AN ORDINANCE relating to and apportioning and levying special assess-
ments on certain lots and pieces of ground in the City of Salina,
Kansas, to pay the cost of building and constructing a lateral
storm sewer in lateral storm sewer district No. 2 in said City,
and relating to an providing for the collection and payment of
such assessments.
BE IT ORDAINED by the Boand of Commissioners of the City of Salina
Kansas:
Section 1. For the purpose of paying the cost of building and
constructing lateral storm sewer in lateral storm sewer district No. 2
in the City of Salina, Kansas, beginning at the point of intersection
of the center line of the alley between Ash Street and Park Street with
the center line of the right-of-way of the Missouri Pacific Railway;
thence southwesterly and south along the center line of said right-
of-way to its intersection with the center line of the alley between
Ash Street and State Street; thence west along the center line of said
alley to its intersection with the center line of the alley parallel
to and situate 120 feet west of Olive Street; then north along the
center line of the last named alley to its intersection with the alley
between Ash Street and Park Street; thence east along the center line
of the last named alley to the place of beginning, there are hereby
levied and assessed on the property liable therefor, being all of the 1
lots and pieces of ground situate in and comprising said lateral storm
sewer district Ido. 2 heretofore provided for and established by Ordinance
No. 3246, which are specially benefited by said sewer according to the
appraised value of such lots and pieces of ground without regard to the
buildings or improvements thereon, special assessments covering the cost
of such work and improvements; said special assessments being based on
the special valuation or appraisement of said lots and pieces of ground
heretofore made by three disinterested appraisers appointed by the Board
of Commissioners of the City of Salina, Kansas, which said appraisments
is hereby referred to and made a part of this ordinance, and the several
amounts levied, apportioned and assessed against each of said lots and.
pieces of ground for the purpose aforesaid are hereby found and determined
to be as follows:

Section 2. Said amounts levied, apportioned and assessed
aforesaid, shall be due and collectible in 10 equal installments,
the first becoming due with the taxes levied for the year 1926
and one of sa-id installments falling due each and every year there-
after until a1-1- are paid, and all to be collected with interest as
in this ordinance provided; PROVIDED, that the owner of any piece
of property liable for any such assessment may redeem his property
from such liability by paying into the City Treaaury the entire
amount chargeable against the same, as in this ordinance designated
at any time within thirty days after the publication of this ordinance
and before the issuance of the bonds of said City in payment of the
balance of said improvements, and his property so paid on shall not
thereafter be liable for any further assessments for the cost of
said improvements, nor for any part of said bonds.
Section 3. There is hereby further levied and assessed
against each lot and piece of ground described in this ordinance
42 per cent interest per annum on all of said installments there-
in mentioned from the date of the bonds, which may be issued at
the end of.thirty days, as specified in the preceding section
hereof, as by law provided to the time of collection of the last
installment, as provided by-laws which said interest shall be
collected annually -at the same time and in the same manner as said
installments are collected} and after the taking effect of this
ordinance it shall be the duty of the City Clerk of said City to
annually at the same time other taxes are certified, and until all

of said assessments so apportioned and levied herein have been
certified, to certify to the County Clerk of Saline County, Kansas,
a full list of all property liable to assessment and taxation for
such work and improvements, except such property on which the
special assessments aforesaid have been paid in full as herein-
before provided, together with the respective amounts due on each
of such lots and pieces of ground, which amounts shall include.
the annual installments of such special assessments together with
the interest of one year at the rate of 42 per cent per annum,
on all unpaid balances of such assessments at the beginning of
each5 uch year as aforesaid, and such amounts so certified as
herein provided shall be placed upon the tax roll by the County
Clerk of Saline County, Kansas, and collected as all other taxes
are collected.
Section 4. This ordinance shall take effect and be in full
force from and after its publication once in the official City
paper.

AN ORDINANCE relating to and apportioning and levying special
