3254 AnnexNANC AN ORDINANCE providing that certain unplat �ed tracts of land and certain platted additions or sub -divisions which have been subdiv- ided into lots and blocks be added to, tRken into and made parts of the City of Salina, Kansas; extending the City Limits of said City so as toinclude such added land and re- pealing all ordinances or parts of ordinances in conflict with the provisions of this ordinance. BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF SALINAP� KANSAS: Section 1. That that certain tract of unplatted land which is des- cribed by .metes and bounds as follows: Commencing at the northwest corner of the North East Quarter of Section 18, Township 14, Rangg 2 in Saline County; thence east 967.3 feet more or less to the northeast corner of e Lot 1 in Surveyor's Plat No. 34, being a surveyor's plat of the North Half of the North East Quarter of said Section 18 as the same remains on file and of recotd in the office of the Register of Deeds Cdr said county; thence south along the east line of said Lot 1 and said line extended 458 feet more or lees to the center of the public road known as the Iron Avenue road; thence west along the center of said road 967.3 feet more or less to the west line of the North East Quarter of said Section 18; thence north 458 feet more or less to the point of beginning; which tract does not exceed twenty acres in area and which is so situated that more than two thirds of the west boundary line thereof lies upon or touches the present boundary line of the City of Salina and which contains and consists of Lot 1 in said Surveyor's Plat 34 together with the north half of said public road above mentioned all lying within and being a part of the north half of the North East Quarter of said Section 18, be added to, taken into and made a part of the City of Salina, Kansas. Section 2. That that certain tract of unplatted land which is described by metes and bounds as follows: Commencing at a point 967.3 feet east of the northwest corner of the North East Quarter of Section 18, Town- dhip 14, Range 2 in Saline County, Kansas, being the northwest corner of Lot 3 in Surveyor's Plat No. 34 of the North Half of the North East Quarter of said Section 18, according to the recorded pca t thereof in the office of the Register of Deeds of Saline County; thence east 1672.7 feet more or less along the north line of said Section 18 to the north east corner of said Section; thence south 458 feet more or less along the east line of said Section 18 to the point of intersection of said line with the center line of the public road known as Iron Avenue; thence west 1672.7 -feet more or less along the center of said public road.to a ioint in the center line of said Section 18 due south of point o -f beginning; thence north 458 feet more or less to point of beginning; which said tract does not exceed twenty acres in area and which is so situated that more than two thirds of the west boundary thereof lies upon or touches the present boundary line of the City of Salina as established by Section 1 of this ordinance and which c contains and consists of Lot 3 in said Surveyor's Plat No. 34, together v✓ith•that.part of the west half of the public road lying along the east line of said tract and the north half of that part of the public road lying along the south line of said tract, all laying within and being a part of the north half of the North East Quarter of said Section 18, be added to, taken into and made a part of the City of Salina, Kansas. Section 3. That Country Club Heights, a platted addition or sub -division in Saline County, Kansas, which is sub -divided into lots and blocks according to the recorded plat thereof on file arra of re- cord in the office of the Register of Deeds of Saline County, Kansas, as -shown in Plat Certificate Book No. 1 at page 227 in Book E of Plats at page 77 and which'adjoins the present limits of the City of Salina, as established by Section 2 of this ordinance, -be and the same is hereby added tori taken into and made a part of the City of Salina, Kansas.. Section 4. That the corporate limits of the City of Salina, including the territory added to said City by the provisions of the •preceding sections of this ordinance are hereby defined as hereinafter 'in this section set forth and that all land lying within the following described boundaries be and the same is hereby declared to be within the corporate.limits of the City of Salina, Eansas, and a part of such City, such boundaries and corporate limits being as follows, to -wit: Commencing at the point of intersection of the center of Ninth Street with,the center of Cloud Avenue, being the corner of Sections 23, 24, 25 and 26, Township 14 South,.Range 3 West of the 6th P. M. in Saline " County, Kansas; thence west along the south line of,said,section 23 to the -,southwest corner of Evergreen Park Addition; thence north along the west line of Evergreen Park "Addition to the northwest corner of said.Addition, such point being in the south line of Claflin Avenue as, shown on the plat of Pleasant View Addition; thence west along the scu th line of ClaflinnAvenue to the wouthwest corner of Pleasant View Additior; thence nor.th along the west line of Pleasant View Addition to the north- west corner of said Addition, said point being the south east corner of Park View Addition; thence west along the south line of Park View Addition to the southwest corner of said Addition; thence nort9m along the west line of said Addition to the south line of Jeqell Avenue, be- ing the northwest corner of said Park View Addition; thence west along the south line of Highland Court Addition to the point of intersection of said line with the east line of the right -of -way -of the Missouri Pacific Railroad Company, be$ng the west line of Highland Court -Add- ition; thence north along the east line of said railroad right-of-way U to the point of intersection of said line with the south line, produced east, of Walnut Grove Addition; thence west along said line 66 the south- west corner of said Addition; thence north along the west line.of said Addition to the south line of Leavenworth Addition, being the center line of Walnut Street; thence west along the south line of Leavenworth Addition to the southwest corner of said Addition; thence north along the west line of Leavenworth Addition to the center line of State Street, -being the north line of Section'14,.Township 14, Range 3; thence east along said ;Hne to the center of the channel of Dry Creek; thence in a northerly direction down the center of said creek to the center line of North Street; being the north line of Chicago Addition and the center line of Section 11. thence south along said line to the center of Cloud Avenue, being the southeast cofner of said addition; thence west along said line, being the south line of said Section 24, to the intersection of said line with the center line of Ninth Street, being the point of.beginning. Section 5. That all references to this ordinance to any addition or sub -division be deemed to refer to and that the same does refer to such addition or sub -division as originally platted and as the certificate of the same is recorded in the office of the Register of Deeds of Saline County, Kansas. . Section 6. That all ordinances or parts of ordinances in con- flict with this ordinance be and the same are, in so far as they conflict with the provisions of this ordinance, repealed. Section V. That if any section of this ordinance or any clause or any part of any such section shall be.held unconstitutional or void for any reason, all other sections, clauses.or parts of this ordinance shall remain in full force and effect irrespective of any such holding or deeision, it being the intention to adopt eaeh.section, clause or part of this ordinance independently.of any other section, clause or part thereoff Section S.
