AN ORDINANCE creating a Board of Public Works in the Cit?;* of Salina I
providing for the appointment of members of such Board and de-
fining the duties of such Board. {

BE IT ORDAINED by the Board of Commissioners of the City of Salina,

Kansas:
Section 1 Tha there be and there is hereby created in the
i

City of Salina, an ad 'sory board or commission to be known as
"The Board of Public W ks" -�hich shall consist of seven members
i
-'ho shall serve without m,1enation, to be appointed by the Board
j of Commissioners of the C y of Salina as hereinafter provided.
Four of the members of sue board shall be the Presidents of the
four banks now existing in t City of Salina, and the persons j

shall be, ex -officio, a member such Board, provided that if the
President of any such bank shall e an officer, either elective or

appointive, of the City of Salina such person shall. not be eligible
I
for membership on such board but s, place shall be filled by some

other executive officer of the same nk, to be selected by the Board
of Commissioners of the City of Salin The three remaining members
of said board shall 1,e appointed by th oard of Commissioners of

the City of Salina, and shall hold their ff'ices for a term of t,,,o
years from the date of their ap ointment d until their successors
I are duly ap_ointed. Any vacancy caused by t e death. of resignation j
of any such member shall be filled by appo'_n ent of the Board of j
Commissioners for the unexpired term of such ber. At the expira-

ti -n of the regular term of such members, thei uccessors shale be
ap_,:o` nted in the same manner for a period of tl,r-o ears. Said board
shall select its own chairman and secretary from ng its members
and shall pro•\Tide its own rules of order. The Sec e'ary shall keep
a record of the proceedi4s of said Board and of any ction taken
by said Board. �.
Section 2. After this ordinance shall take effect and such
Board shall have been appointed as herein
provided for, the Board
of Commissioners of the City of Salina shall refer to such Board

of Public i-orks, for its approval or disapr\royal, all petitions
presented to the Board of Com,-issioners for the construction of
,ie any public imF.rovements, the cost of which will exceed 4�y1,040 and
all or any -art of which cost will be paid by taxation against the

�� g y the proceeds of any general bond issue; before
initiating proceedings for any such x_ublic improvements, whether a
petition has been filed therefor or not, the Board of Commissioners
shall refer any s h proposed project to such Board of Public
l,rks for their ap_ oval or disapproval.
Section 3. A proposed purchase of equipment or material
which shall amount t $1,000.00 or more shall, if said Board of
Public vlorks requests, be submitted to said Board for its approval
or disapproval before a y such purchase is made. Notice of any such
proposed purchase shall given to said Board, vrhich may -within
five days thereafter req u t that the matter be submitted to it for
consideration. If no such equ.est be ?ade, such purchase may made
ithout further reference o the matter to such board If a reference
be requested, or of the Boar of Com-Assicners desire to submit the
matter without a request, suc Board shall consider and report on
the matter as herein provided.
Section 4. When any such roposed public improvement or pur-
chase has been referred by the B a d of Commissioners to said Board
of Public Vlorks, it shall be the c.0 y of the Secretary of said Board
to call a meeting of the members o aid_ Board within five da -vs there-
after and said Board shall thereupon onsider any such matter and if
deemed proper, shall hold public hear gs on the same and within rive
days after the first meeting held by s h board to consider any such
matter shal report the same back to th Board of Commissioners with
the approval or disap,roval of any such tier. If said Board. of
Public Works shall not be ready to report any matter considered
by it within five days from the date of an uch proposition is
first considered by it, such fact shall be e orted to the Board of
Commissloners, :ho may grant such additional t me for consideration
as they may deem necessary. Any such re_ort, o request for extension
of time shall be filed with the City Clerk wit i the time herein pro-
vided for.
Section 5. The recommend tM on of said Boa of Public Works
to the Board of Commmissinners o aid city concerni g any matter
considered by it shall be advisory o ly, but any ordinance or reso-
lution adopted by the Board of Commis ioners providing for any such
pu',lic improvement or any such purcha which has been disapproved
by the Board of Public Works shall be ..ted only after five days

Section 8. Whene'ver the Board of Public Works shall so re-
quest, it shall be the duty of any of the officers of the City of
Salina to appear before such Board and Five it such assistance as.
the Board may require, and such information as such officer may
possess concerning any proposed public improvements or purchases,
or the necessity therefor, or the purpose thereof.
Section 9. Any matter to be submitted to said Board of Public
�yorks, or notice to be Civen to said Board, shall be submitted to the
Secretary of said Board., who shall notify t e members thereof .in such
manner as the rules cf such Board may provide.
Section 10. This ordinance shall not bedeemed to affect or
refer to any proposed pilblic improvement, proceedings for vrhich
shall have been commenced prior to the adoptio� of this ordinance,
nor to improvements or purchases made by the Tater :Department, which

are under the jurisdiction of the t"atervorks Ads sory Commission.
Section 11. This ordinance shall take effect and be in force
after its publication in the official city paper,

