3191 Creating a Water Works Advisory BoardAn ordinance creating and relating to the Water -Works Department of the City of Salina, Kansas, creating a Water Works Advisory Board, defining the duties thereof, creating and providing for certain officers and employees thereof and regulating the management thereof, establishing rates, rules and regulations for the govern- ment of tomsiamers and others concerned, providing for the collect- ion and disbursement of revenues and for the protection of water- works equipment, prescribing penalties for the violation of any section hereof and repealing all.ordinances and parts of ordin- ances in conflict herewith. BE IT ORDAINED.by the Board of Commissioners of the City of Salina, Kansas: Section 1. CONTROL. That there be and there is hereby created in the City of Salina, Kansas, a department to be known as "The .Water Works Department of.the City of Salina" which shall hereafter in this ordinance be referred to as the "Department"; which in accordance with the provisions of this ordinance shall have the control and management of the system of water works now owned or hereafter owned by the City of Salina.. The Board of Commissioners of the City of Salina shall, through the officers and employees of said department as hereinafter provided for, maintain, manage and conduct said Water Works Department. Section 2. WATERWORKS ADVISORY COMISSION. That there be and there is hereby created a Commission to be known as "The Water Works Advisory Commission",which.--shall consist of five members who shall serve without compensation, and who shall be appointed by,the Board of Comm- issioners of the City of Salina. Of the members first appointed two shall serve for a period of one year from the first day of January of the year of their appointment, two for two years from slid date and one for three years from said date. At the expiration of such terms, members shall be appointed to fill the vacancies caused by such expiration for a term of three (3) years; and any eacancy caused by death, resignation or otherwise than by the expiration of a regular term shall be filled by appointment for the unexpired term only. Such Commission shall elect a President and Secretary and shall provide its own rules of order, and it shall be the duty of such commission to consult with and advise the Board of Commissioner of the City of Salina with reference to the operation of the Water Works System of the City of Salina, and to make such reoommendations as it may deem necessary or proper for the conduct and operation of such waterworks, and it shall meet with said Board of Commissioners at least once a month for such purpose. Section 3. OFFICERS AND EMPLOYEES. That there be and there are hereby created certain offices in said Department as follows, topwit: (a) Consulting Engineer.. The City Engineer of the City of Salina shall be, ex -officio, the consulting engineer of the Water Works Depart- ment. The duties of .such Consulting Engineer shall be to consult with and advise the Board of Commissioners and the Superintendent of the Water Works Department on all technical matters in connection with the operation, extension and management of said water works system and plant, and to supervise and inspect from time to time the said water works system and plant and make such reports and recommendations witli reference to the operation, repair or replacement of the same as he deemd necessary,.and to design and supervise the installation of any new improvements or extensions in or to said water works system and plant. (b) Superintendent. The Superintendent of the Water Works Department, hereinafter referred to as the Superintendent, shall, under the direction of the Board of Commissioners, have charge of said Water Works and all property connected therewith and shall ,manage and control the same. He shall inspect all parts of said Water Works and see that they are maintained in good condition for use, and that all employees of the Department attend to their respect- ive duties. he shall keep in good repair the pumps, hydrants, and other water works property. All other officers and employees, ser- .vants and agents of said Department when appointed by said Board other than the Consulting Engineer hereinabove provided for, shall be under the.immediate control and managament of said Superintendent. The Superintendent shall perform all such other duties as may be .. prescribed by said Board of Commissioners by ordinance or resolution. (c) Secretary. The Secretary of the Water Works Department, who shall also be Cashier, shall under the direction of the Superin- fendents keep a regular set of books for Water Works accounts showing in detail the business transactions of such Department. He shall, under the direction of the Superintendent, have general supervision .and charge of office employees of said Department. At the beginning of each month it shall be the duty of the Secretary to strike a trial -balance and make a complete report to the Board of Commissioners showing the transactions of the preceding month and the financial condition of the Water Works Department, which report shall also ::,include a correct account of a1L'coYle'etions, appropriations, and ,expenditures and approved claims entitled to payment. (d) The Board of Commissioners shall appoint such other employ- ees,as shall be necessary for the proper, ope ration of said Water Works.' (e) The