AN ORDINANCE providing for the submission to the legal voters of
the City of Salina, Kansas, at the gneral election
to be held on November 2nd, 1926, the question•of
authorizing the sale of certain real estate belong-
ing to the City of Salina, Kansas.
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. That at the general election to be held in the
City of Salina, Kansas on November 2nd, 1926, there be submitted
to the legal voters of said city the following question: "Shall
the City of Salina sell the following described real estate owned
by said city, to -wit: Lot 124 and the north six and one-half inches
of Lot 126 on Fifth Street in City of Salina with appurtenances
thereto, for not less than 47,000.00?"
Section 2. That the Mayor of said city shall give notice
of the submission of such proposition at said general election
by a proclamation to be published once each week for three con-
secutive weeks, the first publication not less than twenty-one
days prior to such election in the Salina Journal, a daily news-
paper published in said city, such publication to be on Wednesday
or Thrusday of each of three consecutive weeks of such publication,
which notice or proclamation shall set forth the time and place of
holding such election and shall state the proposition to be voted
upon.
Section 3. That the polls shall be open and such election
held at the several voting precincts in City of Salina hereafter
designated for the holding of said general election and between
the hours designated for the holding of said general election,
and that the judges and clerks of the election hereafter appointed
to act as judges and clerks at said general election shall act as
judges and clerks at the election held on the proposition provided
for in Section 1 of this ordinance and their qualifications as
judges and clerks for such general election shall be deemed to
qualify them for the duties as such judges and clerks at the
election on said proposition so submitted and they shall canvass
and certify the votes on said question and make due returns thereof
to the City Clerk of the City of Salina in the same manner as now
required and provided by law in the case of general city elections
so far as such provisions shall be applicable.
Section 4. That the qualification of electors voting on such
proposition shall be the.same as required of electors Voting at theh
general:.eleetion to be held on the date mentioned in Section 1 thereof.
Section 5. That the City Clerk shall prior to said election,
within the time and in the manner required by law, prepare and deliver
to the judges of election at each voring precinct the ballots to be used
in submitting the question hereinabove provided for, which shall be in
the following form, as provided for by Section 25-605 Revised Statutes
1923. Across the top of said ballot shall be printed the following
words "Shall the following be adopted?" followed by the proposition
provided for in Section 1 in this ordinance, printed in Brevier lower-
case type, opposite and after,which shall be printed two squares, pre-
ceeding the upper one which shall be printed the word "yes" and pre-
ceeding the lower one shall be printed the word "no". Across the
entire width of said ballot and at the top thereof shall be printed
in pica type the following instructions; "To vote in favor of the
question submitted upon this ballot, make a cross (x) mark in the
square after the word "yes!'; to,evote;against it make a similar mark
in the square after the word "no". The City Clerk shall provide a
separate ballot box at each voting place for the reception of such
ballots.
Section 6. When the judges.and clerks of election shall
have completed the canvass and counting of votes cast upon such
proposition at such election they shall return and deliver to the
City Clerk all the ballots received by them on such proposition at
said election, with their certificate showing the result of said
election and the City Clerk shall on Friday following such election
present the same to the Board of Commissioners of said City who shall
meet on said date as a Board of Canvassers, to canvass the vote cast
on said proposition at such election. After making a canvass of the
vote so cast they shall certify the result of such canvass, which
certificate shall be spread upon the minutes of said meeting and shall
be part of the records of the proceedings of said Board of Commissioners.
If at such special election, as shown by the certificate of the canvass
of the votes cast thereat as herein provided for, a majority of the
legal voters voting thereon at such election shall be found to have
voted in favor of. such proposition, the Board of Commissioners of said
city shall thereupon have authority to see, and to convey by general
or special warranty deed to the purchaser thereof, for not less than

$7,000.00 in cash to be paid to the City of Salina upon the
execution and delivery of such conveyance, the real estate
described in Section 1 of this ordinance, and the Mayor and
City Clerk of said city are hereby authorized, upon compliance
with all the provisions of this ordinance, to execute, attest
acknowledge and deliver such conveyance on behalf of said city.
Section 7. .This ordinance shall take effect and be in
force from and after its publication once in the official city
paper.
