Street to the north ne o orrison Avenue; and for the excavating, grading and surfacing with sand clay Third Street from the south line of Iron Avenue a,uth to the mo y H River, all in the City of Salina, Kansas. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That it is hereby determined that Ash Street in the City of Salina, Kansas from the west line of the right-pf-way of the Missouri Pacific Railway Company to the east line of Olive Street shall be gravelled with artificial sand -clay surface. Such graveling shall be seven (7) inches deep, and shall be fort* (40) feet in width, excluding curb and gutter. Section 2. That it is hereby determined that Adi Street in the City of Salina, Kansas from the west line of the fight -of -way of the Missouri Pacific Railway Company to the east line of Olive Street shall be curbed and guttered w1th one piece combination cement curb and gutter.: Said combined curb and gutter shall be comprised of a curb six (6) inches thick at top, seven (7) inches thick at bottm and sixteen inches deep, with gutter 24 inches wide, 6 inches thick at throat and 6 inches thick next to pavement. Section 3. That it is hereby determined that College Avenue -in the City of Salina, from the south line of South Street to the north line of Morrison Avenue in sand City shall be gravelled with artificial sand -clay surface. Such graveling shall be 7 inches deep, and shall be 30 feet in widt excluding curb and giutter. Section 4. That it is hereby determined that College Avenue in the City of Salina, from the south line of South Street to the north line of Morrison Avenue in said City shall be curbed with Portland Cement Concrete surb, six inches at top, seven inches thick at bottom and sixteen inches deep. Section b. That it is hereby determined that Ellsworth Avenue in the City of Salina, Kansas from -the east line of Santa Fe Avenue to the west line of Osborne Street in said City shall be gravelled with artificial sand -clay surface. Such graveling shall be 7 inches deepip and shall be 30 feet in width, excluding curb and gutter. Section 6. That it is hereby determined that Ellsworth Avenue in the City of Salina, Kansas from the east line of Santa Fe Avenue to the west line of Osborne Street in said City shall be curbedwith Portland Cememt Concrete Curb, six inches at top•, seven inches thick at bottom and sixteen inches deep. Section 7. That it is hereby determined that Third Street in the City of Salina, Kansas from the south line of Iron Avenue south to the Smoky Hill River in said City shall be gravelled with artificial sand -clay surface. Such graveling shall be 7 inches deep, and shall ba 30 feet in width, excluding curb and gutter. Section 8. That it is hereby determined that Baker Street in the City of Salina, Kansas, from the south line of South Street to the north line of Morrison Avenue in said City shall be paved with vibro-lithic concrete pavement. Such surface shall be six (6) inches deep, and shall be 23 feet in width excluding curb and gutter. Section 9. All excavating, filling and folling necessary for the proper construction' of such improvements shall be done and all of such improvements shall be made in strict conformity to and in compliane with the plans and specifications heretofore made by the City Engineer of Salina, Kansas, and now on file with the City Clerk of said City, which plans and.specifications are hereby incorporated in and made a part hereof in all respects asfully and completely as.though written out at.length herein, which said plans and specifications are hereby adopted as and for the plans and.speeifieations of such work and im- provements. Section 10. That a contract is hereby awarded to'L. W. hexroad for the paving with.vibroiithic concrete pavement; for the surfacing with sand clay, and for curbing, guttering, excavating and filling.the above mentioned' streets in the limits afersaid with the materials hereinbefore specified, for the labor actually.performed and the materials actually furnished at the following prices: Bor`Paving $2.23 per square yard; for surfacing with sand clay 44 per square yard; for excavating and grading 88� imr cubic yard; for Portland Cement Concrete curb and•gutter870 per linear foot; for Portland Cement Concrete curb, 87¢,per linear foot.' All of said work to be paid for= according to measurement made by the City Engineer of the City -of Salina. It is hereby found and determined that the prices to be paid for the improvements as aforesaid are less than the prices of'each and all of said improvements as ehowh by the sworn estimates of the City Engineer now on file with the City Clerk of the City of Salina, Kansas. - Section 11. Such contract is awarded upon,the a xpress condition that such work and improvements shall be;done,in strict accordance and in compliance with the plans