An Ordinance creating a Board of Public Works in the City of Salina,
Providing for the appointment of members of such Board and
defining the duties of such Board.
BE IT -ORDAINED -by -the -Board of Commissioners -of -the -City -.of -Salina,
Kansas:
Section 1. . That there be and there is hereby created in the
City of Salina, an advisory board or commission to be known as
"The Board of Public Works" which shall consist of seven members
who shall serve without compensation, to be appointed by the Board of
Commissioners of the City of Salina as hereinafter provided. Four of
the members of such board shall be the Presidents of the four banks
now existing'in the City of Salina, and the person who shall from
time to time be the President of each of such banks shall be, ex-
--officio, a member of such Board. -provided. -that if the -President
of any such bank shall be an officer, either elective or appointive,
of the City of Salina, such person shall not be eligible for member-
ship on such board but such place shall be filled by some other
executive officer of the same bank, to be selected by the Board of
Commissioners of the City of Salina. The,three remaining members
of said board shall be appointed by the Board of Commissioners of
the City of Salina, and shall hold their offices for a term of two
years from the date of their appointment and until their successors
are duly appointed. Any vacancy caused by the death or resignation
of any such member shall be filled by.appointment of the Board of
Commissioners for the unexpired term of such member.. At the expira-
tion of theregular` term of such members, their successors shall be
appointed in the -same; manner for a period of two years. Said board
shall select its own chairman and secretary from among its members
and shall provide its own rules of order. The Secretary shall keep
a record of the proceedings of said Board and of any action taken
by said Board.
Section 2. After this ordinance shall take effect and such

provements, the cost of which $1,000.00 and all or any
part of which cost will be paion against the City at large
or by the proceeds of any general bond issue, efore initiating pro-
ceedings for any such public improvements, whether petition has been
filed therefor or not, the Board of Commissioners shall re�z%r any such
proposed project to such Board of Public Works for their appr
disapproval.

Section 3. Any proposed purchase of equipment or material
which shall amount to $1,000.00 or more shall, if said Board of Public
Works requests, be submitted to said Board for its approval or
disapproval before any such purchase is made. Notice of any such pro-
posed purchase shall be given to said Board, which may within five days
thereafter request that the matter be submitted to it for consideration.
If no such request be made, such purchase may be made without further
reference of the matter to such board. If a reference be.requested,
or of the Board of Commissioners desire to submit the matter without a
request, such Board shall consider and report on the matter as herein
provided.
Section 4. When any such proposed public improvement or purchase
has been referred by the Board of Commissioners to said Board of Public
Works, it shall be the duty of the Secretary of said Board to call a
meeting of the members of said Board within five days thereafter and
said Board shall thereupon consider any such matter and if deemed
proper, shall hold public hearings on the same and within five days
after the first meeting held by such board to consider any such matter
shall report the same back to the Board of Commissioners with the approv-
al or disapproval of any such matter. If said Board of Public Works

shall not be ready to report on any matter considered by it within five
days from the date of any such proposition is first considered by it,
such fact shall be reported to the Board of Commissioners, who may grant
such additional time for consideration as they amy deem necessary.
Any such report, or request for extension of time shall be filed with
the City Clerk within the time herein provided for.
Section 5. The recommendation of said Board of Public Works to
the Board of Commissioners of said city concerning any matter con-
sidered by it shall be advisory only, but any ordinance or resolution
adopted by the Board of Commissioners providing for any such public"
improvement or any such purchase which has been disapproved.by the Board
of Public Works shall be adopted only after five days notice by mail
shall have been given'to said Board of Public Works of the time when
any such ordinance shall be presented for final passage, at which time
the members of said Board of Public Works ant any other persons who
may be interested shall have an opportunity to appear before said Board
of Commissioners and state the reasons why any such ordinance or reso-
lution shall not be adopted.
Section_ 6. If any matter is submitted to such Board, and no
report approving or disapproving the same, or a request for additional
time, is returned to the City Clerk within the time herein provided for,
the Board of Coimaissioners may adopt an ordinance providing for such
work or such purchlase without further considerationby or report from
such Board.
Section 7. In addition to the consideration of proposals for the
construction of public improvements or purchases initiated by the Board
Of Commissioners or by petition, it shall be the duty of said Board of
Public Works to make recommendations to the Board of Commissioners
from time to time concerning improvements and public work in the City
of Salina, which said Board may deem necessary, and to consult tith
and advise said Board of Commissioners of the City of Salina from time
to time with reference to proposed public improvements or the purchase'.

Section S. Whenever the Board of Public Works shall so request,
it shall be the duty of any of the officers of the City of Salina to
appear before such Board and give it such assistance as the Board may c
require, and such information as such officer may possess concerning
any proposed public improvements or purchases, or the necessity there-
for, or the purpose thereof.
Section 9. Any matter to be submitted to said Board of Public
Works, or notice to be given to said Board, shall be submitted to the
Secretary of said Board, who shall notify the members thereof in such
manner as the rules of such Board may provide.
Section 10. This ordinance shall not be deemed to affect or
refer to any proposed public improvement, proceedings for which
shall have been commenced prior to the adoption of this ordinance,
nor tocimprovements or purchases made by the Water Department, which
are under the jurisdiction of the Waterworks Advisory Commission.
Section 11. This ordinance shall take effect and be in force
after its publication in the official city paper.
