AN ORDINANCE authorizing and directing the issuance, sale and
delivery of $605,082.00 of negotiable, coupon bonds
of the City of Salina, Kansas, for the purpose of
paying the award found, ascertained and reported
by the Commission appointed.for such purpose, as
a fair cash value of the plant of the Salina Water
Works Compabt; and providing for the levy of a tax
for the payment of the same.
WHEREAS, at a special election duly called and held in the
City of Salina, Kansas, on the 22nd day of September 1925 the
following proposition was submitted to the electors of said City,
to -wit:
"Shall the City of Salina purchase and tkke the plant of
The Salina Water Works Company and the appurtenances there-
unto belonging or in any way appertaining to the same for
the sum of $605,082.00, being the amount ascertained and
found as the value thereof by the Commissioners duly
appointed for such purpose?"
4nd said proposition was at said special election adopted by a
majority of the legal electors of said City voting at such special
election; and,
WHEREAS, all of the proceedings and conditions precedent to
the fixing and ascertainment of such award by such Commissioners,
as provided for in Section 12-811 of the Revised Statutes of Kansas
1923, were prior to such special election and prior to the filing
of the award of such Commissioners duly had and performed; and
WHEREAS, by virtue of the provisions of said Section 12-811
of the Revised Statutes of Kansas 1923 as aforesaid, the Board of
Commissioners of the City of Salina, Kansas, are authorized to
issue bonds to be sold and the proceeds thereof use for the pur-
chase of such plant; NOW THEREFORE,
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas;
Section 1. That the negotiable coupon bonds of the City of
Salina, Kansas, be and the same are hereby authorized and directed
to be issued in the aggregate amount of Six Hundred and Five
Thousand Eighty Two Dollars ($605,082.00), such bonds to be sold
in the manner provided by law and the proceeds thereof to be.used
for the purchase of the plant of the Salina Water Works: -Company
and the appurtenances thereunto belonging or in any way appertaining
to the same, and the Mayor and City Clerk of said"City are hereby
directed to execute and deliver said bonds -as provided herein.
Section 2. Said bonds shall be dated October 1, 1925 and
shall bear interest at the rate of four and one half per centum
per annum, payable semi-annually on the first days of _April -and
October of each year, which interest shall.be evidenced by coupons
attached to and numbered to correspond to the bonds to which they
belong and shall bear the lithographed signatures of the..Mayor and
City Clerk which signatures said officers hereby adopt as their
official signatures to said coupons.. Said bonds shall have the seal
of the City of Salina, Kansas affixed thereto. All of said bonds
and interest coupons shall be,payable at the office of the State
Treasurer of the State of Kansas, in the City of Topeka, the same
being the fiscal agency of the State of Kansas, and shall be re-
gistered by the City Clerk and also with.the Auditor of the State of
Kansas, as required by law, and the full faith, credit and all of
the resources of the City of Salina, Kansas, are hereby irrevocably
pledged for the prompt payment of the principal and interest of
said bonds as they severally mature.
Section 3. All of said bonds shall be in the denomination of
One Thousand ($10000.00) Dollars except bond number one (1) which
shall be in the denomination of One.Thousand Eighty Two ($$,082.00)
Dollars and shall be numbered and become due and payable as follows:

KNOW ALL MEN BY THESE PRESENTS, that the.City of Salina,
in the State of Kansas, acknowledges itself.to owe, and
for value received, promises to pay to the bearer, or if
registered, to the registered holder thereof, the sum of
ONE -THOUSAND DOLLARS

on the first day of October 19 with interest on said sum
from the date hereof at the rale of four and a half (42) per
centum per annum, payable semi-annually, on the presentation
and surrender of the annexed interest coupons as they severally
become due.
Both.principal and interest of this bond are hereby made
payable in lawful money of the United States of America, at the
office of the State Treasurer in the City of Topeka, State of
Kansas, the same being the fiscal agency of the State of Kansas.
This bond is one of a series of six hundred and five (605)
bonds of.like date, tenor and affect, except at to maturity
and except as to bond number one_�(1) which is'issued in the
amount of One Thousand Eighty Two ($p1,0820'00) Dollars, said
bonds being numbered from one (1) to six hundred and five (605)
inclusive, amounting in the aggregate to Six Hundred Five
Thousand Eighty Two ($p6052082.00) Dollars, issued for the purpose
of purchasing.the water plant of the Salina.Water Works Company.
This bond is issued under the authority of^and.in full
compliance with the constitution..and.statutes of the State of
Kansas, including Section 12-811.of the Revised Statutes of
Kansas 1923, pursuant to which there was submitted to the
electors of the City of Salina, Kansas, on the twenty-second
day of September 1925 the following proposition, to -wit:
"Shall the -City of Salina purchase and take the
plant of the Salina Water Works Company and the
appurtenances thereunto belonging or in any way
appertaining to the same for the sum of $605,082.00
being the amount ascertained and found. as the-ftalue
thereof by the Commissioners duly appointed for
such purpose"?
Such proposition so submitted was adopted by the majority of
all the votes cast at such special election.
It is hereby certified, recited and represented, that
all acts, conditions and things required to be done, to
exist, happen or be performed, precedent to and in the
issuance of this bond, have been done, do exist, have happened
and have been performed in due time, form and manner as required
by law, and that the amount of this bond, together with
all other existing indebtedness of the City of Salina.. Kansas,
including this issue of bonds, does not exceed any limitation
prescribed by the constitution..and..statutes of the State of
Kansas, and that the full faith, credit and resources of the
City of Salina, Kansas, are hereby irrevocably pledged for
the punctual payment of principal and interest of this bond
when due; and that an annual tax levy sufficient to pay the
annual interest and principal..of this. -bond -will be levied
upon all the taxable property in the.City of Salina, Kansas.
This bond may be registerdd.n the name of the owner
as provided by the Statutes of the tate of Kansas, at the
office of the State Treasurer.
IN WITNESS iyVHEREOF, the. City of Salina,. Kansas, by
its Board of Commissioners, has caused -its corporate seal to
be hereunto affixed and this bond to be signed by its Mayor
and attested by its City Clerk, and each of the interest
coupons hereto attached to be executed with the lithographed
facsimile signature of said -Mayor and City Clerk,'all-as of

Section 5.. The. City of Salina, Kansas, hereby assumes
the payment of said bonds and interest coupons and promises the
holders thereof that said City will make prompt payment of the bonds
and interest coupons at the respective times set out herein, and it
is hereby made the duty of the property city officials to levy annually,
at time of making the levy for other city taxes, a tax sufficient to
pay the interest and principal of said bonds as the same severally
mature.
Section 6.' That the Mayor and.;Gity Clerk of the City
of Salina are hereby authorized and directed upon the taking effect
of this ordinance to send a certified copy of the transcript of the
proceedings required by law, preliminary to the.issuance of bonds
herein provided for, by registered mail to the State School.Fund
Commission, and that if said State.School Fund..Sommission shall not
within ten (19) days after'receiving such transcript notify such
officers in writing that such Commission desires to purchase the
issue of bonds authorized by said transcript, then the Board of
Commissioners of the City of Salina, Kansas, shall proceed to sell
such bonds for cash in the manner provided by Chapter 93 of the
Laws of the State of Kansas 1925, and shall upon the payment of
the purchase price thereof in cash,.to the City.Clerk, deliver
said bonds to such purchaser..
Section 7. This ordinance shall be in force from and
after its publication in the official city paper.
