An Ordinance providing for the issuance of Improvement Bonds of the City
of Salina, Kansas, in the sum of $13,776.29 to pay the cost of
improving certain streets in said City.
WHEREAS; in pursuance of proceedings duly had according to law,
contracts have been let and performed for the:
Curbing, guttering, excavating, grading and surfacing with
sand clay Jewell Avenue in the City of Salina, Kansas, from
the east line of Santa -Fe Avenue to the west line of Osborne
Street in said City:
Curbing,and guttering Baker Street in the City of Salina, Kansas,

Avenue in said City:
Curbing and guttering Phillips Street in the City of Salina,
Kansas, from the scu th line of Was ington Avenue to the no rt4
line of Morrison Avenue in said City;
Curbing and guttering Washington Avenue in the City of Salina,
Kansas, from the west int o eventh Street to the east line
of Phillips Street;
Curbing and guttering 'Twelfth Street in the city of Salina,
Kansas, from the south line o aszi.ngton Avenue to the north
line of Prescott Avenue in said City;
Curbing and guttering Prescott Avenue in the City of Salina,
Kansas from the west line of E eventh Street to the east line
of 'Twelfth Street in said City;
Curbing and guttering, excavating, grading and paving Thirteenth
Street in the City of Salina, Kansas from the south line o

Curbing and guttering Third Street in the City of Salina,
Kansas, from the southlineo Iron Avenue, thence south to
the Smoky Hill River in said.City;
Excavating and grading and surfacing with sand clay Prescott
Avenue in the City of Salina, Kansas_from the west 1 ni—e—
leventh Street to the east line of 'Twelfth Street in said City;
and
WHi;;F�EAS, tke total cost of said improvements has been ascertained
and the portion thereof to be paid by a general tax to be levied upon all
of the taxable property within said City for the improvement of squares
and areas formed by the crossing of streets and alleys for which bonds
are to be issued as herein after provided, has been ascertained and is
hereby determined and found to be the sum of $2,450.280 and;
WHEREAS, the portion thereof to be paid by special assessments
levied upon the lots and pieces of ground liable therefor has been ascer-
tained and is hereby found and determined to be the sum of $12,059.00,
which said last amount has been heretofore duly assessed and apportioned
to the several lots and pieces of ground on such streets liable therefor,
payable in ten equal installments according to law and as provided in
ordinances of the City of Salin@., Kansas, duly passed and approved, and;
WHEREAS, the amount of said special assessments for which
bonds are to be issued as herein provided in anticipation of said special
assessments which remain unpaid has been ascertained and is hereby
determined and found to be.the sum of $llj326.01, the difference between
said last two named amountw having been paid by the property owners of
said above named streets whose property has been -discharged from any
further assessments for the cost of said improvements in the amount so
paid, N0W THEREFORE,
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansa
Section 1 That the cost of such improvements, after deducting
therefrom the assessments heretofore paid thereon as aforesaid, includ-
ing the cost of the improvements of the squares and areas formed by
the crossing of streets and alleys and of City property, shall be paid
in ten substantially equal annual installments instead of levying the
entire cost at one time; the first installment of which is to be paid
with the taxes for the year 1926 a n3 one installment with the taxes
for each suddeeding year thereof until the whole amount thereof shall
have been paid and that for such improvements there shall be and are
hereby issued Improvement Bonds of the City of Salina, Kansas, in the
aggregate sui;j of 613,776.29.
Section 2. Said issue of bonds shall consist of twenty (20)
bonds all bearing interest at the rate of Four and Three-quarters per
cent (4-3/4%) per annum, interest payable semi-annually on the 1st
days of November and May of each year after the date of said bonds;
except that the first interest payment as hereinafter described shall
be due and payable on the let day of November 1926, and thereafter
alliinterest shall be payable semi-annually as above provided for. All
of said bonds shall be dated November 1st, 1925.
Said bonds shall be numbered, the amount due each year and
the date of maturity of said bonds shall be as follows:

Section 3. Said bonds shall be signed by the I:4ayor and attested
by the Clerk of the City of Salina, Kansas and shall have the corporate
seal of said City attached therc;to. Interest.coupons to said bonds shall
be signed by the lithographed signatures of said Mayor and Clerk and both
bonds and coupons shall be paid at the fiscal agency of the Stat& of
Kansas in the City of Topeka, Kansas.
Section 4. Said bonds shall be executed in the form and shall
contain recitals substantially as follows:

KNOW ALL MEN BY THESE PRESENTS: That the City of Salina, in the
County of Saline, State of Kansas, for value received hereby acknowledges
itself to be indebted and promises to.pay tht bearer the sum of
1 in lawful money of the United States of America
on the first da—y--o November 19 , with interest thereon from the date
hereof at the rate of four and gree -quarters per cent (4-3/4%) per
cent per annum, payable semi-annually on the first days of May and
November of -each year after the date hereof until the said principal
sum shall have been paid, (except that the first interest coupons shall
become due on November 1st, 1926) upon presentation and surrender of
the interest coupons hereto attached, bearing the lnthographed signatures
of the Mayor and City Clerk of said City, as said coupons severally
become due; both principal and interest of this bond being payable at
the office of the State Treasurer in the City of 'Topeka, Kansas. And
sadd City of Salina In the State of Kansas is held and firmly bound
by these presents, and the full faith, credit and resources of said
City are hereby irrevocably pledged for the prompt payment of said prin-
cipal and interest at maturity.
THIS BOND is one of a series of 20 bonds of like date and tenor,
except denomination and maturity, aggregating the principal sum of
$13,776.29 issued by the City of Salina, Kansas, for the purpose of
paying the cost of improving certain streets in said City by the author-
ity of and in full compliance with the provisions, restrictions and
limitations of the Constitution and Yaws of the State of Kansas, includ-
ing Sections 10-101 to 10-115 and Sections 12-601 to 12-610 and Section
13-1011 of the Revised Statutes of.K.ansas 1923, and all other provisions
of the laws of said State applicable thereto and this bond and all other
bonds of said series and all interest thereon are to be paid by said
City of Salina, Kansas.
AND IT IS HEREBY DECLAR__,D AMID CERTIFIED, that all acts, conditions
and things required to be done and to exist precedent to and in the
issuance of this bond, have been done and performed and do exist in due
and regular form and manner and that the total indebtedness of said City,
including this series of bonds does not exceed any constitutional or
statutory limitation.
IN WITNESS WHEREOF, the saie .City of Salina in the State of Kansas by
its Board of Commissioners has caused this bond to be signed by its
Mayor and its corporate seal to be. hereto affixed, attested by its City
Clerk, and the coupons hereto attached to be signed with the litho-
graphed signatures of said officers and this bond to be dated this first
day of November 1925.

Section 6. The Mayor and City= Clerk are hereby authorized,
directed and empowered without unnecessary delay, to prepare and
execute said bonds, and coupons as in this ordinance provided
and when executed, said bonds shall be registered with the City Clerk
of the Cit -y of Salina, Kansas and with the Auditor of the State of
Kansas as required by law, and shall be by the Mayor of said City
delivered to the contractor or contractors constructing such im-
provements in proportion to the amounts due each contractor or
contractors in payment of the amount due them for such work and
improvements; PROVID_r,D, however that such bonds shall not be sold
or delivered to such contractor or contractors at less than par
value thereof nor in a greater surd or amount than the whole amount
due to said contractor of contractors under their respective con-
tracts with said City, or the Board of Commissioners may sell sAid
bonds at not less than their par value and out of the proceeds there d'
pay said contractor or contractors for said work_ and improvements.
Section 7. Said Board of Commissioners ahll make pro-
visions for the payment of the principal and interest on said bonds
as the same become due and payable by levying a tax on the property
liable therefor.
Sect -ion S. This ordinance shall take effect and be in full
force from and after its publication once in the official City paper.