officers and employees herein above provided for shall be appointed by the Board of Cotnnissioners and shall hold office aw employment until removed for cause. All such officers and employees shall receive such compensation as may be hereafter provided by ordinance. The Superintendent and Secretary shall each give good aamd sufficient surety company bonds to the City each in the sum of x$5,000.00 to be approved by law for the faithful performance of their duties and for a true and faithful accounting of all monies that may come into their hands by reason of thei3r position. Section 4. FINANCES. All revenues derived from the sale and from the operation and management of the Department shall be deposited daily in the City Treasury to the credit of the Department and shall be kept in a separte fund to be known as the Water Works Department Fund,and all warrants for expenses of operating, improvement, extending and maintaining said system and for interest on or for repayment of principal of waterworks bonds shall be drawn on such fund. In addition to customer's accounts, etc., there shall be kept a set of cost books and records complete enough to show the cost of producing and distribut- ing water and repairing and maintaining the water works plant and equip- ment, and such other items as shall be necessary for the intelligent management of the department. Interest on and amortization of outstand- ing indebtedness of the water department, and a charge to cover th0 depreciation of the water works plant and equipment, shall be included in the cost of water at the tap as shown W the cost account. Separate reserves shall be established for interest, sinking funds, repairs and depreciation and the proper',amounts appropriated monthly to such reserves. If, at any time, the,revenues of the water department are not sufficient to pay all such charges, the amounts not paid shall be appropriated from future revenues or surplus of the department. The accumulations of the depreciation reserve shall be used for replacement of worn out or obsolete plant or equipment,zandnmay be temporarily invested in water works extensions or improvements but all monies so invested shall be returned to the depreciation reserve, with aedrued interest, from the revenues of the department. Section 5. RULES. The rates, rules and regulations herein established shall be considered a part of the contract with every person, firm and corporation supplied with water by and through the water works system, either within or without the corporate limits of the City of Salina. Such person, firm or corporation, by applying for and accepting water shall be held and eonsidered.as.consenting to be bound thereby, qnd in case of violation of any rules or regulations in force or upon fail1re to pay any charges,or penalties herein provided for, the water may be out off from the premises or place of violation and not turned on again except by order of the Superintendent of the Water Wprks Department after satisfactory assurance that there shall 1B no further cause for complaint and upon payment of any such charges. Section 6. APPLICATIONS. Any person.making proper application and complying with the requirements herein set forth shall be supplied with water by the Department providing his property adjoins a water main or distributing pipe. All applications for water shall be on a form to be furnished by the Department and shall be signed by the person making such application and shall state the location of i the premises for which water is to be furnished and all purposes for which water is required, and any other information required by the Department. Unless such application be signed by the owner, or the authorized agent of the owner of the property to be supplied, suds i ppplieation must be accompanied by a dash deposit of not less than Two ($2.00) Dollars as security tr the payment of bills and services rendered of any charges property assessed against said premises as provided for herein, Provided" that the'amount of deposit so required shall be increased to an amount equal to double the estimated monthly water bills for such premises and any applicant shall, upon demand of the Superintendent, increase such deposit when, if in the opinion of such Superintendent, such increase0. may be necessary. Whenever such application is made by any person other than the owner of the property or the authorized agent of such owner, the applicant shall secure the written consent of such owner or agent to the furnishing of water to such premises and to such applicant in accordance with the rules and regulations herein provided for. Such deposit shall be in a separate account showing the name of the depositor, the amount thereof and the date on which any such deposit is received. Such deposit may be applied to the payment of any accrued bills or charges or any such bills or charges due on discontinuance of service and any such deposit not so applied shall be payable as provided by law on demand of the depositor after discontinuance of service. Section 7. TAPS: The Department shall tap all mains or dis- tributing pipes, inserting a corporation cock and furnishing the union for the connection to the service pipe. The charge for each tap shall be Four (04.00) Dollars 'for three-quarter (3/4) inch corporation cock and Six ($6.00) Dollars for one (1) inch corporation cocks, to be paid to the water department when the tap is