3229 AnnexAN ORDINANCE providing that certain lands adjoining or touching the limits of the City of Salina, consisting of certain platted additions m sub -divisions which have been sub -divided into lots and - blocks, and certairi-unplatted tracts of land be added to, taken into and made parts of the City of Salina, Kansas, and extending the City limits of said City so as to include such added land, and'repealing all ordinances or parts of ordinances in conflict with the provisions of this ordinance. BE IT ORDAINED by the Board of Commissioners (f the City of Saliha, Kansas; Section 1.. That -COLLEGE COURT, a platted sub -division, which is subidivided into lots and blocks according to the recorded plat thereof on file and of record in the office,of the Register of Deeds of Saline County, Kansas, as shown in Plat Certificate Book No. 1, at Page 164 and in Book "E" of Plats, page,38 and which adjoins the present limits of the City of Salina, be and the same :s hereby added to, taken into and made a part of the City of Salina. That WALNUT GROVE; a platted addition or sub -division, which is sub -divided into lots and blocks according to the recorded plat thereof on file and of record in the office of the Register of Deeds of Saline County, Kansas, as shown in Plat Certificate Book No. 1, at Page 185 and in Book "E" of Plats, Page 57 and which adjoins the present limits of the City of .Salina, be and the same is hereby added toy taken into and mode a part of the City of Salina.. Section 3. That Blocks One (1), Two (2), Three (3) and Four (4) of STACK PLACE, a platted addition or sub -division, which is subgdivided into lots and blocks according to the recorded plat thereof on file and of record in the office of the Register of Deeds of Saline County, Kansas, as shown in Plat Certificate Book No. 1 at Page 105 in Book "D" of Plats, Page 19 and which adjoins the present limits of Salina be and time same are hereby added to, taken into and made a part of the City of Salina. Section 4. That SOUTHERN HEIGHTS, a platted addition or sub- division, and which is subgdivided into lots and blocks according to the recorded plat thereof on file and of record in the office of the Register of Deeds of Saline County, Kansas, as shown in Plat Certificate Book No. 1, atePage 98 and in Book "D" of Plats, Pgge 17, and which adjoins the present limits of the City -of Salina, be and the same is hefeby added to, taken into and made a part of the City of Salina. Section 5. That PLEASANT VIEW ADDITION, a platted addition or sub -division which is sub -divided into lots and blocks according to the recorded plat thereof on file and of reeodd in the office of the Register of Deeds of Saline County, Kansas, as shown in Plat Certificate Book No. 1, at Page 183 and Book "E" of Plats at Page 55 and which adjoins the present limits of the City of Salina, be and the same is hereby added torp taken into and made a part of the -City of Salina. Section 6. That EVERGREEN PARK ADDITION, a platted addition or sub -division which is dilvided into lots and blocks according,to the recorded plat thereof on file and of record in the office of the Register of De,eds of Saline County,,Kansas, as shown in Plat Certificate Book No.l at Page 101 and Book "D" of Plats at Page 18, and which adjoins the present limitsof the City of Salina, be and the sqme is hereby added to, taken into and made a part of the City of Salina. Section 7: That PARK VIEW ADDITION, a platted addition or sub- division and which is sub -divided into lots and blocks according to.the recorded plat thereof on file and of record in the office of the Registw of Deeds of Saline.County, Kansas as shown in Plat Certificate Book No. l at Page 223 and Book,"E".of Plats at Page 74, and which adjoins the present limits of the City of Salina, be and the same is hereby added to, taken into and made a part of the City of Salina. Section S. That that certain tract of unplatted land which is described by metes and bounds as follows: Commencing at the point of intersection of the east line of Delaware Avenue (north of Iron Avenue) in the City of Salina, Kansas, produced north, with the een$er_ of the channel of the Smoky Hill River, thence easterly along the center of said river to the north line of Dec. 18-14-2; thence east to the center line of Wisconsin Avenue as shown on the recorded plat of.Phillips East Salina Addition qs the same remains on file and of record in the office of the Register of Deeds for Saline County