AN ORDINANCE specifying and selecting the material to be used and letting
a contract for the re -curbing and guttering of Seventh Street
in the City of Salina, Kansas from the north line of Walnut
Street to the scu th line of Elm Street in said City.
BE IT ORDAINFM by the Board of Commissioners of the.City of Salina, Kansas:
Section 1. That it is hereby determined that Seventh Street in the
City of Salina, Kansas, from the north line of Walnut Street to the south
line of Elm Street in said City be re -curbed with separate concrete curb,
said concrete curb to be 6 inches at top, 7 inches at bottmm and 16 inches
averate depth.
Section 2. That it is hereby determined that Seventh Street in
the City of Salina, Kansas, from the north line of Walnut Streetnto the
south line of Elm Street in said City be guttered with concrete gutter,
said gutter to be 4 feet wide, 7 inches deep and to be placed outside of
the present paving line on each side of said street.
Section 3. That the present curb and all of the present sidewalk
in said street lying within 42 feet on each side of the present paving line
of said street and al'l the earth within said space necessary to be removed
for the 'construction of said curb and gutter above provided for, be excav-
ated and removed and that the white -way poles noN in said space be removed
and re -set back of the new curb line, and that such part of the p°esent
brick surface on Seventh Street as may be necessary to paopIrly connect
with sucjg new curbing be taken up and relaid, and that such sidewalks adjac-
ent to such improvements as may be necessary be replaced or relaid, and that
all filling and rolling necessary for the proper construction of all of the
improvements herein above provided for shall be done and all such improvements
shall be made and done in strict conformity and in compliance with the plans
and specifications heretofore made by the City Engineer of Salina, Kansas
and now on file with the City Clerk of said City, which plans and speci-
fications are hereby iheorporated in and made a part hereof in all respects
as fully and completely as though written out at length herein; which said
plans and specifications are hereby adopted as and for the plans and speci-
fications of such work and improvements.
Section 4. That a contract is hereby awarded to L. W.nRexroad
for constructing the improvements.in the pueceding section hereof provided
for, and for the labof actually performed and the material actually furnished
the following prices shall be paid in accordance with the written proposal
of said L. W. Rexroad, which is hereby made a part hereof by reference, to -
wit: Excavating per square yard, $.58; white -way removing and replacing,
$485.00; curbing, per lineal foot 820; guttering, per square foot, 280;
new concrete sidewalks, per square foot 200; old concrete sidewalks, per
square foot, 10¢; old brick sidewalks, per square foot, 150; brick paving,
removed and relaid, per square yard, $1.00. All of said work shall be paid
for according to the measurement made by the City Engineer of the City
of Salina, nIt is hereby determined the found that the price to be paid
for the improvements as aforesaid is less than the estimated prices fv r
said improvements, according to the estimate made and prepared by the
City Engineer and now on file with the City Clerk of the City of Salina
Kansas.
Section 5. Said contract is awarded upon the express condition
that such work and improvements shall be done in stric& accordance with
and in compliance with the plans and specifications of the City Engin-
eer therefor, which plans and specifications are hereby made a part of
this ordinance and with the contract awarded to said L. W. Rexroad,
and upon further condition among others that stid L. 'N. Rexroad shall
furnish to the City of Salina a surety company bond of the approximate.
sum of the cost of such improvements, guaranteeing the prompt, proper
and workmanlike construction of all of the same and indemnifying the
City of Salina against loss or damage which the City'm@L3r sustain or
suffer on account of injury to persons or property caused or permitted
by said contractor or his employees, together with a surety company bowl
guaranteeing such curbing and guttering against all defects in material
and workmanship for a period of two years from the date of its complet-
ion and acceptance by the City, together with a good and sufficient
surety company bond running to the State of Kansas in an amount app-
roximately equal to the contract price of said improvements conditioned
that said L. W. Rexroad shall pay Ill indebtedness for labor and mater-
ial furnished in the making of the improvements provided for herein.
Section 6. The Board of Commissioners of the City of Salina are
hereby authorized to make and enter into on behalf of said City all
written agreements necessary to secure the construction of the improve-
ments herein provided for.
Section 7. This ordinance shall take effect and be in full
force from and after its publication once in the official city paper.

of said L. W. nexroad,which is hereby made ,a part hereof by reference, to -wit:

with the City Clerk of the City of Salina, Kansas.

which plans and specifications are hereby made a part of this ordinance and
with the contract awarded to said L.W.nexroad, and upon further codditions
among others that said L. W. hexroad shall furnish to the City of Salina a
surety company bond of the approximate sum of the cost of such improvements,
guaranteeing the prompt, proper and workmanlike construction of all of the
same and indemnifying the City of Salina against loss or damage which the
City may sustain or suffer on account of injury to persons or property

caused or permitted by said contractor or his employees, together with
a surety company bond guaranteeing such curbing and guttering against all
defects in material and workanship for a period of two years from the
date of its completion and acceptance by the City, together with a good
and sufficient surety company bond runking to the StaDe of Kqmmsas in an
amount approximately equal to the contract price of said improvements
conditioned that said L. W. Rexroad shall pay all indebtedness for labor
and material furnished in the making of the improvements provided for
herein.
Section 6. The Board of Commissioners of the City of Salina are

written agreements necessary to secure the construction of the improvements
herein provided for.