ordered. Section 8. SERVICE PIPES. All service pipes must be. of cast iron, lead or brass between t#e corporation cock and the stop_keoek;: and all tees, valves or other fittings shall be of cast iron or brass. All pipe must be double extra heavy lead pipe, cast iron or brass pipe of approved composition and weight. No services of less than three-quarter (3/4) inch pipe shall be installed. At the point of connection with the corporation cock the lead pipe shall be bent in an "S" or other form to allow for movement of the pipe. All service pipes shall be Uid at least three feet below the surface of the pavement or sidewalk and be so protected as to prevent rppture from freezing or damage from other causes. Each service shall be furnished with a round way, tee handle, brass curb cock, located not more than eight inches from the curb, provided that the superintendent may direct or permit the curb cock to be placed in a different location where he deems it necessary or advisable and provided that where more than one consumer is served through a single servile pipe,' a curb cock and stop boxImV L ovided for each branch of such service. A stop and waste cock shall be provided X vvt��9�y on the.premises'' be used by the consumer for shutting off the water �o avoid damage or waste of water in case of accident or cold weather. All such service pipes and all other cocks, tees, valves and other fittings shall be installed by the owner of the premises to be supplied, in accord- ance with the provisions of this ordinance and any other ordinances of the City of Salina now or hereafter in effect and shall be and remain the property of such owner, but no part of the same which lies in any street or public property shall be removed except in accordance with ordinances of.the City of Salina then in force and in accordance with the rules and regulations of the.Street Department and the Water Works Department of said City. On streets where paving has been or is ordered to be laid, old service pipes other than leas or brass pipes must be replaced at the expense of the property owner. When service pipes are laid only to tine curb for future use, the end of the pipe must be securing capped of plugged and a curb cock and service box installed. Section 9. CARE OF SERVICE LINES: All consumers shall keep their own fixtures, service lines, and curb cocks in good repair and protected from frost at their own expense, and shall prevent all un- ndcessary waste of water, keeping all fixtures closed when not in use. It -is expressly stipulated that no claim shall be made against the City of the Water Works Department bedause of any break in the servio3 of any damage arising from the cutting off of water to repair mains, make connections, or for any other purpose, that becomes necessary; the right is hereby reserved to cut off water at any time when deemed necessary. Defective service lines must be promptly repaired; other- wise the water may be shut off at the main, notice having first been given, and_the cost charged against the service. When it becomes necessary for repairs to be made to service lines between the main and the curb cock, or when curb cocks -,are broken or cannot be closed, service boxds are misplaced, filled with debris or require new lids, or when other repairs or replacements are necessary to the proper operation of the system or to prevent waste of water, reasonable efforts shall be made to notify, the owner or party liable for the expense and to induce him to make the necessary repairs or alter- ations; but in cases where.;. after reasonable effort, it is found impossible or impracticable to notify the owner or party liable, or where the owner or party liable fails or refused to have the necessary repairs made within a reasonable length of, time, or where an, emergency does not permit the necessary delay in finding the owner or party liable, then the Water Works Department shall make such repairs or alterations -as are necessary and charge the actual cost of labor and material involved, plus 25% for overhead expenses,. against the proper'Yy•serveds and the same shall be colledtible in the same manner as monthly water bills. No service lines shall be abandoned without first having been shut off and capped or plugged at the corporation cock at the expense of the property owner. Section 10. METERS. All water sold by the Department shall be measured by -meter. All meters shall be furnished by the Departmert and installed without test :fo the consumer. The meters shall be located adjacent to the curb cock where practicable in a meter box to be, furnished by the Department at thee xpense of the consumer, and otherwise at such point as the Superintendent shall direct. The owner shall leave a gap in the service line of proper size to accomodate .the meter and connections furnished by the Water Works Department and shall leave sufficient room about the meter for the installation of a meter box in case the meter is placed outside the buildings. No person shall molest, injuuee or in any way interfere with any water meter, meter box or cover, or anything appertaining thereto, and no pewon shall deposit dirt, stone or rubbish of any nature in any meter box or service box. The occupant of any building or premises where a meter is located shall keep the meter free from all obstructions so that it is at all times conveniently accessible for reading, inspecting or repairing. The