3187 Levy Assessments9 W An Ordinance relating to and apportioning and levying special assess- ments on certain lots and pieces of ground in the City of Salina, Kansas, -to pay the cost of curbing and gutteting Prescott Avenue in the City of Salina, Kansas, from the west line E"leverith Street to the east line.of_Twelfth"Street in said City, and relating to and providing for the collection and payment of such assessments. BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF SALINA, KANSAS: Section 1. For the purpose df paying for the cost of curbing and guttering Prescott Avenue in the City of Salina, Kansas, from the west line of Eleventh Street to the east line of Twelfth Street in said City, there are hereby levied and assessed on the property liable therefor, being all of the lots and pieces of ground laying on either side of said-oPrescott Avenue for the distance improved as aforesaid to the. center of the block, according to the appraised value of such lots and pieces of ground without regard to the buildings or improvements thereon, special assessments covering.the cost of such work and improvements, said special assessments being based on the special valuation and appraisement of said lots and pieces of ground heretofore made by three disinterested appraisers appointed by the Board of.Commissioners of the City of Salina, Kansas, which said appraisement is hereby referred to and made a part of this ordinance, and the several amounts levied, apportioned and assessed against such lots and pieces of ground for the purpose aforesaid are hereby found and determined to be as follows: PRESCOTT AVENUE FROM TWELFTH STREET TO ELEVENTH STREET. Said amounts, levied, apportioned and assessed as aforesaid, shall_.be due and collectibe in.ten equal installments, the first becoming due with thb taxes levied for the year 1926 and one of said installments falling due each and every year thereafter untillall are paid, and all to be collected with interest as in this ordinance provided, PROVIDED, that the owner of any piece of property liable for any such from assessment may redeem his property/such liability by paying into the City Treasury the entire amount chargeable against the same, as in this ordin- ance �lesighatedgtat.npny time within thirty days after the publication of this ordinance and before the issuance of the bonds of said City in paydient of the balance of said impavvements, and his property so paid on shall not thereafter be liable for any further assessments for the cost of said im- provements, nor for any part of said bonds. Section 3. There is hereby further levied and assessed against each lot and piece of ground described in this ordinance 4-3/4% interest per annul on all of said installments therein mentioned from the date of the bonds, which may be issued at the end of thirty days, as specified in the preceding section hereof, as by law provided to the time of collection of the last installment, as provided b� law, which said interest shall be collected annually at the same time and in the same manner as said install- ments are collected; and after the taking effect of this ordinance it shall be the duty of the City Clerk of said City to annually at the same time other taxes are certified, and until all of said assessments so apportioned and levied herein have been certified, to certify to the CoUtnty Clerk of Saline County, Kansas, a full list of all property liable to assessment and taxation for such work and improvement except such property on which the special assessments aforesaid have been paid -in full as hereinbefore provide together with the respective amounts due on each of such lots and pieces of ground, which amounts shall include the annual installments of such special assessments together with the interest for one year at bhe rate of.4-3/4% inte°est per annum, on all unpaid balances of such assessments at the beginn ing of each year as aforesaid, and such amounts so certified as herein pro- vided shall be placed upon the tax soll by the County Clerk of Saline County Kansas, and collected as all other taxes are collected. Section 4c This ordinance shall take effeeg and be in full force from and after its publication once in the official City paper. Introduced for first reading November 16th, 1925. Said amounts., levied, apportioned and assessed I as aforesaid., shall be due and collectible in ten equal in- stallments., the first becoming due with the taxes levied, for the Year 1926 and one of sa id installments falling due each and every year thereafter until all are paid, and all to be col- lected with interest as in this ordinance provided; PROVIDED, that the owner of any piecl- of property liable for any such assessment may redeem his property from such liability by paying into the City I Ta-easury the entire amount chargeable I against the same, as in tris ordinance designated,, at any time V,iithin thirty days after: the publication of this ordinance and before the issuance of t'L,.-e bonds of said City in payment of the balance of said improvements', and his property so paid on shall not thereafter be liable for any further assessments for the cost of said improvements., nor for any part of said bonds.