Kansas, in Plat Certificate Book No. 1, page 21 and in Plat Book "C" Page 9, (that part of such addition lying east of Delaware Avenue, with - the exception of certain streets therein having been vacated by an Act of tge Legislature, Chapter 410, Laws of Kansas 1901); thence south along the center line of said Wisconsin Avenue to the center line of Iron Avenue as shown on the plat of said Pgillips East Salina Addition; thence west along the center line of said Iron Avenue to the east line (f Delaware Avenue in said Addition; thence north along the east line of Delaware Avenue to the point of beginning; which said tract does not exceed twenty(20) acres in area, and which is so sitia ted that more than two-thirds of the west boundary line thereof lies upon or touches the present boundary line of the City of Salina, and which contains and consists of certain lots known as Lots 2,3040697, and 8 in Surveyor's Plat No. 8 as the same remains on file and of record in the office of the Register of Deeds for Saline County, Kansas, have been formerly platted as Blocks 7, 10 and 13 and Reserve Number 1 in Phillips East Salina Addition, together with that part of the west one-half of Wiscon- sin Avenue and the north one-half of Iron Avenue lying within the limits above described, all lying within and being a part of the North one-half (1) of the Northwest Quarter of Section 18, Township 14 South, Range 2 West in Saline County, Kansas, be added to, taken into and made q pgrt of the City of Salina. That that certain tract of unplatted land which is described by metes,and boundas as follows: Commencing at.a point 1130 feet west and 1322 feet south of the northeast corner of the northeast Quarter of Section 23, Township �4 South, Range 3 West in Saline County, Kansas; thence west 470 feet; thence south 660 feet; thence east 470 feet; thence north 660 feet to -point of beginningp:•which said tract does not exceed twenty (20) acres in area and which is so situated that more than two- thirds of the east boundary line thereof lies upon or touches the present boundary line of the City of Salina and Which contains and consists of certain -lots known as Lots 13 and 14 in Surveyor's Plat No. 10 as the same remains on file aid of record in the office of the Register of Deeds for Saline County, Kansas, and being a part of the South Half of the North- east orth- east Quarter of Section 23, Township 14, South, Range 3 West in Saline County, Kansas, be added to, taken into and made a part of the City of Saline. Section 11. That that certain tract of unplatted land which is described by metes and bounds as follows:. Commencing at the ineerseatp ion of the center line of Ohio Avenue with the south line of Gypsum Avenue in the City of -Salina, Kansas; thence south along the center line of Ohio Avenue which is the east line of Section 13, Township 14 South, Range 3 West, Saline County, Kansas, to the intersection of sadd line with the south line, produced east, of Lot 12, in Surveyor's Plat No. 12 as the same remains on file and of record in the office of the Register of Deeds for Saline County, Kansas; thence west along the south line of said --Lot 12, and said line produced, to the center of the channel of the Smoky Hill River; thence down the channel of said river to the intersection of said line with the east line produced, of Kansas Avenue in the City of Salina; thence north along the east line of Kansas Avenue, being the west line of Lot 5, in slid Survey- .or's Plat No. 12 to the south line of Gypsum Avenue being the north- west corner of said ]Lot 5; thence easterly along the south line of Gypsum.Avenue, being the northerly line of Lots 5,4,3 and 2 of said Surveyor's Plat 12, and said lineprodueed, to the center of Ohio Street, being the point of beginning; which said tract does not exceed twenty (20) acres in area and which is so situated that more bhan•two thirds of the northerly and westerly boundaries thereof lie upon or touch the present boundary line of the City of Salina, and which contains and consists of certain iota known as Lots 2,3,4,5,8, . 