Superintendent, or persons authorized by him, may enter at any reasonable hour any premises supplied with water in order to in- spect or repair meters, pipes or fixtures or to investigate the use of water. Where a meter is located in an approved meter box or housing in the parking or sidewalk, the consumer or owner of such property in which such meter is placed shall be responsible for its protection and preserv- ation and any damage sustained by such mwter shall be charged to the consumver or owner of the property served in the same manner as preseribed for repairs bu service lines. Whenever a meter is damaged by hot water or steam or by improper method of thawing when frozen, the cost of the repairs shall be chargeable to the property in the same manner as pre- scribed for repairs to services. In case any meter fails to register for any cause, the amount charged for water during such period shall be estimated by the Superintendent, such estimate to be based on the average amount registered during a like preceding period and such other informatioi as is available. Section ll. USE. Patrons shall not allow water to be taken from the premises nor permit any connection being -made to his service line without first obtaining written permission from the Superintendent. Water shall be usedonly on the premises to which the service is extended, and not more than one consumer shall receive water through a single meter except by special written permission of the Superintendent. Section 12. RATES: The following are hereby established as the meter rates which consumers of water shall pay for water furnished them by the Water Works Department of the City of Salina: First 25,000 gal. per month $0.30 per thousand gal. Next 35,000 2.25 Next 250000 " if it - 0.20 " " " Next 15,000 " " it 0:15 " " All over 100,000 gal per.month 0.10 " it Special contracts may be entered into, when approved by the City Commissionera, with large users of water,•granting special rates where the quantity of water used and the conditions of service justify, but no such contract shall cover, a period of more than one year.. The min- imum charge for regular consumers shall be,$1.00 per month where water is furnished through a.five eighths inch meter; provided however, that consumers shall.have the option of e.nterint into contracts for water for theperiod of one year in which case the minimum charge shall be $12.00 per year payable in advance for which the consumer shall be A entitled to receive 40,000 gallons of water during the year and all water used in excess of that amount during such year shall be charged at the uniform rate of thirty cents per 1000 gallons. Section 13. ACCOUNTS: All meters shall be read as nearly as practicalbe on the last day of the month and bills shall be rendered by the first day of the month following. All bills shall be payable on or before the tenth day of the month in which the bill is rendered, and if any person, firm or corporation shall fail to pay his water bill on or before the tenth day of said month, a penalty of ten (10%) per cent of the amount of the bill, in no event less than twenty-five cents, shall be added and collected. If any person, firm or corporatin shall fail to pay his water bill on or before the twentieth day of z '. said month, service shall be discontinued and water shall be shut off from the premises until all unpaid water bills and penalties shall have been paid, together with an additional charge of One($1.00) Dollar to cover the cost of shutting off and turning on the water re- gardless of any change in occupancy or ownership. The Superintendent shall have authority to make corrections or refunds of overpayments or improper-'Witer bills due to error in the Water Works Department, but shall have no authority to remit or diminish bills for any other reason. Section 14. CONSUMERS. The consumer, as referred to in this ordinance, skull be the party receicing water or service for a proper tymlassified as follows: First, an apartment or a building under one roof, occupied by one business or residence; Second, a combination of buildings, owned by one party, in a common enclosure, used for one residence or business; Third, the one side of a double house having a solid vertical partition wall; Fourth, a building owned by one party, having a number of offices, or sleeping or living rooms (not including apartments designed for occupancy by a separate family) a using in common one hall andone or more means of entrance. Where by special written permission of the Sup-rintendent more than one consumer is permitted to obtk.in water through a single ,i;eter, a minimum charge at the uniform rate of 30 cents per thousand gallons even though the con- sumption exceeds 25,000 gallons per month. Section 15. UNLAWFUL USE OF WATER. It. shall be unlawful for any person to take or use water from the waterworks of the City of Salina without, notice -bo the Department and without p$yment for the scone as provided by the rules and regulations herein contained. No person shall turn on or shut off the water at any valve, curb cock, corporation cock or other places regulating the supply of water to any premises or part of the waterworks system except duly authorized employees of the Depart- ment -or persons authorized to do so by the Superintendent; provided how- ever, that any licensed plumber may turn on or shut off water for the purpose of testing his work but he shall