3306 Taxicabs04 35o69 AN ORDINANCE relating to taxicabs. BE IT ORDAINED by'the Board of Commissioners of the City of Salina, Kansas: Section 1. That no taxicab, as defined by Section One of Ordinance No. 2948, now or hereafter licensed, according to the provisions of Ordinance No. 1552, as,amended by Ordinances No. 1616, 1911, 2499, and 2954, for the carrying of passengers in the City of Salina, shall be permitted to stand when unemployed at any place on the public streets of said City, except that space for one taxicab shall be reserved directly in front of the place of business (ground floor) owned, leased or occupied .by the owner of such taxicab; and in addition thereto, the Chief of Police, as provided in Section 16 of Ordinance No. 1552, as amended by Section One.of Ordinance 2954, shall designate a space for not to exceed one taxicab in front of or adjacent to each or any hotel, (as defined in Section 36-101, R. S. 1923) in the City of Salina, Kansas, and the Board of Commissioners of said City may designate such additiio to as they may deem necessary for the convenience o f,.tLe dub i ., not to exceed space for more than one taxicab o�°n one owner on the same side of the street in any one block) .�stands may be occupied exclusively by the taxicab or taxicabs operated by any person, firm or corporation who shall secure from the owner and ground floor occupant or lessee of the hotel or other premises adjacent to which such stand is located, written permission for maintaining such stand and written request to the Chief of Police, or to the Board of Commissioners, as the case may be, to designate such stand, but no stands shall be designated or located on Santa Fe Avenue between Ash Street and walnut Street or on Iron Avenue between Fifth Street and Seventh Street, and any space in any street designated as such stand by the Board of Com- missioners may be by such Board vacated as such stand and restored to the use of the general public on 10 days notice in writing de- livered to the office or residence of the owner of the taxicabs affected thereby. Section 2. SECTION 3. Two or more owners or operators of taxicabs associated to- gether in any partnership or joint enterprise or doing business under a joint or common name or from the same offices or headquarters shall for the purposes of this ordinance be, -deemed and considered to be a single firm or owner. I I I - SECTION 4. This ordinance shall, not be deemed to repeal any other ordi- nance of the City of Salina, except in so far au the same may be in spe- cific conflict with 'this ordinance, in which case this ordinance shall govern, but shall be supplemental to the ordinances mentioned in Section One of this ordinance. SECTION 5. Any person who shall violate any of the provisions of this ordinance, or who shall permit or direct the violation thereof by any other person, or who shall stand or permit or direct the standing of any taxicab on any public street in the City of Salina, Kansas contrary to the provisions of this ordinance or who shall fail or refuse to obtain the direction of the Chief of Police in connection with the sta.nd- ing of any taxicabs, as required by this ordinance, or any other ordinance to which this ordinance is supplemental, or who shall mark or use any space for standing a taxicab except as authorized by this ordinance,shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in any sum of not less than X5:00 and not more than $25.00 for each offense.
