BE I-' ORDAINED by the Board of COI"1"1issioners of the City of Salina Kansas, as foll>ws : SEction 1, DEPT7I' T�CT'1S, The fo7_lowing definitions shall apply in the interpretation and the -enforcement of this ordinance: (A) I,'iILK* Milk is hereby defined to be the lacteal secretion obtained by the complete milking of one or more healthy cows, excluding that obtainer; within fifteen days before and five says after calving, or such longer period as may be necessary to render the irxiUc practically colostrum free; which contains not less than eight and one-half per cent o' milk solids -not -fat, and not less than three and one-fourth Per cent of milk fat, (B) MILK PAT OR BUTTER FAT. Milk fat or butter fat is tae fat of milk. (C) CREAMS Cream is a portion of milk which contains not; less than eighteen per cent milk fat, and the acidity of which is not more than 0.20 per cent, expressed as lactic acid. -Tilipping cream ohall con- tain not less than 30 per cent milk fat. (D) SKII,21,,IED, ITILK. Skimmed milk is milk from which a sufficient :portion of milk fat has been removed to reduce its milk fat per- centage to less than three and one-fourth per cent. (E) T, ILK OR SK111 ,,TD-FeILK BEVERAGE. A milk beverage or a skiimled- milk beverage is a food compound or confection consisting of milk or ski2rmied milk as the case may be, to which has been added a syrup or flavor consisting of wholesome ingre:Iients. 0 (F) BUTTERMILK. .Buttermilk is the product vahich remains when fat is removed from milk or cream in the process of churning. It con- tains not less than eight per cent of milk solids -not -fat. ( G ) CLZmTJRED BUTTLRI<LILK. Cultured buttermilk is the product re- sulting from the so -.)ring or treatment, by a lactic acid culture, of milk or milk products. It colitains riot less than eigYit per cent of milk solids -not -fat, and shall be pasteurized before adding; the culture. (H) VITAMIN D MILK. Vitamin D milk is milk the vitamin D content of which has been increased by a method and in an amount approved by t_:ie health officer. (I) RECOIVSTITU'fED OR RECO1,1 INED '_ILK. (T) BACTERICIDE. The terra "bactericide" small be taken to mean any bacetericidal substance or process Approved by the health officer. (U) P7:f?SOI?. The word "person" as used in this ordinance shall mean "person., firm., corporation, or association". Section 2. TLE UA�1Tii 01' ADULTERATED., 11aSBRATIDED OR UINGRADET) ,,ILT OR I:IT�i P tO' JUCTS PROHInITEDD, No person shall within the ''ity of Salina, or it piblice jurisdiction produce, sell, offer, or expose for sale, or have in his possession, with intent to se1.l, any milk or milk product -,;hick i. adulterated, misbranded or ungraded, or ,:hick contains any visible dirt or sediment. It shall be unlawful for any person, elsewhere than in a private home, to have in posses. -cion any adulterated., misbranded, or ungraded milk or ni lk product, or any milk or ---ilk product which contains any visible dirt or sediment. Section 3. F , TT - E. 1� S. —'- i{; -Tull be unlativful for any person to bring :i xrto or receive in to the City of Salina, or its police jurisdiction, for sale, or to sell, or offer for sale tl.erein, or to have in storage where mile. or milk products are sold or served, or kept fo • sale, any milk or mile product defined in this ordinance, who does not possess a permit from the health officer of the City of Salina, and on whose vehicle and in whose place of business there does not appear in a conspicious place the permit number of figures at least three inches high ar.d one and one-half inches wide, and on any such vehicle the name of the holder of such permit of the name under which he is engaged in business. Before any such permit shall be issued by the health officer, the person desiring the same shall file with the health officer an applicat-4_on signed by such person, which shall statb the name of such person and the name under which he does bu:-,iness, the kind of business in Which such person is engaged and for which he desires such permit, the location of the dairy fare, milk plant, or other place of business for w'nich such permit was desired., the nut-ber of cows 1,, -e -.-.t on any such dairy farm, in case the Epplicant is a milk producer, whether the same are milked or not, and the number and kind of vehicles used by any such person in Connection with the sale or distribution of such milk, together with such other informa- ton as the health officer may require, and shall pay to the health officer the fees provided for in this ordinance, which fees shall be accounted for and turned over by the health office# to the City Clerk and placed in the City Treasury to the credit of th(; _Milk Inspection department of the general fund of said:. city. .Any such permit shall rema.'kn in effect only for the rena.inder of the calendar year during, t�rhich it is issued and shall expire on December 31st of such, year. VJ'henever after any such pernit is issued the person holding the Sanne shall have or keep any additional cows on his premises not listed in his application for such pej�mjit, or z all use any additional vehicles not listed and described in said application, he sp all file with the health officer a sup?)lc:nental application and pay such additional fees t1lerefor as may be required in this ordinance, such additional fees to be computed as if s i.1,ch additional coves or vehicles were included in the original application and in the permit issued to such person for that year. Such a permit may be revoked by the health officer upon the violation by the holder of any of the t erms of this ordinance or in any emergency when in the judgment of the health officer the milk or n1311I product in question has become a public health r:enace, or whenever for any of#er cause in the opinion of the healtr_, officer the public health requires such revocation, provided that t -.e holder Of such permit shall, after complying with such revocation, have the right to appeal to the Board. of Comxrlissioners of the Cit;y� of Salina, ti'lilic7 board, after hearing t" e facts upon which such revocation ti as base(--'., shall either sustain the order of revocation made by the health officer or set the same adide and reinstate sii&., ;::ermit, and the decision of the Board of Corm issioners on any such appeal shall be f inal.