leave the valve or curb cock in the same position in which he found it. Section 16, WATER FOR CITY DEPARTMENTS. All water used by any city department for any purpose whatsoever, excepting only that used by the Fire Department for extinguishing fires, shall be measured and charged for in the same manner as water used by private consumers at a fate to be fixed by the Board of Commissioners. Where it is impract- icable to meter the water so used, it shall be estimated by the Super- intendent. Section 17. HYDRANT RENTALS. To cover the cost of furnishing and maintaining fire hydrants, fire mains and water for extinguishing fires an annual hydrant rental shall be paid to the Water Works Department by the City of Salina in such sum as the Board of Commissioners may hereafter determine. For all fire hydrants located in water mairs outside the limits of the City of Salina, the person for whose benefit such fire h#drants are installed shall pay a fire hydrant rental.of 460.00 per annum per hydrant which shall be payable quarterly in advance. No fire hydrant shall be connected to any water main outside of the city of Salina without notice and without securing permission from the Super- intendent and no such hydrant shall be or remain connected to any such water main unless the rental due thereon shall be paid within ten days after the same becomes due. Section 18, PENALTY. Any person, firm or corporation who shall violate any of.the provisions of this ordinance shall, upon conviction thereof, be fined in any sum not less than $25.00 nor more than $100.00 for each offense, and in case of continued viol- ation each day during which such violation continues shall be and constitute a separate offense. 'lection 19. EFFECT. This ordinance shall take effect and be in force from and after the acquisition by the City of, Salina of the title and right to possession of the Water Works System and plant of the Salina Water Works Company and after its due'publica- tion in the official city paper. The accumulations of the depreciation reserve shall be used for replacement of worn out or -',obsolete plant or equipment, and may be temporarily invested in water works extensions or improvements but all monies so invested shall be returned to the depreciation reserve,, with accrued interest, from the revenues of the department. The rates, rules and regulions herein established shall be considered a part of the contract with every Person, firm and copporation supplied-; with water'by and through the waterworks system, either within or without the corporate limits of the OitY of Salina. Such person, firm or corporation, by applying for and accepting water shall be held and considered as consenting to L, be bound thereby, and in case of violation of any rules or regulatians in force or upon failure to pay any charges or penalties herein provided for, the water may be out off from the premises or place of violation and not turned on again except by order of the Superintendent of the 0 water 11vorks Department after satisfaebbry assuranxie that there shall be no further cauxe for complaint and upon payment of ang such charges. Section 6. APPLICATIONS. Any person making proper application and complying with the requirements herein set forth shall be supplied with water by the Department providing his property adjoins a water main or distributing pipe. All applications for water shall be on a form to be futnished by the Department and shall be signed by the person making such application and 'shall. state the location of the premises for which water is to be furnished and all purposes for which water is required., and any other information required by the Department. Unless such application be signed by the owner, or the authorized agent of the owner of the property to be supplied, such application must be accompanied by a cash deposit of not less than `�!'wo(3 .00) Dollars as security for the payment of bills and services rendered of any other chargesLL properly assessed against said premises as provided for herein, provided that the amount of deposit so required shall be increased to an amount equal to double= the estimated month):y water bills for such premises and any applicant shall, upon demand of the Superinten- dent, increase such deposit when, if in the opinion of such Super- intendent, such increase may be necessary:, I'v'henever such application is made by any person other than the owner of the property or the authorized agent of such owner, the applicant shall secure the written consent of such owner or agent to the furnishing of Mater to such premises and to such applicant in accordance with the rules and regulations herein provided for. Such deposits shall be in a separate account showing the name of the depositor, the amount thereof and the date on which any such deposit in received. Such deposit may be applied to the payment of any accrued bills or charges or any such bills or charges due on discontinuance of service and any such deposit not so applied shall be ppcyable as provided by law on demand of the depositor after discontinuance of .service. Section 7. T-P,,tS: The Department shall tap all mains or distributing pipes, inserting a corporation cock and furnishing the union for the connection to the service pipe. The charge for each tap shall be Four 04.00) Dollars for three-quarter (3/4) inch corporation cock and Six ($6.00) Dollars for one (1) inch corporation cocks, to be paid to the water department when the tap is ordered. 