and specifications of the City Engineer therefor, which plans and specifications are hereby made a part ofthis ordinance and of the contract awarded, and upon J further.conditions among others that the person to whom said contract is awarded shall furnish to the City of Salina a surety bond in the'approx- inate sum of the cost of such improvements, guaranteeing the prompt, proper and workmanlike construction of all the same, together with a surety.company bond guaranteeing such cubb and gutter against all defects in material and workmanship for a period of tWo (2) years from the date of its completion and acceptance by said City; and upon a futrther condition that thetper- son to whom said contract is awarded shall furnish to the City of Salina a surety company bond guaranteeing such,pavement against all defects in materi and workmanship for a period of five (5) years from the date of its complet- ion and acceptance by said City, together with a good and sufficient surety company bond running to the State of Kansas in an amount approximately equal to the contract price of said improvements and conditioned that said L. W. nexroad shall pay all indebtedness, for labor and material fur- nished in making the improvements herein provided -for. Section 12. The Board of Commissioners of the City of Salina are hereby'authorized to make and enter into on behalf of said City all written agreements necessary in order to secure the construction of the improvements herein provided for. All excavating, filling and rol said City Such sur - feet in width necessary for the proper construction of such improvements shall be done and all of such improvements shall be made in strict conformity to and in compliance with the plans and specifications heretofore made by the City Engineer of Salina, Kansas, and nsw on file with the City Clerk of said City, which plans and specifications are hereby incorporated in and made a part hereof in all respects as fully and completely as though written out at length herein, which said plans and specifications are hereby adopted as and for the plans and specifications of such work and improvements. Section 10. That a contract is hereby awarded to L. W. Rexroad for the paving with vibrolithic concrete pavement; for the surfacing with sand clay, and for curbing, guttering, exca- vating and filling the above mentioned streets in the limits aforesaid with the materials hereinbefore specified, for the labor actually performed and the materials actually furnished at the following prices: For paving 02.23 per square yard; For surfacing with sand clay 43� per square yard; For excavating and grading 80¢ per cubic yard,; for Portland Cement Concrete P&,.i:4a., � C?.,� Cv—v,� Pu,,.b . It is hereby found and determined that the prices to be paid for the improvements as aforesaid are less than the prices of each and all of said improvements as shown by the sworn estimates of the City .Engineer now on file with the City Clerk of the City of Salina, Kansas. Section 11. Such contract is awarded upon the express condition that such work and improvements shall be done in strict accordance and in compliance with the plans and specifications of the City Engineer therefor, which plans and specifications are hereby made a part of this ordinance and of the contract awarded, and upon further conditions among others that the person to whom said contract is awarded shall furnish to the City of Salina a surety bond in the approximate sum of the cost of such improvements, guaranteeing the prompt, proper and workmanlike construction of all the same, together with a surety company bond guaranteeing such curb and gutter against all defects in material and work- manship for a period of two (2) years from the date of its com- pletion and acceptance by said City; and upon a further condition that that the person to whom said contract is awarded shall Varnish to the City of Salina a surety company bond guaranteeing such pavement against all defects in material and workmanship for a period of five (5) years from the date of its completion and acceptance by said City, together with a good and sufficient surety company bond running to the State of Kansas in an amount approximately equal to the contract price of said improvements and conditioned that said L. W. Rexroad shall pay all indebtedness, for labor and material furnished in making the improvements herein provided for. Section 12. The Board of Commissioners of the City of Salina are hereby authorized to make and enter into on behalf of said City all written agreements necessary in order to secure the construction of the improvements herein provided for. Section 13. This ordinance shall take effect and be in full force from and after its publication once in the official City paper. Introduced for first reading, June 14th, 1926.
