AN ORDINANCE ratifying and confirming a contract for the building and
construction of certain lateral sanitary sewers in Lateral Sani-
tary Sewer Districts No. 165 and 166, and providing for the
issuance of temporary notes to pay the cost thereof pending
issuance and sale of bonds.
BE IT ORDAINED by the Board of Commissioners of the Oity of Salina,
Kansas:
Section 1. That the acceptance by the City of Salina of the
proposal of Ray G. Tripp Construction Company of Herington, Kansas,
hereinafter referred to as the "Contractor" as submitted to the Board
of Commissioners on April 27, 1931, which is hereby found and determined
to be the lowest and best bid for such work, and the contract awarded
by the Board of Commissioners of said city to said contractor and signed
on behalf of the City by the Mayor on April 27, 1931, for the construc-
tion of certain lateral sanitary sewers ins Lateral Sanitary Sewer Dis-
tricts No. 165 and 165 as provided for in Ordinance No. 4040 at and
for the unit prices contained in said proposal, which proposal and con-
tract are hereby referred to and made parts of this ordinance, be and
the same is hereby ratified and confirmed, said proposal r,eing within
the estimated cost of said improvements as shown by the sworn estimate
of the City Engineer filed in the office of the City ClerV, which es-
timates are hereby referred to and made a part of this ordinance.
Section 2. That said lateral sanitary sewers shall be built
and constructed in accordance with the plans and specifications therefor
prepared by the City Engineer on file in the office of the City Clerk
and in accordance with the proposal of said -contractor and under the
terms of said contract entered into between the City and said-ontractor
on April 27, 1931, which said plans, specifications, proposal and
contract are hereby referred to and made parts of this ordinance, said
work to be done and the material, equipment, appliances and appurtenances
necessary and required in connection therewith to be performed and
furnished in accordance with said plans and specifications, conditioned
however upon the furnishing by the contractor of the contract, maintenance
and statutory bonds within the time required by said contract.
Section 3. That temporary notes signed by the Mayor and attested
by the City `'lerk bd issued from time to time as the work progresses
in the manner and form as required by lawn, the total amount thereof
not to exceed the contract price for such work, such notes to bear
interest not to exceed 4-1/4% per annum and to be issued in such
amounts and at such time as money for the payment of the cost of such
work may be required, such notes to be issued to said contractor and
to be redeemed and cancelled at the time that permanent bonds are issued
in lieu thereof.
Section 4. This ordinance shall take effect and be in force
from and after its publication in the official city paper.
