3230 Improving Lincoln Ave!w AN ORDINANCE specifying and selecting the material to be used and lett- ing a contract for the curbing, excavating, grading and gravelling with sand -clay of Lincoln Avenue from the west line of Ninth Street to the West line of Tenth Street and for the excavating, grading and gravelling with sand -clay of Thirteenth Street from the north line of the.Union Pacific Right-of-way to the south line of Grand Avenue and of Tenth Street from the n m th line of Lincoln Avenue to the south line of Grand Avenue, in the City of Salina, Kansas. BE IT:.ORDAINED BY THE BOARD OF-COMMISS�30NERS of the City of Salina, Kansas: Section 1. That it is hereby determined that Lincoln Avenue in the City of Salina. Kansas, from the west line of Ninth Street in said City to the west line of Tenth Street shall be gravelled with art- ificial sand -clay surface. Such gravelling shall be 7 inches deep, and shall be 37 feet in width, excluding curb and gutter. Section 2. That it is hereby determined that Lincoln Avenue in the City of Salina, Kansas, from the west line of Ninth Street to the west line of Tenth Street in said City shall be tubbed with Portland Cement concrete curb, six inches thick at top; seven inches thick at bottom and sixteen inches deep. Section 3. That it is hereby determined that Thirteenth Street in the City of Salina, Kansas, from the north line of the Union Pacific Rig ht -df -way to the south line of Grand Avenue in said City, shall be gravelled with.artificial sand -clay surface. Such surface shall be 7 inches deep and shall be 36 feet in width from the Union Pacific Right - of -tray to North Street and 28 feet in width from North Street to Grand , . Avenue excluding curb and gutter. Section 4. That it is hereby determined that Tenth Street in the .City of Salina, Kansas from the north line of Lincoln Avenue to the south line of Grand Avenue in said City shall be gravelled with artificial sand clay surface, Such surface shall be 7 inches deep, and shall 31 feet in width, excluding curb and gutter. V Section 5. All excavating, filling and rolling necessary far the proper construction of such improvements shall be done and all of such improvements shall be made and done in strict conformity to aryl. -in compliance with the plans and specifications heretofaee made by the City Engineer of Salina, Kansas, and now on file with the City Clerk of said City, which plans and specifications are hereby incorporated in and made a part hereof in all respects as fully and completely as though written out at length herein, -which said pland and specifications are hereby adopted as and for the plans and specifications of such work and improve- ments. Section 6. That a contract is hereby awarded to L. W. hexroad for the surfacing with sand clay, and for curbing, excavating and filling the above mentioned streets in the limits aforesaid with the materials herein- before specified, for the labor actually performed and the materials actually furnished at the following prices: For surfacing with sand clay 38� per square yard; for excavating and grading, 800 per cubic yard; for Portland Cement Concrete Curb, 82� per linear foot. All of said work shall be paid for according to measurement made by the City Engineer of the City of Salina. It is hereby found and determined that the prices to be paid for the im- provements mprovements as aforesaid are less than the prices of each and all of said improvements as shown by the sworn estimates of the City Engineer now on file with the City Clerk of &he City of Salina, Kansas. Section 7. Shah contract is awarded upon the express onndit- ion that such work and improvements shall be done in stricg accordance and .n compliance with the plans and spedifications of the.City Engineer therefore; which plans and specifications are hereby made a part of this ordinance and of the contract awarded, and upon further conditions among others that the person to whom said contract is awarded shall furnish to the City of Salina a surety bond in the approximate sum of the cost of such improvements, guaranteeing the prompt, proper and workmanlike construction of all the same, together with a surety company bond guaranteeing such curb against all defects in material and workmanship for a period of two years from the date of its completion and acceptance of such work by the City, together with a good ans dufficient surety company bond running to the State of Kansas in an amount approximately equal to the contract price of said improvements and conditioned that said L. W. Rexroad shall pay all indebtedness for labor and material furnished in making the improvements haelin provided for. Section 8, The Board of Commissioners of the City of Salina are hereby authorized to make and enter into on behalf of said City all written agreements necessary in ,order to secure the construction of the improvements herein provided for. Section 9. This ordinance shall take effect and be in full force from and after its publication once in the official city paper.
