3179 Improving 13th StreetAn Ordinance specifying and selecting the material to be used and
letting a contract for the excavating'and grading, curbing,
guttering and paving of Thirteenth.Street ffom the south line
of Ash Street to the north line of State Street in the City
of Salina, Kansas.
Be It Ordained by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. That it is hereby determined that Thirteenth Street
in the City of Salina, Kansas, from the south line of Ash Street to
the north line of State Street in said City shall be paved with
vibro-lithic concrete pavement. Such surface shall be six inches
deep, and shall be 33 feet in width, excluding curb and gutter.
Section 2. That it is hereby determined that Thirteenth
Street in the City of Salina, Kansas, from the south line of Ash
Street to the north line of State Street in said City shall be curbed
and guttered with one piece combination cement curb and gutter.
Said combined curb and gutter shall be comprised of a curb six inches
thick at the top, six andone-half inches thick at the throat and
twelve inches thick at the throat and seven inches thick next to
the pavement.
Section .3. All excavat'tLng, filling and rolling necessary
for the proper construction of such improvements shall be done and
all of such improvements shall be made and done in strict conformity
to and'in compliance with the plans and specifications of the City
Engineer of the City of Salina, Kansas, and now on file with the
City Clerk of said City, which plans and specifications are hereby
incorporated In and made a part hereof in all respects as fully
and completely as though written out at length herein; which said
plans and specifications are hereby adopted as and for the plans ard
specifications of such work and improvements.
Section 4. That a contract is hereby awarded to L. W. Hexroad
for the curbing, guttering, excavating and paving the above mention al
street in the limkts aforesaid with the materials hereinbefore
sgoecified, for the curbing and guttering actually lAid and put in
place, for the labor actually performed and the materials actually
furnished at the following prices: For excavating and g radii, 600
per cubic yard; for -paving $2.15 per square yard; for Portland
Cement Concrete combined curb and gutter 750, ber lineal foot. All
of said work shall be paid for according to measurement made by the
City Engineer of the City of Salina. It is hereby found and deter-
mined that the prices to be paid for the improvements as aforesaid
are less than the prices of each and all of said improvements shown
by the sworn estimate of the City Engire er now on file with the City
Clerk of the City of Salina, Kansas.
Section 5. Such contract is awarded upon the express condition
that such work and improvements shall be done in strict ao.odrdahce
and in compliance with the plans and specifications of the City
Engineer therefor, which plans and specifications are hereby made a
part of this ordinance and of the contract awarded, and upon further
conditions among m6hers that the person to whom said contract is
awarded shall furnish to the City of Salina a surety bond in the
approximate sum of the cost of such improvements, guaranteeing the
prompt, proper and workmanlike construction of all the same, together
with a surety "company bond guaranteeing said curb and gutter against
all defects in material and workmansAip for a period of two years
from the date of its completion and acceptance of such work by the
City, together with a good and sufficient surety a =pany bond
running to the State of Kansas in an amount approximately equal to
the contract price of said improvements and conditionedt:that said
L. W. Rexroad shall pay all indebtedness for labor and material
furnished in making the improvements herein provided for..
Section 6. The Board of Commissioners of the City of
Salina are hereby authorized to make and enter into on behalf of
said City all written agreements necessary in order to secure the
construction of.the improvements herein provided for.
Section 7. This ordinance shall take effect and be in
full force from and after its publication once in the officidE city
paper.
