3255 License Tax Billiard TablesAN ORDINANCE fixing a, license tax on billiard arYd pool tables, providing for the issuing of licenses and the conditions thereof, regulating pool and billiard halls, limiting the number thereof, provid- ing penalties for the violating thereof, and repealing Ordinance No. 2018. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: eetion 1. It shall be unlawful for any person or persons to have, keep or ma tain, for hire or profit in any place in the Cdtty of Salina, any billiard pool tables, without first securing a license therefor as in this ordina a pro`vi'ded, and paying a license tax on all such tables in the following am nts: For the first table, $25.00; for the second table, $15,00; for each ditional table $10.00. Such lienace when issued shall be for a period of x months, and shall expire on the last day of. June or Lecember next after a same is issued, and shall'non-assignagle and non- transferrable; provide that if any such license shall be issued within three months prior to t last day of June or December, the license tax for such remaining period hall be one-half of the amounts above specified. Section 2. An erson or persons desiring a license under this ordinance shall make applica on therefor in writing, over his or their 'signature, to the Board of Co issioners. Such application shall state the number of billiard and pool tab s to be set up, kept and used; the location of the room or rooms in which sue tables are to -be set up and used and shall contain a certificate of at, east two reputable citizens of said city as to the character of the appl cant or applicants and their recommend- ation -that such license be granted, Section 3: Accompanyint s\haication, and before any license is issued, such applicant shall deposite City Clerk a bond running to $he4 _(City of Salina, in the penal sum $500.00., with a corporate surety authorized to do business. in thef Kansas, conditioned that no intoxicating liquors, cigarettes, ortte papers, shall be sold cr kept for sale or free distribution, and intoxicating liquor shall be permitted to be used in or about thes esignated in such applicat- ion; that sikeh applic"t shall keep an hou e, will not permit any person under nineteen years:of age to pilli ds or pool on said premises, or permit any minors to loiter or congregate in or about such place, and will not permit any gambling in or about sa premises, and will in all respects satisfactorily observe all of the provis ns and conditions of this ordinance and all other ordinances of the City of alina,.relating to the business for which such license is asked. Section 4. It shall be unlawful for any person or persons to keep open\�r cause to be kept open any billiard or pool hall,'bowling alley, or an other place where billiard or pool tables or other gaming tables devices are kept for pay on the first day of the week, eomm6nly nown as Sunday, or between the hours of 11 P. M. and 6 A. M. or permit y game to be played therein on 'Sunday or between such hours of 11 P. M. `4nd 6 A. M. Section \�. It shall be unlawful for the keeper of any place described in th* preceding section hereof to permit or allow any person under the 'age of nineteen years to play at or take part in any game in any sal" place, or to permit or allow any minors to loiter or congregate in or. about any such place. Section 7. It 11 be unlawful for the proprietor or manager of any pool or billiar 11 to knowingly permit the use of profane or indecent languate or. permit any riotous or disorderly conduct in such places. Section 8. Any phson or persons who shall violate any of the provisions of this ord ante shall be deemed guilty of a misdemeanor and upon conviotio thereof shall.be.fined not less than $10.00 nor more than $100.00 for each offense and upon the convic+timn. of any person or persons to. whom a license as provided for in this ordinance shall have been issued, o in charge of any pool or billiard li any.employee thereof, of any such.vio upon the conviction of any person sed un: er this ordinance, Om ion, or upon -the conviction of any of such persons of selling or kee ing for sale or free distrib- ution, or of using or permitting the use any intoxicating liquors or of selling or keeping for sale or free d strubution-of any cigarettes or cigarette papers on any of'such premises, shall revoce such license, and no license shal be granted or issued to any such person so.c such conviction, an action shall at once.accrue Byrd of Commissioners at any time thereafter ted, and upon any the bond given by any such person or persons, and the person or psons to whom any such license is issued shall be deemed responsible f and guilty,of any violation of this ordinance caused or.permitted or employee of such pool or billiard hall. Section 9. Any person or persons who shall atin any pool or billiard table required to be licensed by manager ep or main - this ordin- ance, without first obtaining a license therefor, or -who sha'1 maintain any such pool or billiard table or keep open any bi 1 pool hall after ang such license shall be revoked shall for ea keep or or day or part of a day that any such pool or billiard hall is kept'open, be guilty of a misdemeanor and for each separate offense shall upon etion be punished by a fine of not less than $50.00 nor=more than 00; and provided further that if any bond given unde-r,this ordinance shall\cancelled by the surety, or otherwise, the operation or use of -any pool ord table thereafter and before a new bond is�given shall be deemeation thereof without a license, and any such license shall bedeeand void during any perlid in which no bond as herein required is ir�\effect. That no more than 8 license -s shall hereafter be grant- ed or be in effec\othing ime under the;provisions of this ordinance; pro- vided however, thin this section shall be construed to prevent the re -issuing ofto persons nvw engaged in such business in the City of Salina, ofide purchasers of any such business, but in the efent of the on of the license of any such person or persons, or of their successors in bu iness, no additional licenses shall be grant- ed in excess of the number abode specified. Section 11. At least o copies of this ordinance and the license issued hereunder, shall.be pos billiardohall licensed under the conspicuous places in each pool.or isions of this ordinance, and a fail- ure to keep such copies and license p\bea\ all be deemed a violation of the provisions of this ordinance. Section 12. That OrdinancNo.18 of the City of Salina, passed and approved January 5th; 1917d the same is hereby repealed; provided that any license heretofore issued u\derthe provisions of such ordinance and any bond filed in accordance