01-22-2007 MinutesCommission Action # CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS January 22, 2007 4:00 p.m. n The City Commission convened at 3:45 p.m. in a Study Session for a Citizens' Open Forum. The W Regular Meeting of the Board of Commissioners was called to order at 4:00 p.m. in Room 107, City - County Building. A roll call was taken followed by the Pledge of Allegiance and a moment of silence. There were present: Mayor Donnie D. Marrs, Chairman presiding Commissioner Deborah P. Divine Commissioner Alan E. Jilka comprising a quorum of the Board, also present: Jason A. Gage, City Manager Greg Bengtson, City Attorney Lieu Ann Elsey, City Clerk Absent: Commissioner R. Abner Perney Commissioner John K. Vanier II 07-7427II Moved by Mayor Marrs, seconded by Commissioner Jilka, to add Item 8.6 to the agenda. Aye: (3). Nay: (0). Motion carried. CITIZEN FORUM Phil Black, 438 Hazel Court, expressed his support for the bike trails. AWARDS - PROCLAMATIONS (4.1) The day of January 26, 2007 as "Richard Bergen Day" in the City of Salina. John Highkin, Arts and Humanities Director, read the proclamation and announced upcoming events. Mayor Marrs presented the proclamation to Mr. Bergen. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME (5.1) Pubic hearing to consider an application for tax exemption filed by Salina Vortex Corporation for a new manufacturing facility and machinery at 1725 Vortex Avenue. (5.1a) Resolution No. 07-6350. Mayor Marrs opened the public hearing. Dean Andrew, Director of Planning and Community Development, explained the request and the cost -benefit analysis. Jeff Thompson, President of Salina Vortex, thanked staff for their efforts. There being no further comments, the public hearing was closed. 07-7428II Moved by Commissioner Divine, seconded by Commissioner Jilka, to adopt Resolution No. 07-6350. Aye: (3). Nay: (0). Motion carried. Mayor Marrs thanked Salina Vortex for their support in the community. CONSENT AGENDA (6.1) Approve the minutes of January 8, 2007. Page 1 Commission Action # (6.2) Resolution No. 07-6353 authorizing an agreement extension with Community Access Television. 07-7429 Moved by Commissioner Jilka, seconded by Commissioner Divine, to approve the consent agenda as presented. Aye: (3). Nay: (0). Motion carried. Z w DEVELOPMENT BUSINESS None. U ADMINISTRATION (8.1) Second reading Ordinance No. 07-10368 vacating two alleys located in the Pacific Addition. Mayor Marrs noted that Ordinance No. 07-103 68 was passed on first reading on January 8, 2007 and since that time no comments have been received. 07-7430 Moved by Commissioner Jilka, seconded by Commissioner Divine, to adopt Ordinance No. 04-10368 on second reading. A roll call vote was taken. Aye: (3) Divine, Jilka, Marrs. Nay: (0). Motion carried. (8.2) Second reading Ordinance No. 07-10369 providing a change in zoning district classification from R-2 (Multi -Family Residential) to PC -1 (Planned Restricted Business) on property addressed at 715 N. Ninth Street. Mayor Marrs noted that Ordinance No. 07-10369 was passed on first reading on January 8, 2007 and since that time no comments have been received. 07-7431 Moved by Commissioner Divine, seconded by Commissioner Jilka, to adopt Ordinance No. 04-10369 on second reading. A roll call vote was taken. Aye: (3) Divine, Jilka, Marrs. Nay: (0). Motion carried. (8.3) Award bid for the sponsor component of the Bicentennial Center scoreboard and signage project and authorize final financing plan (Project No. 06-1620). Keith Rawlings, Bicentennial Center Director, explained the project, bids received, and project funding. A discussion followed between Commissioner Jilka, Mayor Marrs, and Mr. Rawlings regarding the sponsorships. Mr. Rawlings then responded to Mayor Marrs' questions regarding future advertising projects. 07-7432 Moved by Commissioner Divine, seconded by Commissioner Jilka, to award the project bid for the non -electronic portion of the project to Power Ad at a cost of $21,244. Aye: (3). Nay: (0). Motion carried. 07-743311 Moved by Commissioner Jilka, seconded by Commissioner Divine, to finance the project internally through general fund resources. Aye: (3). Nay: (0). Motion carried. (8.4) Resolution No. 07-6351 authorizing a license agreement with Clarence and Connie Wilson to allow the installation of a private water line within the right-of-way on North Fifth Street. Martha Tasker, Director of Utilities, explained the request, bids received, and license agreement, and funding for the installation of the water line. A discussion followed between Commissioner Divine, Ms. Tasker, Director of Planning and Community Development Dean Andrew, and City Attorney Greg Bengtson regarding Sections 1 and 10 of the agreement. Mr. Bengtson suggested that the sections be amended to clarify future property owner rights. Page 2 Commission Action # Commissioner Divine expressed her appreciation for staff's work. Connie Wilson, 2404 N. Fifth Street, thanked the Commission. N 07-2434 Moved by Commissioner Divine, seconded by Commissioner Jilka, to adopt Resolution W No. 07-6351. Aye: (3). Nay: (0). Motion carried. (8.5) Resolution No. 07-6352 authorizing an agreement for a comprehensive downtown parking master plan with Rich and Associates, Inc. in the amount of $25,000. 0 U Jason Gage, City Manager, explained the project, funding, and the agreement. Commissioner Divine expressed her appreciation for the amount of public input that has been put into the project. Commissioner Jilka commented on the PUMA study, noting that the plan has been a partial success. Commissioner Jilka continued to explain that he felt that if the PUMA plan succeeds, there would be a need for a parking plan, but it is not at that point yet. 07-7435 11 Moved by Commissioner Divine, seconded by Mayor Marrs, to adopt Resolution No. 07- 6352. Mayor Marrs explained that there is a need for the information and it was important to have a plan on how to proceed. Mayor Marrs called the question. Aye: (2). Nay: (1) Jilka. Motion carried. II (8.6) Authorize the City Manager to execute renewals of Agreement to Provide Administrative Services for a Self -Funded Health Benefit Plan and Individual and Aggregate Stop -loss with Blue Cross B1ueShield of Kansas. Natalie Fischer, Director of Human Resources, explained the current plan, the renewal plan, and benefit funding. A discussion followed between Mayor Marrs and City Manager Jason Gage regarding the percentage of increase and the Employee Benefit Fund. 07-7436 Moved by Commissioner Jilka, seconded by Commissioner Divine, to authorize the City Manager to execute an Agreement to Provide Administrative Services for a Self -Funded Health Benefit Plan and Individual and Aggregate Stop -loss with B1ueCross B1ueShield of Kansas. Aye: (3). Nay: (0). Motion carried. (3-0) OTHER BUSINESS Commissioner Divine complimented the Street Division on their snow removal efforts. 07-7437 Moved by Commissioner Jillka, seconded by Commissioner Divine, to recess into executive session for 15 minutes to discuss with legal counsel a matter subject to attorney-client privilege for the reason that public discussion of the matter would waive that privilege and adversely affect the City's interest in the matter and reconvene at 5:00 p.m. Aye: (3).