9, 10, 12 and 12 of Surveyor's Plat 12, together with that part of the west half of Ohio Avenue which lies within the limits above described, all lying within and being a part of the -East Half of the northeast Quarter of Section 13, Township 14, South, Range 3 West, in Saline County, Kansas, be added to, taken into and made a part of the City df Salina, Kansas. That that certain tract ®f..unp]a tted land which is described by metes and bounds as follows: Commencing at the inter- section of the south line Bf Jewell Avenue, as shown by the recorded plat-of,Highland Court. Addition in the office•of the. Register of Leeds for Saline County, Kansas, with the center line of Ninth Street in the City of Salina, being the east line of Section 23, Township 14, South Range 3 West in Saline County, Kansas; thence south along said center line of Ninth Street to the north line produced east, of Kirwin Avenue, as shown by the recorded plat of Pleasant View Addition; thence west along the north line of said Kirwin Avenue 1320 feet to the southeast corner of Park View Addition according to the recorded plat thereof; thence north 210 feet to the northeast comer of Lot 6, -Park View Addition; thence west 100 feet to southeast Corner of Lot 1, in said addition; thence north to the south line of Jewell Avenue as shown by the recorded plat of Highland Court Addition, the same being the north line of the south Half of the South Fast Quarter of Section 23, Township 14, Range 3 West; thence east along said line to point of beginning, which said tract does not exceed twenty (20) acres in area and which is so situated that more than two thirds of the north and east boundary lines thereof lie upon and touch the present boundary line of the City of Salina, together with that part of the west one half of Ninth Street.which lies within the limits above described, being the north half of the North One Half of the South East Quarter of the South East Quarter and a tract app- roximately 100 feet by 120 feet in the north east corner of the South West Quarter of the South East Quarter, all in Section 23, Township 14 Sow:th, Range Three west in Siline County, Kansas be added to, taken into and made a part odr the City of Salina. Section 13. That that certain tract,of unplatted land whichis described by metes and bounds as follows: Commencing at the intersection of the North lineof the right-of-way of the Misr uri `acific Railway Company with the east line of Section 12, Township 14, South, Range 3 West in Saline County, Kansas; thence southwesterly along the north line of said right-of-way to the intersection of said line with the south line of the North East Quarter of said Section 12; thence north along the east line of Section 12; to the point of beginning, being a part of the South Half of the South Half of the North East Quarter of said Section 122 -which said tract does not exceed twenty (20) acres in area and which is so situated that more than two thirds of the southerly and northwesterly boundaries thereof lietupon and touch the present boundary lines of the City of Salina, be added to, taken into and made a part of the City of Salina, Kansas. That the corporate limits of the City of Salina, including the territory added to said City by the provisions of the pre- ceding sections of this ordinance, are hereby defined as hereinafter in this section set forth and that all land lying within the following des - Bribed boundaries be and the same is hereby declared to be within the cor- porate limits of the City of Salina, Kansas, and a part of such City, such boundaries and corporate limits being as follows, to -wit: Commencing at the point of intersection of the center of Ninth Street with the center of Cloud Avenue, being the corner of Sections 23, 24, 25 and -26,: Township 14 South, Range 3 West of the 6th P. Section 15. That all references in this ordinances to any additio; be deemed to refer to and that the same does refer to such addition as originally platted and as the certificate of the same is recorded in the office of the Register of Deeds of Saline County, Kansas. Sectionl6.That all ordinances or parts of ordinances in conflict with t:is ordinance be and the same are, in so far as they conflict with the provisions of this ordinances, repealed. Section 17. That if any section of this ordinance or any clause or any part of any such section shall be held unconstitutional or void for any reason, all other sections, clauses or parts of this ordinance shall remain in full force and effect irrespective of any such holding or decision, it being the intention to adopt each section, clause or part of this ordinance inddpendently of any other section, clause or part thereof. 6 Section 18. That this ordinance shall take effect and be in full force and effect from and after its publication once in the official city paper. Introduced for first reading January 25th, 1926.
