AN ORDINANCE specifying and selecting material and letting a con-
tract for the construction of a lateral storm sewer in and for
the purpose of draining, lateral storm sewer district No. 4 in
conformity with the provisions of Ordinance No. 3303 of the City
of Salina.
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. That it is hereby determined that a lateral storm
sewer be constructed in, and for the purpose of draining, lateral
storm sewer district No. 4 as defined by ordinance No. 3303 of City
of Saliba, said storm sewer to be constructed of vitrified sewer
pipe, with pre -formed asphaltic joints, in accordance with the plans
and specifications of the City Engineer now on file in the office
of City Clerk, along the following course and with the following
materials to -wit: Beginning at a manhole to be constructed near
the center of the park lying between west Park Lane and East Park
Lane, as shown on the City Engineer's plans, thence in a north-
easterly_direction as a 15 inch vitrified pipe sewer to an outlet
at a point north of the public road lying along the north side
of said Park, so as to empty into the natural water course running
northerly from said point, as shown on said Engineer's plans;
together with inlet No. 1 in Crestview Drive and inlet No. 2 in
West Park Drive as shown on said plans, and inlet connections
consisting of 12 inch vitrified pipe sewer connecting said inlets
No. 1 and No. 2 with the manhole first above described and together
with all other necessary inlets, inlet connections, manholes, head-
walls and other appurtenances as shown on plans and specifications
of said Engineer, on file as aforesaid, which are hereby made a part
of this ordinance, and including all materials and all labor necessary
for the construction thereof and for all trenching and backfilling
necessary in connection therewith.
Section 2. That all excavating and filling and all of the labor
performed or all material furnished for such work shall be in strict
conformity to and in compliance with the plans and specifications
therefor prepared by the City Engineer and now on file with the
City Clerk, which said plans and specifications are hereby incorp-
orated and are made a part hereof in all respects as fully and com-
pletely as though written out at length herein, which said plans and
specifications are hereby adopted as and for the plans and specifi-
cations for such work and improvements.
Section 3. That a contract is hereby awarded to C. T. Snyder
for the construction of the lateral storm sewer described in Section 1
of this ordinance, for the labor actually performed and materials
actually furnished at the following price; For 15 inch vitrified pipe sewer
laid complete in trench, per lineal foot $1.65; For 12 inch vitrified
pipe sewer laid complete in trench, per lineal foot $1.45, the above
prices to include trenching and back filling, including setting of trench
and removal
of excess materials; Standard manholes
complete as
per plans,
each s60;
Standard inlets, complete as per plans,
each $35.00;
Plain
1, 2, 4, concrete in head walls, in place, per cubic yard, $30.00; hock
excavation per cubic yeard x$'6.00. All of said work to be paid for accord- `
ing to the measurements made by City Engineer of the City of Salina. It
is hereby found and determined that the price to be paid for the improve-
ments as aforesaid are less than the price of each and all of said
improvements as shown by the sworn estimate of the City Engineer now on
file with the City Clerk.
Section 4. Such contract is awardod upon the express condition
that such work and improvements shall be done in strict accordance to
and in compliance with said plans and specifications of City Engineer
therefor, and upon the express conditions among others, that the person
to whom said contract is awarded shall furnish to the City of Salina
a Surety Bond in the approximate sum of the cost of such improvements,
guaranteeing the prompt, proper and workmanlike construction thereof,
together with a Surety Bond guaranteeing the storm sewer so constructed
against all defects in materials or workmanship for a period -of one
year from the date of the final acceptance thereof by the city; and
together with a Surety Bond running to the State of Kansas in an amount
approximately equal to the contract price of said improvements, con-
ditioned that said person shall pay all indebtedness, for labot and
material furnished in making the improvements herein provided for.
Section 5. That the Mayor of the City of Salina is hereby
authorized to make and enter into on behalf of said city all written
agreements necessary in order to secure the construction of the im-
provements herein provided for.
Section 6. This ordinance shall take effect and be in full
force from and after its publication once in the official city paper.
