BE IT ORDAINED BY THE BOARD OF COMMISSIONERSOF THE CITY OF SALINA, KANSAS Section 1. That there be and there is hereby created a Lateral Storm.Sewer District in the City cff Salina which shall be designated as Lateral Storm Sewer District No. 2 which shall include all of the terr- itory in said city within the following described boundaries, to -wit: Beginning at the point of intersection of the center line of the alley between Ash Street and Pakk Street with the center line of bhe right- of-way of the Missouri Pacific Railway; thence -southeasterly and south along the center line of said flight -of -way to tts intersection with the center line of the alley between Ash Street and State Street; thence west along the center line of said alley to its intersection with the center line of the alley parallel to and situate 120 feet west of Olive Street; thence north along the center line of the last named alley to its intersection with the alley between Ash Street and Park Street; thence east along the center line of the last named alley to the place of beginning. Section 2. That it is necessary and it is hereby crdered that a lateral storm sewer, together with all necessary inlets, inlet connections, manholes, head walls and other appurtenances, be construct- ed and built for the purpose of draining the territory within the dis- trict created and defined by Section 1 of this ordinance, such storm sewer exclusive of, such inlets, inlet connections, etc., to be built along the following described course; Beginning at a manhole to be con- structed near the center line of Ash.Street and approximately 179"" feet east of the center line of Chicago Street; thence west along the center line of Ash Street as a 15 inch vitrified pipe sewer to a man- hole to be constructed approximately 194 feet west of the center line of Chicago Sbreet; thence continuing west as a 21 inch vitrified pipe sewer approximately 680 feet to an outlet in the east bank of Dry Creek; together with all the necessary manholes, inlets, inlet connections, headwalls, and other appurtenances as shown.on the plans and specifi- cations to be prepared and filed by the City Engineer as hereinafter provided for. Section 3. That the City Engineer of said City shall on or before the 24th day of May 1926 prepare and file in the office of the City Clerk phns and specifications for the construction of the Lateral Storm Seaver provided for in Section 2 of this ordinance which shall be of sufficient size and of proper character to properly drain -the property within..said District and shall on or before the said date prepare and submit to the Board of Commissioners a detailed estimate under oath of the cost.thereof. That thereafter the City Clerk shall advertise for three consecutive days in the official City paper for sealed proposals for the building and construction of said sewer according to the plans and specifi- cations of the City Engineer herein provided for which proposals shall be filed with the City Clerk on or before the time to be fixed in such notice at which time the Board of Commissioners shall let the contract for the building and construction of said sewer to the lowest responsible -bidder therefor; provided that such bids shall not exceed the estimated cost thereof and provided further that the Board of Commissioners shall reserve the right to reject any and all such proposals and that if no responsible -bid shall be received within such estimated cost the Board of Commissioners may proceed to build and construct such sdwer within such estimated cost. mSeetion 4. That for the cost of building and constructing said sewer special assessment shall be made for the full cost thereof on all lots or pieces of land within the District as created and defined by Section 1 of this ordinance accodrding to the appraised value thereof without regard to the buildings or improvements thereon. Section 5. After the passage and publication of this ordinance the Board of Commissioners shall appoint three disinterested appraisers who after having taken an oath to make a true and impartial appraisembnt of all lots or pieces of land liable to assessment and -taxation for the cost of improvements herein provided for, shall within five days after having been notified of their appointment proceed to appraise all of the lots or pieces rf land.within said Districp, liable to assessment and taxation as aforesaid without regard to the buildings or improvements thereon, and after making said appraisement shall return the s.ame to the Board of Commissioners of said City and said Board shall designate_a time for hold-.._ ing a special session of such Board for the purpose of hearing any com- plaints that may be made as to the value of any lot or piece of land appraised as aforesaid, of which special session due notice shall'be given in the official city paper at which special session said Board may alter any valuation of any lot or piece of land if, in their opinion, the same has been appraised too high m too low. Section 6. The special assessments herein provided for may be paid by the person liable therefor in ten approximately equal annual in- stallments but the ovmer of any property liable to such assessment may within thirty days from the time of determining the amount assessed against his property pay the same in full�fnd his property shall not be liable for any assessment for the cost of suctL improvements and bonds as hereinafter provided for shall be issued only for the amount of the cost of such improvements remaining unpaid at the end of thirty days from the time such assessment is fixed. Section 7. For the purpose of paying for the work and improvements in this ordinance provided for the Board of Commissioners are hereby authorized and directed to issue improvement bonds of the City of Salina ,in an amount not to exceed the contract price for such improvements and to run for a period of ten pears and be payable in ten approximately equal installments, together with interest not to exceed 5% per annum, which bonds shall be made payable at the fiscal agency of the State of Kansas; and for the purpose of paying principal and interest on said board as they severally become due and payable the Board of Commissioners.shal 1 apportion and assess against the lots or pieces of land within the tax- ing district of such improvements special assessments covering the cost of such improvements and the apportionment therein contained shall hold good for all the installments that are to be collected from the specific property chargeable with said improvement. Such assessment and apport- ionment ordinance shall contain the total amount of tax apportioned to each tract, piece or parcel of land within the taxin district and shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually, at the same time other taxes are certified, certify to the County Clerk of Saline County, Kansas a full list of all property liable for such work ard improvements, together with the respective amounts due on each of said tracts, pieces or parcels of land, which amounts shall include the annual installments and interest on all unpaid balances for.one_year at the rate of not to exceed 5% per annum, on such amounts so certified which shall be collected as other taxes are collected. Seotion 8, This ordinance shall take effect and be in full force from and after its publication once in the official city paper; Introduced for first reading May 14th, 1926. Section Be After the passage and publication of this ordinance the Board of Commissioners shall appoint three disinterestod appraisers who after having tak^n an oath to mage a true and impartial 0 0 appraisement of all lots or pieces of land liable to assessment and taxation for the cost of improvements herein provided for, shall within f'ive days after having been notified of their appointment proceed to appraise all of the lots or pieces of land within said District, liable to assessment and taxation as aforesaid without regard to the buildings or improvements thereon, and after making said appraisement shall return the same to the Board of Commissioners of said City and said Board shall designate a time for holding a special session of such Board dor the p urpose of hearing any complaints that may be made as to the value of any lot or piece of land appraised as aforesaid, of which special session due notice shall be given in the official city paper at whioh special session said Board may alter any valuation of any lot or piece of land if, in their opinion, the same has been appraised too high or too low. Section 6. The special assessments herein provided for may be paid by the person liable therefor in ten approximately equal annual installments but the owner of any property liable to such assessment may within thirty days from the time of determining the amount assessed against his property pay the same in full and his property shall not be liable for any assessment for the cost of such improvements and bonds XXJ11¢Xj1 as hereinafter provided for shall,be issued only for the amount of the cost of such improvements remaining unpaid at the end of thizty sr time such assessment is fixed. G Section 7. Section S. This ordinance shall take effect and be in full force from and after its publication once in the official city paper.
