present outlet of what is now known as the Ash Street sewer,
which empties into the Smoky Hill River at or near the intersection
of Ash Street and Riverside Drive; and the force main connecting
the disposal plant and the pumping plant shall be constructed
approximately along a line commencing at said pumping plant and
running thence northwesterly in Riverside Drive to Ohio Street;
thence north in Ohio Street to the Missouri Pacific Railroad
right-of-way; thence easterly along the Missouri Pacific Railroad
right -of way to the site of said main disposal plant.
Section 4. That after the contract or contracts for the
construction of said system of sewage disposal worky, or hereinabove
provided for, shall have been awarded, and the cost and expense of
such construction shall have been ascertained, the Board of Com-
missioners shall issue improvement bonds of the City of Salina
for the purpose of paying the cost and expense thereof, which said
bonds shall be issued as provided by law and shall bear interest
at not to exceed 44 percent per annum, and shall be issued to
mature in installments of approximately equal amounts each year
for not to exceed twenty (20) years, and that when issued such
bonds .be sold in the manner provided by law or delivered to the
contractor or contractors constructing such improvements, in pro-
portion to the amounts due such contractor or contractors, in pay-
ment of the amount due them or any part of such bonds may be so
used at the option of the Board of Commissioners, but such bonds
shall not be sold or delivered to any such person for less than
the par value thereof nor in a greater sum or amount than the
whole amount due to any such persons.
Section 5. That the cost and expense of building said system of
sewage disposal works shall be born by the City as a whole, and for
the purpose of paying the bonds hereinabove provided for, and the in-
terest thereon as the same becomes due and payable, the Board of Com-
missioners shall levy a general taxon all of the taxable property in
the City of Salina in the time and manner provided by law.
Section 6. This ordinance shall take effect and be in force from
and after its publication in the official city paper.