4 11 Section S. SEFRVICE PIPS: All service pipes must be of cast iron, lead or brass between the corporation cock and the stop cock:, and all tees, valves or other fittings shall be of cast iron or brass. All pipe must be double extra %heavy lead pipe., cast iron or brass wipe of approved composition and weight. No services of less than three-quarter (3/4) inch pipe shall be installed. At the I point of connection with the corporation Bock the lead pipe shall be bent in an "S" or other form to allow for movement of the pipe. All service pipes shall be laid at least three feet below the surface of the pavemen ¢fir Id eivalk and be so protected as to prevent rupture from freezing or k"'a f��oi �ather causes. �'ach. service shall be furnished with a round way t dle, grass curb cock, located not more than eight inches frog he'-c,_urb, provided that the superintendent may, direct or permit the curb cock to be placed in a different location where he deems it necessary or advisable and provided that where more than one consumer is served through a single service pipe, a curb cock and stop box -must be provided for each branch of such service. The curb cock shall be protected by an approved service box reaching from the pipe to the surface. The tee handle of the curb cock shall stand parallel to the curb when shut. e stop and waste cock shall be provided on the premises to be used by the consumer for shutting off the grater to avoid damage or waste of water in case of accident or cold weather. All such service pipes and all other cocks, tees, valves and other fittings shall be installed by the oi,,ner of the premises to be supplied, in accordance with the provisions of this ordinance and any other ordinance of the City of Salina nor or hereafter in effect and shall be and remain the property of such owner, but no part of the same which lies in any street or public property shall be removed except in accordance with ordinances of the City of 0 a Salina then in force and in accordance with the rules and I regulations of the Street Department and the "Sater 10orks Depart- ment of said City. On streets where paving has been or is ordered to be laid, old service pipes other than lead or brass pipes must be replaced at the expense of the property owner, When service -pipes are laid only to the curb for future use, the end. of the .pipe must be securely capped or plugged and a curb cook and service box installed. ection 9, CARE OF SERVICE LT JINES: All consumers shall keep there own fixtures., sdrvice lines, and curb cocks in good repair and protected from frost at their own expense, and shall -prevent all unnecessary waste of water, keeping all fixtures closed when not in use. It is expressly stipulated that no claim shall be made T-' against the City or the dater Corks Department because of any break in the service or any damage arising from the cutting off of water to repair mains, make connections., or for any other purpose, that becomes necessary; the right is hereby reserved to cut off water at any time when deemed necessary. Defective service lines must be promptly repaired; otherwise the water may be shut off at the main., notice having first been given., and the cost charged against the service. INhen it becomes neceesary for repairs to be made to service lines between the main and the curb cock, or when curb cocks are broken or cannot be closed., service boxes are misplaced., filled with debris or require new lids, or when other repairs or replace- ments are necessary to the proper operation of the system or to prevent waste of water, reasonable efforts shall be made to notify the owner or party liable for the expense and to induce him to make the necessary repairs or alterations; but in cases where, after reasonable effort, it is found impossible or impracticable to notify the owner or party liable., or where the owner or party liable fails or refuses to have the necessary repairs made within a reasonable length of time, or where an emergency does not permit the necessary delay in finding the oiriner or party liable, rhea the "ater -Viorks Department shall make such repairs or altera- tions as are necessary and charge the actual cost of labor and material involved, plus 25' for overhead expenses, against the property servied, and the sane shall be collectible in the same manner as monthly water bills. No service lines shall be abandoned without first having been shut off and capped or plugged at the corporation cock at the expense of the property owner. Section 10. IIETERS: All water sold by the Department shall be measured by meter. All meters shall be furnished by the Department and installed without cost to the consumer. The meters shall be located adjacent to the curb cook where practic- abld" by the Department at; the expense of the consumer, and otherwise at such point as the Superintendent shall direct. The owner shall leave a gap in the service line of proper size to accomodate the meter and connections furnished by the I -Vater fforks Department and shall heave sufficient room about the meter for the installation of a meter box in case the meter is placed outside the buildings. No person shall molebt, injure, or in any way interfere with any water meter, meter box or cover, or anything appertaining thereto, and no person shall deposit dirt, stone or rubbish of any nature in any meter