3996 Improvement BondsORDINANCE NO. 3996 AN ORDINANCE authorizing and providing for the issuance of Improvement Bonds of the City of Salina, itansas in the sum of $9,873.19 to pay the cost of certain improvements for the protection of the City of Salina and public and private property therein from flood and damage by the overflow of Dry Creek. WHEREAS, pursuant to the provisions of Resolution No. 477 and of Ordinance No. 3820 duly adopted by the governing body of the City of Salina, Kansas a certain contract has been let and performed and certain other work has been done and performed under the direction of the City Engineer of the City of Salina.in the construction of certain improvements for the protection of the City of Salina from floods and damage by the overflow of Dry Creek, in accordance with the specifications of said work as prepared by the City Engineer of said city; item two of Section One, and all of Section Two of said work having been performed under contract let pursuant to said resolution and ordinance at a cost less than the Engineer's estimate of said work, and item One of Section One of said work having been done at the direction of the City Engineer at a cost less than the Engineer's estimate of the cost thereof, all contractors' bids for said portion of said work having been rejected because in excess of the estimated cost of said work; the total cost for said work as done under such contract and under the direction of said City Engineer having been found and determined to be the sum of $9,873.19 which sum is less than'the e'ngineer's estimate of the total cost of all of such work; NOW THEREFORE BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That for the purpose of providing funds to pay the cost of the improvements hereinbefore described, there shall be issued and hereby are issued Internal Improvement Bonds of the City of Salina, Kansas in the total principal sum of $9,873.19, said issue to consist of twenty bonds, numbered from 1 to 20 inclusive, all dated December 1st, 1930 to become due serially in denominations as follows: No. 1 for 373.19 due December 1st, 1931 No. 2 for 500.00 due December lst, 1932 No. 3 for 500.00 due December 1st, 1933 No. 4 for 500.00 due December 1st, 1934 No. 5 for 500.00 due December 1st, 1935 No. 6 for 500.00 due December lst, 1936 No. 7 for 500.00 due December lst, 1937 No. 8 for 500.00 due December lst, 1938 No. 9 for 500.00 due December 1st, 1939 No. 10 for 500.00 due December 1st, 1940 No. 11 for 500.00 due December 1st, 1941 No. 12 for 500.00 due December lst, 1942 No. 13 for 500.00 due December 1st, 1943 No. 14 for 500.00 due December 1st, 1944 No. 15 for 500.00 due December lst, 1945 No. 16 for 500.00 due December 1st, 1946 No. 17 for 500.00 due December lst, 1947 No. 18 for 500.00 due December 1st, 1948 No. 19 for 500.00 due December lst, 1949 No. 20 for 500.00 due December 1st, 1950 All of said bonds shall bear interest at the rate of 441% per annum payable semi-annually on June lst and December 1st, in each year. Sectior, 2. Said bonds ahall be executed by the Mayor and shall be attested by the City Clerk, and the corporate seal of the City shall be affixed thereto. Said bonds shall have attached thereto interest coup -,ns representing the interest thereon and said interest coupons shall bear the fac-simile signatures of the Mayor and City Clerk of said. city. 4. Section 3. Said bonds shall be in the form and shall contain recitals substantially as follows: No. UNITED STATES OF AMERICA STATE OF KANSAS COUNTY OF SALINE CITY OF SALINA INTERNAL IMPROVEMENT BOND 119 KNOW ALL MEN BY THESE PRESENTS, That the City of Salina in the County of Saline, State of Kansas, acknowledges itself to be indebted and for value received hereby promises to pay the bearer the sum of Dollars in lawful money of the United States of America, on the first day of December with interest thereon from the date hereof at the rate of four and one-fourth per cent (44) per annum, payable semi-annually on the first days of June and December in each year, on presentation and surrender of the interest coupons hereto annexed as said coupons severally become due, both principal and interest of this bond being payable at the office of the State Treasurer of the State of Kansas in the City of l'opeka, Kansas, And said city of Salina, Kansas is held and firmly bound by these presents and the full faith, credit and recources ofsaid city are hereby irrevocably pledged for the payment of said principal and interest at maturity. This bond is one of a series of 20 bonds of like date and tenor, excepting denomination and maturity, aggregating the principal sum of $9,873.19, issued by the City of Salina, Kansas, for the prupose of paying the cost of the construction of certain improvements for the protection of the City of Salina from floods and damage by the overflow of Dry Creek, by the authority of and in full compliance with the provisions, restrictions and limitations of the constitution and laws of the State of Kansas, including Sections 12-635 to 12-646 of the Revised Statutes of Kansas 1923, as amended, and all. other provisions of the laws of said state applicable thereto, and this bond and all the other bonds of this series, and all interest thereon are to be paid by the City of Salina, Kansas. And it is hereby declared and certified that all acts, condi- tions and things required to be done and to exist precedent to and in the issuance of this bond have been properly done and performed and do exist in due and regular form and manner as required by the Constitution and lavas of the State of Kansas, and that the total in- debtedness of said city, including this series of bonds, does not exceed any constitutional or statutory limitation. IN WITNESS WHEREOF, thesaid City of Salina, Kansas, has executed this bond by causing it to be signed by its Mayor and its corporate seal to be hereto affixed, attested by its City Clerk and the coupons hereto attached to be signed with the fac-simile signatures of said 6fficers, and this bond to be dated this first day of December, 1930.
