3177 Improving 3rd StreetANC
An Ordinance specifying and selecting the material to be used and
letting g contract for the curbing and guttering of Third
Street from the south line of Iron Avenue..south to the Smoky
Hill River, in the City of Salina, Kansas.
BE IT ORDAINED,by the Board of Commissioners of the City of Salina,
Kansas.
Section 1. That it is hereby determined that Third Street
in the City of Salina, Kansas, from the south line of Iron Avenue, suQa
south to the Smoky Hill River in said City shall be curbed and gutter-
ed with one piece combination cement curb and gutter. Said com-
bined:.curb and gutter shall be comprised of a curb six inches thick
at the top, six and one-half inches thick at the throat and twelve
inches deep, with gutter twenty-four inches wide_.ysix thches thick
at the throat and seven inches thick next to the pavement. -
Section 2. All excavating, fillingand rolling necessary
for the proper construction of such improvements shall be done and
all of such improvements shall be made and done in strict conformity
to and in compliance with the plans and specifications heretofore
mgde by the City Engineer of Salina.. Kansas, and now -on file with
the City Clerk of said City, which plans and .specifications are
hereby incorporated in and made a part hereof in all respects as
fully and completely as though written out at length herein, which
said plans and specifications are hereby adopted as and for the
plans and specifications of such work and improvements.
Section 3. That a contract is hereby awarded to L. W.
Rexroad for the curbing, guttering, excavating and filling the above
mentioned street in the limits aforesaid with the materials herein-
before specified, for the curbing and guttering actually laid and
put in place, for the labor actually performed and the materials
actually furnished at the following prices: For excavating and grading
60¢ per cubic yard; for Portland Cement Concrete combined curb and
gutter, 75¢ per lineal foot. All of said work shall be paid for
according to measurement made by the City Engineer of the City of
Salina. It is hereby found and determined that the prices to be paid
for the improvements as aforesaid are less than the prices of each
and all of said improvements as shown by the sworn estimates of the
City Engineer tow on file with the City Clerk of the City of Salina,
Kansas,
Section 4. Such contract is awarded upon the express
condition that such work and improvements shall be done in strict
accordance and in compliance with the plans and specifications of
the City Engineer therefdr,'which plans and specifications are hereby
made a part of this ordinance and of the contract awarded, and upon
further conditions among others that the person to whom said contract
is awarded shall furnish to the City of Salina a surety bond in the
approximate sum of the cost of such improvements, guaranteeing the
prompt, proper and workmanlike construction of all the same, together
with a surety company bond guaranteeing such curb and gutter against
all.defects in material and worrffianship for a period of two years from
the date of its completion and acceptance of such work by the City,
together with a good and sufficient surety company bond running to the
State of Kansas in an amount approximately equal to the contract price
of said improvements and conditioned that said L. W. Rexroad shall
pay all indebtedness for labor and material furnished in making the
improvements herein provided for.
Section 5. ThetBoard of Commissioners of the -City of
'Salina are hereby authorized to make and enter into on behalf of said
City all written agreements necessary in order to secure the construct-
ion of the improvements herein provided for.
Section 6. This ordinance shall take effect and be in
full force from and after its publication once in the official City
paper.