box or service box. The occupant of any building or premises where a meter is located shall keep the �1 ,qe t e r free from �7*'obstructions so that it is at all times con- veniently accessible for reading, inspecting or repairing. The Superintendent, or persons authorized by him,, may enter at any reasonable hour any premises supplied with water in order to inspect or repair meters,, pipes or fixtures or to investigate the use olf water. i� ;'here a meter is located in an approved meter box or housing in the parking or sidewalk', the consumer or owner of such property in uhich such Meter is placed shall be responsible for its protection and preservation and any damage sustained by such meter shall be charged to the consumer or owner of the property served in the same manner as prescribed for repairs to service lines. 'rhenever a meter is damaged by hot .rvra t er or steam or b�yr impr open method of thawing when frozen, the cost of the repairs shall be chargeable to the property in :the same manner as prescribed for repairs to services. In case any meter fails to register for any cause, the amount charged for water during such period shall be estimated by the Superintendent, such estimate to be based on the average amount registered during a like preceding period and such other information as is available. Section. 11. USE: Patrons shall not allow grater to be token from the premises nor permit any connection being made to his service line without first obtaining written permission from. the Superintendent. "later shall be used only on the premises to which the service is extended, and not more than one consumer shall receive water through a single meter except by special written permission of the Superintendent. All bills shall be payable on or before the tehth day of the month in which the bill is rendered,, and if any person, firm or corporation shall fail to pay his water bill on or before the tenth day of said month, a penalty of ten (101%6;� per cent of the amount of the bill, in no event less than twenty-five I cents, shall be added and collected. Section 14. ("JONKMElitS. The consumer., as referred to in tids ordinance, shall be the party receiving water or service for a property classified as follows: First, an apprtment or a building under one roof, occupiedbyone business or residence; Second, a combination of buildings, owned by one party, in a commori, enclosure, used for one residence or business; Third, the one side of a double house having q solid vertical partition wall; Foubth; a building owned by one party, having a number of offices, or sleeping or living rooms (not including apartments designed for occupancy by a separate family) using in common one hall and one or more means of entrance. Where by special written permission of the Superintendent more than one consumer is permitted to obtain water through a single meter, a minimum charge at the uniform rate of 30 cents per thousand gallons even though the consumption exceeds 25,000 gallons per month* Section 15, UN'LAATFUL USE OF INATER. It shall be unlawful for any person to take or use water from the waterworks.of the City of Salina without notice to the Department and without payment for the same as provided 'Ey the rules and regulations herein contained. No person shall turn on or shut off the water at any valve, curb cock, corporation cook or other places regulating the supply of water to any 0 r I premises.or.part of the waterworks system except duly authorized employees of the Department or perso:hs authorized to do so by the Superintendent; pr6vided howdver, that any licensed plumber may turn on or shut off water for the purpose of testing hIs work but he shall leave the valve or curb cock in the same position in which he found it. Section 10, ,,.ATER FOR PITY DEPARTMENTS. All water used by any -city department for any purpose whatsoever, excepting only that used I by the wire Department for extinguishing fires., shall be measured and charged for in the same manner as water used by private consumers at a rate to be fixed by the BoarA of Commissioners. 17here it is impracticable to meter the water so used, it shall be estimated by the Superintendent. Section 17. HYDRANT RENTALS. To cover the cost of furnishing and maintaining fire hydrants, fire mains and water for extinguishing; fires an annual hydrant rental shall be paid to the Water 'Norkd Department by the City of Salina in Oileh sum as the Board of' Commissioners may hereafter determine. For all fire hydrants located in water mains outside of the limits of the City of Salina, the person for whose benefit such fire hydrants are instilled shall pay a fire hydrant rental of ��60,00 per annum per hydrant which shall be payable quarterly in advance. No fire hydrant shall be connected to any water -main -outside of the city of Salina without not -ice and without securing permission from the Superintendent and no such hydrant shall be or remain connected to any such water main unless the rental due thereon shall be paid within ten days after the same becomes due. Section 18. PENALTY. Any person, firm err corporation who shall violate any of the provisions of this ordinance shall, upon conviction thereof, be fined in any sun not less than X25.00 nor more thani,�,100.00 for each offense, and in case of continued violation each day during which such violation continues shall be and constitute a separate offense. �j 0 Section 19.