wiordinance, shall re- main in effect until the expiration of such lIntroduced for first reading June926. BE IT ORDAINIsD by the Board of Commissioners of the City of Salina, Itiansas : SECTION 1. It shall be unlawful for any person or persons to have, keep or maintain, for hire or profit in any place in the City of Selina, and billiard or pool tables, without first securing a license there- for as in this ordinance provided, and paying a license tax on all such tables in the following amounts: For the first table, $25.00; for the second table, 15.00; for each additional table, 10.00: Such license when issued shall be for a period of six months, and shall expire on the last day of June or December next after the same is issued, and shall be non -assignable and non -transferable; provided that if any such license shall be issued within three months prior to the last day of June or December, the license tax for such remaining per- iod shall be one-Yialf of the amounts above specified. SECTIn 2. Any person or persons desiring a license under this ordi- nance shall make application therefor in writing, over his or their signature, to the Board of Commissioners. Accompanying such application, and before any license is issued, such applicant shall deposit with the City Clerk a bond running to the City of Salina, in the penal sum of x;500.00, with a corporate surety authorized to do business in the State of i;ansas, conditioned that no intoxicating liquors, cigarettes, or cigarette papers, shall be, sold or kept for sale or free distribution, and that no intoxicating liquor shall be permitted to be used in or about the premises designated 2. in such application; that such applicant shall keep an orderly house, will notopermit any person under nineteen years of age to play at billiards or pool on said premises, or permit any minors to loiter or congregate in or about such place/, and will not permit any gambling in or about said premises, and will in all respects satisfactorily observe all of the provisions and conditions of this ordinance and all other ordinances of the City of Salina, relating to the business, for which such license is asked. SECTION 4. If the Board of Commissioners shall deem the applicant to be a fit person to engage in such business, and shall approve such application and the bond submitted therewith, the City Clark shall, upon payment of the license tax_ herein provided for, issue suen license. SECTION 5. It shall be unlawful for any person or persons to keep open or cause to be kept open any billiard or pool hall, bowling alley, or any other place where billiard or pool tables or other gaming tables or devices are kept for pay on the first day of the week, commonly known as Sunday, or between the hours of 11 P. ISI. and 6 A. M. or per- mit any game to be played therein on Sunday or between such hours of 11 P. M. and 6 A. M. SECTION 6. It shall be unlawful for the keeper of any place described in the preceeding section hereof to permit or allow any person under the age of nineteen years to play at or take part in any game in any said place, or to permit or allow any minors to loiter or congregate in or about any such place. S=C`'IO?d 7. -It shall be unlawful for the proprietor or manager of any pool or billiard hall to knowingly permit the use of profane or in - or decent language/to permit ally riotous or disorderly conduct in such place. SECTION 8. Any person or persons who shall violate any of the pxo visions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined not less than 10100 nor more than X100.00 for each offense and upon the conviction of any person or persons to whom a license as provided for in this ordinance shall have 3. been issued, or upon the conviction of any person in charge of any pool or billiard licensed under this ordinance, or any employee thereof, of any such violation, or upon the conviction of any of such persons of selling or keeping for sale or free distribution, or of using or permitting the use of any intoxicating liquors of of selling or keeping for sale or free distribution of any cigarettes or cigarette papers on any such premises, the Board of Commissioners shall revoke such license, and no license shall at any time thereafter be granted or issued to any such person so convicted, and upon any such aDnviction, an.action shall at once accrue upon the bond given by any such person or persons, and -the person or persons to whom any such license is issued shall be deemed responsible for and guilty of any violation of this ordinance caused or permitted by any manager or employee ofA^^ct- pool or billiard hall. SECTION 9. Any person or persons who shall keep or maintain any pool or billiard table required to be licensed by this ordinance, without first obtaining a licnese therefor, or who shall keep or maintain any such pool or billiard table or keep open any billiard or pool hall after any such license shall be revoked shall for each day or part of a day that any such pool or billiard hall is kept open, be deemed guilty of a misdemeanor and for each separate offense shall upon con- viction be punished by a fine of not less than 950.00 nor more than yplOO.00; and provided further that if any bond .given under this ordi- nance shall be cancelled by the surety, or otherwise, the operation or use of any pool or billiard table thereafter and before a new bond is given shall be deemed an operation thereof without a license, and any such license shall be deemed null and void during any period in which no bond as herein required is in effect. SEC10101T 10. That no more than f licenses shall hereafter be granted or be in effect at any time under the provisions of this ordinances pro- vided however that nothing in this section shall be construed o pre- vent the reissuing of licenses to persons nov, engaged in such business 4. in the; City of Salina, or to bona fide purchasers of any such business, but in the event of the cancellation of the license of any such person or persons, or of their successors in business, no additional licenses shall be granted in excess of the number ,)above specified. p SECTION 11. At least two copies of this ordinance shall be posted in conspicuous places in each pool or billiard 'hall licensed under I the provisions of this ordinance, and a failure to keep such copies"4 MOA" posted shall be deemed a violation of the provisions of this ordinance. That Ordinance PIo. 2018 of the City of Salina, passed and approved January 5th, 1917, be the same :ds hereby repealed; pro- vided that any license heretofore issued under the provisions of such ordinance and any bond filed in accordance with such ordinance, shall remain in effect until the expiration of such license.
