3238 Improving Ash Streetw ORDINANCE AN ORDINANCE providing for the curbing, guttering, excavating, grading and gravelling of Ash Street in the City of Salina, Kansas from: the west line oT__fIie right-of-way of the Missouri Pacific Railway Company to the east line of Olkve Street in said City;) and providing for the cost thereof, how the same shall be assessed and the manner of payment therefor. 'WHEREAS, by resolution dg,ly adopted on the 8th day of March 1926 the Board of Commissioners of the City of Salina.. Kansas, have declared that they deem it necessary to curb, gutter, excavate, grade and gravel Ash Street in the City of Salina, Kansas from the west line of the rigs of way of the Missouri Pacific Railway Company to the east line of Olive Street in said City; and WHEREAS, said resolution was published for six days in The - Salina Journal, a daily newspaper published in the City of Salina, the official City paper of said City; and WHEREAS the majority of the resident property owners,aming a majority in squAre feet of the lots or real estate liable to taxation for the cost of said improvements did not within twenty days from the dqte of the last publication of such resolution file with the City Cler3 of said City their protest in writing against such improvements or the making thereof, NOW THEREFORE: BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That it is necessary and it is hereby ordered that Ash Street in the City of Salina, Kansas, from the west line of the right-of-way of the Missouri Pacific Railway Company to the east -line. of Olive Street in said City be curbed and guttered with such material as the Board of Commissioners may hereafter designate and select, as hereinafter provided for according to the specifications of the City Engineer of the City. of Salina as hereinafter provided for, and that said street within the limits above defined be excavated and graded to such extent as may be necessary for the completion of said work, and th; at the intersections of streets and alleys such curbing and guttering shall be carried back to -the lot line of the street so improved, the distance between the curbing on each side pf said street to be 40 feet from face to face of curb. Section 2. That it is necessary and it is hereby ordered that Ash Street in the City of Salina, Kansas from the west line of the right-of-way of the Missouri Pacific Railway Company to the east line of Olive Street in said City be gravelled with such material as the+. Board of Commissioners may hereafter designate and select, as here- inafter provided for according to the plans and specificationsof, the City Engineer of said City hereinafter provided for and that said street within the limits above mentioned be excavated and graded to the extent necessary for the completion of such work according to suEah specifications and that at the intersection of streets and alleys said gravelling be carried back to the lot line of the street so improved. aaid street shall be gravelled for a width of 40 feet, excluding curb and gutter, which are provided for herein. Section 3. For the work and improvement herein provided for the City Engineer shall make and file with the City Clerk on or before the 10th day of May 1926, complete plans and specifications for the curbing and guttering and for the gravelling of said street with the following materials: CURBING AND GUTTERING: Combined curb and gutteriPortland CemenbnConerete) from back of curb to paving line 30 inches. Curb to be 6 inches at.top, 7 inches at bottom. GRAVELLING: M To be of sand clay type surface and to be 7 inches deep. and that on or before the same last named date the City Engineer o" said City shall submit to the Board of Commissioners, under oath, detailed es- timates of the cost of such curbing, guttering and gravelling, including the excavation and grading necessary therefor with the different kinds of.materi herein mentioiwd. Section 4. That after such plans and specifications shall have been made and prepared by the City Engineer and filed with the City Clerk as afor said the Board of Commissi m ers may advertise, by advertisement published in the official City paper of the City of Salina, Kansas for three consecut- ive days for the receipt of sealed proposals for the construction of such improvements, and after the receipt of such proposals the said Board of Commissioners may and are hereby authorized to let contracts for the improv- ing of said street with the material so selected to the lowest responsible bidder therefor, as determined by said Board of Commissioners, which kind and character of curbing and guttering and gravelling shall be determined by said Board of Commissioners, and for such excavating and grading. Said Board of Commissioners reserve the right to reject any and all bids. Section 5. That for improving the above mentioned street special assessment shall be made for the full cost thereof on each block separately on ail lots or pieces of land to the center of the block on either side of the street according to the appraisers value thereof, without regard to the buildings or improvements thereon for the distance to be improved. Section 6. After the passage and publication of this ordinance the Board of Commissioners shall appoint three disinterested appraisers, householders, who after having taken an oath to make,a true and impartial appraisement of all lots and pieces of land liable to assessment and tax- ation for the cost of the improvements herein provided for, shall within Hive days after having been notified of their appointment proceed to appraise said lots and pieces of land liable to assessment and taxation as aforesaid as may be designated by the Board of Commissioners of said City without regard to the buildings or improvements thereon, and after making said appraisement shall return the same to the Board of Commissioners of said City and said Board of Commissioners shall designate a time for holding a special session of such Board for the purpose of hearing any complaint that may be made as to the value of any lots or pieces of land appraised as aforesaid, of which special session due notice shall be given in the official city paper, at which special session the Board of Commissioners may alter any valuation of any lot or piece of land Lf, in thibir opinion the same ha"s been appraised too high m too low. Section 7. For the purpose of spaying for the work and improvement in this ordinance provided for the Board of Commissioners are hereby authorized and directed to issue internal improvement bonds of the City of Salina in an amount not to exceed the contract price for such improve ments and to run for a period of five years and be payable in five equal installments, together with interest not to exceed 5% per cent per annum which bonds shall be made payable at the fiscal agency of the State of Kansas; and for the purpose of paving principal and interest on said bonds as they severally become due and payable the Board of Commissioners shall apportion and assess against the lots and pieces of land within the taxing district of such improvements special assessments covering the cost of such improvements and the apportionment therein contained shall hold gooa for all the installments that are to be collected from the specific property chargeable with -said improvement. Such assessment and apportionment ordinanve shall contain the total amount of tac apportioned to each tract, piece and parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually, at the same time other taxes are certified, certify to the County Clerk of Saline County, Kansas a full list of all proprty liable for such work and improvements, together with the respective'' amounts due on each of said tracts, piece and parcel of land, which amounts shall include the annual installments and interest on all unpaid balances for one year at the rate of not to exceed 5% per annum, on such amounts so certified which s hall be collected as other taxes are collect ed; Provided that for the purpose of defraying the cost of improving phe intersections and areas formed by the crossing of streets and alley§ as well as where the improvement is through or adjacent to property of the City, for which the Cityowould be liable, the assessment will be made against all taxabii property of the City and paid by the City at large.
