3178 Improving Prescott AVeAn ordinance specifying-.and..selcting.the material to be used and letting a contract for the excavating and grading and surfacing with sand clay Prescott Avenue in the City of Salina$ Kansas, from the west line"o even Street to the east line of Twelfth Street in said City. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That it is hereby determined that Prescott Avenue in the City of Salina, Kansas, from the west line of Eleventh Street to the east line of Twelfth Street in said City shall be surfaced with sand clay. Such surface shall be six (6) inches deep, aryl shall be 26 feet in width, excluding the curb and gutter. Section 2. All excavating, filling and rolling necessary for the.proper construction of such improvements shall be done and all of, such improvements shall be made and done in strict conformity to and in opmplianee with the plans and specifications heretofore made by the City Engineer of Salina.. Kansas, and now on file with tle City Clerk of said City, which plans and specifications are hereby incorporated in and made a part hereof in all respects as fully and completely as though written out at length herein, which said plans and specifications are hereby adopted as and for the plans and specifications of such work and improvements. Section 3. That a contract is hereby awarded to L. W. Hexvoad for the excavating and filling, and surfacing with sand clay the above mentioned street in the limits aforesaid with the materials hereinbefore specified, for the labor actually performed and the materials actually furnished at the following prices: For excavating and grading, 60¢ per cubic yard; for surfacing with sand clay $2.20 per cubic yard. All of said work shall be paid for accord- ing to measurement made by the City Engineer of the City of Salina. It is hereby found and determined that the prices to be paid for the, improvements as aforesaid are less than the prices of each and all of said improvements as shown by the sworn estimates of the City Engineer now on file with the City Clerk of the City of Salina, Kansas. Section 4. Such contract is awarded upon the express con- dition that such work and improvements shall be done in strict accord- ance'with the plans and specifications of the City Engineer therefor, which plans and specifications are hereby made a part of this ordin-" ance and of the.00ntract awarded, and upon further conditions among others that the person to whom said contract is awarded shall furnish to the City of Salina a surety company bond in the approximate sum of the cost of such improvements, guaranteeing the prompt, proper and workmanlike construction of.all the same, together with a good and sufficient suretyvcompany bond running to the State of Kansas I in an amount approximately equal tc the contract price of said improve- ments and conditioned that said L. M. kexroad shall pay all indebted- ness for labor and material furnished in making the improvements herein provided for. Section 5. The Board of Commissioners of the City of Salina are hereby authorized to make and enter into on behalf of said City all written agreembnts necessary in order to secure the construction of the improvements herein provided for. Section 9. This ordinance shall take effect and be in full force from and after its publication once in the official City paper. Introduced for first reading, November 2, 1925.
